14-YEAR-OLD KILLED; OTHERS INJURED AFTER SUV HITS BOAT TRAILER ON ROADSIDE

SOUTH YARMOUTH, MASSACHUSETTS – [YPD MEDIA STATEMENT] - The Yarmouth Police Department is investigating a vehicle crash that left a 14-year-old fatally injured.

Shortly after 1 p.m. on Friday, August 30, 2024, Yarmouth Police received multiple 911 calls reporting a person was pinned between a boat and the vehicle towing it on North Main Street, just South of the Great Western Road intersection. Officers responded to the scene and Yarmouth Fire Department’s Heavy Rescue was requested.

A truck towing a boat trailer had pulled to the side of the roadway with a broken axle. Passengers had got out to attempt to fix it. A Cadillac Sport Utility Vehicle traveling South on North Main Street struck the boat trailer from behind, causing it to hit the people working on the damaged axle.

As a result of the crash, a 14-year-old boy was killed, and two others were transported to Cape Cod Hospital. Their condition is unknown.

The operator of the Cadillac remained on scene and cooperated with the investigation.

The Yarmouth Police ask the community to keep this family, their loved ones, and first responders in their thoughts.

Yarmouth Police and the Cape Cod Regional Law Enforcement Council Crash Reconstruction Unit are investigating the crash. Anyone with information is asked to contact police at 508-775-0445.

FEDS: STOUGHTON COP ALLEGEDLY MURDERED PREGNANT WOMAN, STAGED IT AS SU***DE TO HIDE SEXUAL RELATIONSHIP WHEN SHE WAS A MINOR


BOSTON – [DOJ MEDIA STATEMENT / NO BOOKING PHOTO] - A former Stoughton, Mass. police officer has been charged in federal court in Boston with allegedly murdering a young woman to prevent her from disclosing information about his longstanding s*xual exploitation of her while he was on duty, beginning when she was a minor.

Matthew Farwell, 38, of North Easton, Mass., has been indicted on one count of killing a witness or victim. Farwell was arrested this morning and will make an initial appearance in federal court in Boston at 2:30 p.m. today.

According to the indictment, on or about Feb. 1, 2021, Farwell allegedly killed Sandra Birchmore by strangulation. It is alleged that Farwell staged her body and apartment to make it appear as if Birchmore had committed su***de. The indictment alleges that Farwell killed Birchmore with the intent to prevent law enforcement from learning about Farwell’s commission or possible commission of federal offenses.

According to court documents, Farwell was a sworn officer of the Stoughton Police Department beginning on or about March 27, 2012, until on or about April 1, 2022. In his capacity as a police officer, Farwell served as an instructor for the Stoughton Police Department’s Explorer’s Program, which is a vocational education program designed for youth to learn about careers in law enforcement. Sandra Birchmore joined the Stoughton Explorers Program in 2010, when she was 12 years old. Farwell allegedly used his authority and access to groom, s*xually exploit and ultimately s*xually abuse Birchmore when she was 15 years old and continued to have s*x with her when she became an adult.

On several occasions, Farwell allegedly engaged in s*x acts with Birchmore while on duty as a Stoughton police officer. To conceal this activity, it is alleged that Farwell falsely represented that he had worked certain hours, when in fact he was not working but engaging in s*x acts with the then-minor victim. Farwell’s s*xual contact with Birchmore continued until her death on Feb. 1, 2021.

In December 2020, Birchmore learned that she was pregnant. According to court documents, she was excited about the pregnancy: scheduling doctors’ appointments, purchasing items for childcare and telling loved ones how happy she was to become a mother. Soon after she learned she was pregnant, Birchmore told Farwell that he was the father of the child and that she expected him to be involved, at least in part, in the child’s life. Birchmore disclosed to loved ones that Farwell allegedly became violent with her when they discussed the pregnancy and his role in the child’s life. At one point while she was pregnant, Farwell allegedly held Birchmore in a headlock and told her that he wished she were dead.

On or about Jan. 20, 2021, Birchmore’s friend called the Stoughton Police Department and referenced Farwell and Birchmore’s s*xual relationship. Upon learning this, Farwell allegedly then sent Birchmore angry text messages and, a few days later – approximately one week prior to Birchmore’s death – Farwell visited Birchmore at her apartment in Canton and asked her if she could give him a spare apartment key and keep it a secret. It is further alleged that one week prior to her death, Farwell visited Birchmore’s apartment and began looking through her closets and bathroom, conduct which made her uncomfortable. The court documents allege that, on Feb. 1, 2021, facing perceived imminent disclosure of his criminal conduct, Farwell murdered Birchmore to silence her.

According to court documents, while Birchmore’s death was initially ruled a su***de, the federal investigation probed old evidence and revealed critical new evidence leading to the charge against Farwell.

The charge of killing a witness or victim carries a mandatory sentence of death or life in prison. Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and statutes which govern the determination of a sentence in a criminal case.

Acting United States Attorney Joshua S. Levy and Jodi Cohen, Special Agent in Charge of the Federal Bureau of Investigation, Boston Division made the announcement today. The Massachusetts Attorney General’s Office, Massachusetts State Police, Stoughton Police Department and Norfolk District Attorney’s Office provided assistance in the investigation. Assistant U.S. Attorneys Elizabeth Riley-Cunniffe, Torey B. Cummings and Brian A. Fogerty of the office’s Human Trafficking & Civil Rights Unit are prosecuting the case.

The details contained in the charging documents are allegations. The defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.

GHOST GUN, HIGH CAP. MAGS., NEARLY $52K FOUND IN DRUG TRAFFICKER'S SAFE, COPS SAY...

[FPD MEDIA STATEMENT] Falmouth Police Officers, working with the Massachusetts State Police and the DEA Cape Cod Drug Enforcement Taskforce, arrested Kane Washington (31, Falmouth) yesterday after a four month long investigation. Mr. Washington was stopped in his car and found to be in possession of large quantities of fentanyl & crack co***ne at the time of the arrest. A subsequent search warrant at his residence revealed more fentanyl and crack co***ne. In total, investigators recovered 90 grams of fentanyl and nearly 11 grams of crack co***ne. Mr. Washington has been charged with trafficking in fentanyl, possession to distribute crack co***ne, and other related charges.

UPDATE:

Upon executing a search warrant on a safe owned by Kane Washington subsequent to his arrest, investigators recovered a "ghost gun" (manufactured illegally with no serial number), 5 high capacity magazines, approximately 150 rounds of ammunition, and nearly $52,000 in cash.

Mr. Washington was arrested yesterday after a 4 month long investigation, and is being charged with trafficking in fentanyl, possession of crack co***ne with intent to distribute, charges related to the items found in his safe, and other related charges.

This investigation was the product of collaboration between the Falmouth Police Department, the Massachusetts State Police, and the Cape Cod Drug Enforcement Agency office.

HYANNIS, MASSACHUSETTS – [TOWN OF BARNSTABLE MEDIA STATEMENT] - On Wednesday, August 21, 2024, Vineyard Wind confirmed that pieces of foam collected on Hyannisport beaches, and which were reported through the Vineyard Wind Debris Reporting Hotline, are from the damaged Vineyard Wind turbine blade.

The Town of Barnstable would like to remind the public that Vineyard Wind is responsible for collecting and removing any/all related debris, and only trained Vineyard Wind employees and/or Vineyard Wind contractors should handle debris.

- DO NOT put any debris in your home garbage for collection.

- DO NOT bring the debris to the Barnstable Transfer Station.

- DO notify the Vineyard Wind Reporting Hotline directly and immediately if you identify debris so they can remove it for analysis and proper disposal.

FEDS: FALMOUTH WOMAN AGREES TO PLEAD GUILTY TO EMBEZZLING OVER $1.3 MILLION

BOSTON, MASSACHUSETTS – [DOJ MEDIA STATEMENT/NO BOOKING PHOTO] - The former bookkeeper of a Falmouth flooring company has been charged and has agreed to plead guilty in connection with embezzling more than $1.3 million from her employer.

Susan Figuerido, 73, of Falmouth, was charged with wire fraud and filing a false tax return. A plea hearing has not yet been scheduled by the Court.

According to the charging documents, between June 2015 and February 2023, Figuerido embezzled more than $1.3 million from her employer by writing checks to herself drawn on her employer’s bank account. To conceal her scheme, Figuerido allegedly did not record the checks that she wrote to herself in her employer’s accounting system. It is further alleged that Figuerido did not report or include the funds that she embezzled on her federal income tax filings, resulting in a tax loss of approximately $353,000.

The charge of wire fraud provides a sentence of up to 20 years in prison, three years of supervised release and a fine of up to $250,000 or twice the gross gain or loss. The charge of filing a false tax return provides for a sentence of up to three years in prison, one year of supervised release and a fine of $250,000 or twice the gross gain or loss. Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and other statutory factors.

Acting U.S. Attorney Joshua S. Levy; Jodi Cohen, Special Agent in Charge of the Federal Bureau of Investigation, Boston Division; and Harry T. Chavis Jr., Special Agent in Charge of the Internal Revenue Service’s Criminal Investigations in Boston made the announcement today. The Falmouth Police Department provided valuable assistance with the investigation. Assistant U.S. Attorney Kristen A. Kearney of the Securities, Financial & Cyber Fraud Unit is prosecuting the case.

BPD MEDIA STATEMENT: Barnstable Police Arrest and Charge Man for Two Robberies 24 Hours After He Was Arrested and Released for Car Break-Ins

BARNSTABLE — The Barnstable Police Department announces the arrest of an 18-year-old Orleans man who was charged with breaking into multiple vehicles, released, and then charged with two robberies 24 hours later.

AIDEN SANDERS, AGE 18, OF ORLEANS, was arrested and charged with:
• Breaking and Entering Motor Vehicle (Four Counts)
• Larceny from a Motor Vehicle (Four Counts)
• Unarmed Robbery (Two Counts)
• Trespassing

On Tuesday Aug. 20, SANDERS was arrested and charged with breaking into multiple vehicles in the area of Main Street, Hyannis. Multiple vehicles were reportedly broken into Monday night into Tuesday morning. Investigation by Barnstable Patrol Officers and Detectives lead to the identification and arrest of SANDERS.

SANDERS was released from the Barnstable Police Department on personal recognizance by the on-call bail commissioner and was scheduled to be arraigned at Barnstable District Court Wednesday morning, however he failed to appear.

On Wednesday Aug. 21, at approximately 10:50 a.m., Barnstable Patrol Officers and Detectives responded to two reported robberies in the area of Beares’s Way and Route 28. Based on witness descriptions and video surveillance, SANDERS was identified as the suspect. Responding officers located SANDERS attempting to flee the area on foot, however officers were able to apprehend him on a neighboring street.

SANDERS was ordered held on $5,000 cash bail and is scheduled to be arraigned at Barnstable District Court on Thursday, Aug. 22.

The investigation regarding the motor vehicle breaks on Main Street Hyannis is still active and ongoing. ERO Boston arrests Chinese national charged with s*x crimes against Massachusetts residents

BOSTON, MASSACHUSETTS — [ICE MEDIA STATEMENT/NO BOOKING PHOTO] - Enforcement and Removal Operations Boston apprehended an unlawfully present 43-year-old Chinese national charged with s*x crimes against Massachusetts residents. Deportation officers with ERO Boston arrested Yao Zhang July 5 in Medford.

“Yao Zhang has been charged with some serious and disturbing crimes against inhabitants of our Massachusetts neighborhoods,” said ERO Boston Field Office Director Todd M. Lyons. “He represents a threat to residents that our officers cannot allow to continue. ERO Boston will continue to prioritize public safety by arresting and removing egregious noncitizen offenders from our New England communities.”

U.S. Border Patrol arrested Zhang Sept. 26, 2019, after he unlawfully entered the United States.

On Oct. 26, 2019, U.S. Citizenship and Immigration Services issued Zhang a notice to appear before a Department of Justice immigration judge.

ERO Oakdale released Zhang Dec. 13, 2019, on an immigration bond.

The Dedham District Court arraigned Zhang May 6, 2022, on three counts of indecent assault and battery on a person over 14 years old.

The Cambridge District Court arraigned Zhang April 3 on the charge of indecent assault and battery on a person over 14 years old. Later that day, ERO Boston lodged an immigration detainer against Zhang with the Middles*x County Sherriff's Department.

The Cambridge District Court, arraigned Zhang May 31 on charges of indecent assault and battery on a person over 14 years old.

Deportation officers with ERO Boston arrested Zhang July 5 in Medford. ERO Boston cancelled Zhang’s immigration bond. Zhang remains in ERO custody. ERO Boston intends to hold Zhang pending his next immigration court hearing based on his current criminal charges.

Noncitizens who are apprehended by ICE have their case reviewed by an ICE officer to determine their custody status. Noncitizens subject to mandatory detention are placed in ICE detention facilities, while those who are released constitute ERO’s non-detained docket. ICE officers weigh a variety of factors when making general custody determinations, including criminal record, immigration history, community ties, flight risk, and whether the individual poses a potential threat to public safety or national security.

ICE detention is not punitive, and ICE uses its limited detention resources to detain noncitizens to secure their presence for immigration proceedings or removal from the United States, as well as to detain those who are subject to mandatory detention or for whom an ICE officer determines a public safety threat or flight risk is present. Every case, whether detained or non-detained, remains part of ERO’s caseload and is actively managed and monitored until it is formally closed.

ICE takes many factors into account when targeting and arresting individuals, including their criminal and immigration history. ICE conducts an individualized determination in each case to assess whether arrest and removal is warranted. This determination includes an assessment of whether the person is removable under the law, as well as other aggravating and mitigating factors. ICE is committed to enforcing immigration laws humanely, effectively, and with professionalism.

Detainers are critical public safety tools because they focus enforcement resources on removable noncitizens who have been arrested for criminal activity. Detainers increase the safety of all parties involved — ERO personnel, law enforcement officials, removable noncitizens and the public — by allowing an arrest to be made in a secure and controlled custodial setting as opposed to at-large within the community. Because detainers result in the direct transfer of a noncitizen from state or local custody to ERO custody, they also minimize the potential that an individual will reoffend. Additionally, detainers conserve scarce government resources by allowing ERO to take criminal noncitizens into custody directly rather than expending resources locating these individuals at-large.

ERO conducts removals of individuals without a lawful basis to remain in the United States, including at the order of immigration judges with Department of Justice’s Executive Office for Immigration Review. The Executive Office for Immigration Review is a separate entity from the Department of Homeland Security and U.S. Immigration and Customs Enforcement. Immigration judges in these courts make decisions based on the merits of each individual case, determining if a noncitizen is subject to a final order of removal or eligible for certain forms of relief from removal.

ERO Boston arrests Brazilian national charged locally with attempted murder, stalking, kidnapping

WORCESTER, MASSACHUSETTS — [ICE MEDIA STATEMENT/NO BOOKING PHOTO AVAILABLE] - Enforcement and Removal Operations Boston apprehended an unlawfully present 33-year-old Brazilian national charged locally with attempted murder, stalking, intimidation, kidnapping and two counts of vandalizing property. Deportation officers from ERO Boston arrested Evandro Ribeiro-Rosa Aug. 12 at the Worcester District Court.

“Evandro Ribeiro-Rosa allegedly committed a number of violent crimes against a member of our Massachusetts community,” said ERO Boston Field Office Director Todd M. Lyons. “We will not allow noncitizen criminals to repeatedly victimize our neighborhoods. ERO Boston will continue to prioritize public safety by arresting and removing egregious noncitizen offenders from New England.”

U.S. Border Patrol arrested Ribeiro-Rosa Sept. 16, 2021, after he unlawfully entered the United States near Nogales, Arizona. Border Patrol officials served Ribeiro-Rosa with a notice to appear before a Department of Justice immigration judge and released him from custody.

The Worcester Police Department arrested Ribeiro-Rosa July 16 and charged him with the offenses of attempted murder, stalking, intimidation, kidnapping and two counts of vandalizing property. Later that day, ERO lodged an immigration detainer against Ribeiro-Rosa with the Worcester Police Department following his arrest.

[Ribeiro-Rosa was released from custody July 23 on a $2,500 bail without honoring the ERO immigration detainer.]

The Worcester Police Department arrested Ribeiro-Rosa Aug. 8 on an outstanding default warrant for failure to appear. Later that day, ERO Boston lodged another immigration detainer against Ribeiro-Rosa with the Worcester Police Department.

Deportation officers from ERO Boston arrested Evandro Ribeiro-Rosa Aug. 12 at the Worcester District Court. The court surrendered custody of Ribeiro-Rosa based on the active immigration detainer. Ribeiro-Rosa remains in ERO custody.

As part of its mission to identify and arrest removable noncitizens, ERO lodges immigration detainers against noncitizens who have been arrested for criminal activity and taken into custody by state or local law enforcement. An immigration detainer is a request from U.S. Immigration and Customs Enforcement to state or local law enforcement agencies to notify ICE as early as possible before a removable noncitizen is released from their custody. Detainers request that state or local law enforcement agencies maintain custody of the noncitizen for a period not to exceed 48 hours beyond the time the individual would otherwise be released, allowing ERO to assume custody for removal purposes in accordance with federal law.

Detainers are critical public safety tools because they focus enforcement resources on removable noncitizens who have been arrested for criminal activity. Detainers increase the safety of all parties involved — ERO personnel, law enforcement officials, removable noncitizens and the public — by allowing an arrest to be made in a secure and controlled custodial setting as opposed to at-large within the community. Because detainers result in the direct transfer of a noncitizen from state or local custody to ERO custody, they also minimize the potential that an individual will reoffend. Additionally, detainers conserve scarce government resources by allowing ERO to take criminal noncitizens into custody directly rather than expending resources locating these individuals at-large.

ERO conducts removals of individuals without a lawful basis to remain in the United States, including at the order of immigration judges with Department of Justice’s Executive Office for Immigration Review. The Executive Office for Immigration Review is a separate entity from the Department of Homeland Security and U.S. Immigration and Customs Enforcement. Immigration judges in these courts make decisions based on the merits of each individual case, determining if a noncitizen is subject to a final order of removal or eligible for certain forms of relief from removal.

ERO Boston arrests Guatemalan national charged with unlawful re-entry, assault, battery

(Lynn District Court didn't honor ICE Immigration Retainer and released Mendez after A&B arraignment back in May...)

BOSTON, MASSACHUSETTS — [ICE MEDIA STATEMENT] - Enforcement and Removal Operations Boston apprehended an unlawfully present 27-year-old Guatemalan national charged with illegal reentry after removal and assault and battery on a family member. Deportation officers from ERO Boston arrested Darvin Joel Mendez-Lopez July 23 in Lynn.

This arrest was part of a national ERO operation. Deportation officers obtained and executed 50 arrest warrants during the one-day nationwide law enforcement effort July 23. The warrants are related to ICE’s Title 8 authority over noncitizens who threaten public safety and have previously been removed from the United States.

“Darvin Joel Mendez-Lopez repeatedly broke U.S. immigration law and has now been charged with assaulting a Massachusetts resident,” said ERO Boston Field Office Director Todd M. Lyons. “Our officers cannot allow such individuals to threaten our communities. ERO Boston remains dedicated to our mission of prioritizing public safety by apprehending and removing egregious noncitizen offenders from out New England neighborhoods.”

Between March 4 and March 27, 2015, U.S. Border Patrol apprehended Mendez on two separate occasions after he unlawfully entered the United States near McAllen, Texas.

On March 5 and March 28, 2015, designated officials in McAllen ordered Mendez removed from the United States.

ICE removed Mendez from the United States to Guatemala March 10, 2015, and again April 6, 2015.

The Lynn District Court arraigned Mendez May 12, 2020, for assault and battery. Later that day, ERO Boston issued an immigration detainer against Mendez with the Lynn District Court. However, the detainer was not honored, and the court released Mendez from state custody.

The U.S. District Court for the District of Massachusetts issued a warrant for Mendez’s arrest Aug. 25, 2020, for illegal reentry after removal.

Mendez fled the United States Sept. 4, 2020, from New York to Mexico City, Mexico. From there, Mendez traveled to Guatemala, where he resided.

U.S. Border Patrol apprehended Mendez on three occasions: May 17, June 16 and June 19, 2021, after he unlawfully reentered the United States in Texas. On each occasion, U.S. Border Patrol processed Mendez as a voluntary return.

Mendez unlawfully reentered the United States on an unknown date at an unknown location, without being inspected, admitted or paroled by a U.S. immigration official.

On Feb. 26, 2024, the ICE Tip Line received information regarding a previously removed noncitizen living in Lynn with an ICE warrant of removal for illegal reentry.

Deportation officers from ERO Boston arrested Mendez July 23 in Lynn. Later that day, the U.S. District Court for the District of Massachusetts arraigned Mendez for illegal reentry after removal. Mendez remains in ERO custody.
