FG Drags 36 Governors To Supreme Court Over LGAs Autonomy
The Federal Government has instituted a legal action against the governors of the 36 states of the federation at the Supreme Court over alleged misconduct in the administration of Local Government Areas.
The suit filed by the Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi, is seeking full autonomy for all local government areas in the country.
In suit, the Federal Government specifically prayed the court to issue an order, prohibiting state governors from embarking on unilateral, arbitrary and unlawful dissolution of democratically elected local government leaders.
The governors of the 36 states were sued through their respective Attorneys General.
The suit is also asking for an order permitting the funds standing in the credits of local governments to be directly channelled to them from the federation account in line with the provisions of the constitution as against the alleged unlawful joint accounts created by governors.
The Federal Government also prayed the Supreme Court for an order stopping governors from further constituting caretaker committees to run the affairs of local governments as against the constitutionally recognized and guaranteed democratic system.
It equally applied for an order of injunction restraining the governors, their agents and privies from receiving, spending or tampering with funds released from the federation account for the benefits of local governments when no democratically elected local government system is put in place in the states.
In the 27 grounds it listed in support of the suit, the Federal Government argued that Nigeria, as a federation, was a creation of the 1999 Constitution as amended, with the president as head of the federal executive arm, swearing on oath to uphold and give effects to provisions of the constitution.
The Federal Government told the apex court that the governors represent the component states of the federation with executive governors who have also sworn to uphold the constitution at all times.
It holds constitution of Nigeria recognizes federal, states and local governments as three tiers of government and that the three recognized tiers of government draw funds for their operation and functioning from the federation account created by the constitution.
“That by the provisions of the constitution, there must be a democratically elected local government system and that the constitution has not made provisions for any other systems of governance at the local government level other than democratically elected local government system.
“That in the face of the clear provisions of the constitution, the governors have failed and refused to put in place a democratically elected local government system even where no state of emergency has been declared to warrant the suspension of democratic institutions in the state.
“That the failure of the governors to put democratically elected local government system in place, is a deliberate subversion of the 1999 constitution which they and the president have sworn to uphold.
“That all efforts to make the governors comply with the dictates of the 1999 constitution in terms of putting in place, a democratically elected local government system, has not yielded any result and that to continue to disburse funds from the federation account to governors for non-existing democratically elected local government is to undermine the sanctity of the 1999 constitution.
That in the face of the violations of the 1999 constitution, the federal government is not obligated under section 162 of the constitution to pay any state, funds standing to the credit of local governments where no democratically elected local government is in place.”
The Supreme Court has fixed May 30 for hearing.

UPDATED: Aren Eggon Pegs N5,000 As Maximum Bride Price, Four Basins Of Ebyekpyen For Eggon Ladies

The Aren Eggon, HRH Justice Ahmed Ubangari Alaku (Rtd), has pegged N5,000 as bride price with four basins of Ebyekpyen and some other items as the maximum requirements to be met by the groom in order to marry an Eggon lady.
The Aren Eggon who is the paramount ruler of Eggon people worldwide, made the pronouncement today (Saturday, May 25, 2024) at his palace in Nassarawa Eggon Local Government Area of Nasarawa State.
The royal father explained that the action is in response to the outcry from many quarters, complaining about the exorbitant requirements often placed on young men intending to marry Eggon ladies.
He said: “We thank Almighty God for what has happened today about these two events; the issue of bride price in Eggon land and the little crises that has affected our growing children. These two issues have been pending for a long time and I am particularly happy that what has been bothering our local communities has come, particularly the issue of bride price in Eggon land. And I am sure you have seen the reaction from the crowd.
“It is an issue that has been affecting the youth, both the female and male alike. You see them littering around because they cannot pay the dowries. So exorbitant. During our days, if I should tell you how much I paid my father in-law, you will be shocked.
“And we don’t want these children to remain at home. Let them marry in good time so they can bring children in good time. It is not good to wait till when you are 50 (years old) before you get married and he starts producing children. By the time these children are growing, he is also getting older. The training will not be there. I think that is the essence of what we have done. Train these children in good time so they can become good citizens.
“I told them I have done my own. What is left is for the parents of the children. If they go by this, the happier the lots of all of us. If they refuse it, the children will remain at home with them, which is the problem we are trying to avoid. I am now using this opportunity to call on to them to abide by this conventional agreement which has been reached this morning so that it becomes something for the good of Eggon land.”
Earlier while presenting the details of the report by the committee that worked on the review of the bride price, the District Head of Wakama, Chief Adams Makka Nangba said: “In view of this, the high cost of the bride price – the monetary aspect of it – we resolved that bride price should not be more than N5,000. You must not collect up to that amount. You can decide to collect 500 or 1,000 but you cannot collect more than 5,000 as bride price in Eggon nation with effect from today.
“The other items have also been drastically reduced. Before now, you can hear that some people collecting up to 15, 12 or 8 basins of Ebyekpyen. Now that will be only four basins and that is because there are segments. The father, the mother, the bride herself and the uncles are the people who are now entitled to a basin each.
“Even the chicken which you hear that some people request for up 25 chickens, today we have said it should not be more than five.
“And before now too, they could request for two bags of guinea corn and a who goat in each basin of Ebyekpen. But today it is only two goats that will be slaughtered and prepared along with the beans and one live goat to signify our culture.
“Even the drinks have been reduced to one crate of soft drinks and one crate of beer in cases where the family accepts alcohol. Where alcohol is not accepted, two crates of soft drinks will be accepted. It is just for symbolic purposes.
“Pigs are not part of the tradition of Eggon people. It is just that people have felt as to collect pigs. It is goat that we know as part of our tradition. Even if you commit an offence in Eggon nation, it is goat that you will bring.”
However, a look at the committee report reveals that a total of eighty six thousand naira (N86,000) will be paid under various sub-headings along four and half (4.5) basins of Ebyekpyen, with nine (9) crates of soft drinks, five (5) cartons of beer (this could be replaced with crates of soft drinks) and a total of three goats (two to be cooked and one to be presented alive.
Other items in the report are nine (9) chickens, a total of eight (8) liters of palm oil (four to be used to prepare the Ebyekpyen), one bag of guinea corn, two basins of corn flour, one ‘pick-up’ truck of firewood, four measures of beniseed (to be used in preparing the Ebyekpyen), three packets of seasoning cubes, 30 pieces of dadawa, four measures of dry okro, two packets of salt, a small basket of onions and a small carton of dry fish.
On the crisis that has engulfed Eggon youths, the Aren Eggon, HRH Justice Ahmed Ubangari Alaku (Rtd), in his pronouncement at the event, re-affirmed the proscription of the Eggon Youth Movement (EYM) and recognition of Eggon Youth Wing (EYW) by the palace.
The Aren Eggon however directed the expansion of the current positions in the executive of EYW to accommodate four members from the proscribed EYM to become: Vice President 1, Treasurer, PRO 1 and Director of Social and Culture 1. He set June 8, 2024 as the date for the inauguration of the newly expanded executives of EYW.

NNPC Denies Reducing Price Of Petrol, Diesel

The Nigeria National Petroleum Company (NNPC) has denied rumours making the rounds that it had reduced the price of Premium Motor Spirit (PMS) and Automotive Gas Oil (Diesel).

In a press release signed by the company's Chief Corporate Communications Officer, Olufemi Soneye, it said: "The NNPC Limited wishes to clarify rumours suggesting a price adjustment for Premium Motor Spirit (PMS) and Automotive Gas Oil (Diesel) at its retail stations nationwide.

"The company asserts that these reports are false and urges Nigerians to disregard them entirely.

"NNPC Ltd. reaffirms its commitment to sustaining the current sufficiency in petroleum products supply across all its retail stations in the country."

On Tuesday (March 28, 2024) there was widespread news that the NNPC had made some adjustments to the cost of PMS and diesel that would result in a significant decrease in the price of the essential products. There were even rumours that the price of PMS and diesel had been adjusted in NNPC retail stations nationwide to N580 and N900 respectively.

The press release by NNPC may have effectively dampened the sigh of relief many Nigerians were set to heave as a reduction in the price of PMS and diesel along with the recent improvement in the Dollar-Naira exchange would have been the perfect news.

Nassarawa Eggon came to a standstill on Saturday February 17, 2024 as dignitaries from all around Nigeria converged in the town as the Aren Eggon, Justice Ahmed Ubangari (Rtd) oversaw the wedding fatiha of five of his children.
The wedding which took place at the palace of the Aren Eggon was witnessed by the Executive Governor of Nasarawa State, Engr. Abdullahi Sule who was represented by his deputy, Dr. Emmanuel Akabe. The Speaker of the Nasarawa State House of Assembly, Rt. Hon. Danladi Jatau and his deputy, Rt. Hon. Adamu Oyanki were also present.
The royal weddings also had in attendance, traditional rulers from within and outside Nasarawa State including the Emir of Lafia and Chairman, Nasarawa State Traditional Council of Chiefs, Justice Sidi Bage (Rtd), the Chun Mada, Pastor Samson Gamu Yare, the Osana of Keana, Alhaji Abdullahi Agbo, the Andoma of Doma, Alhaji Ahmadu Aliyu Ogah Onawo and the Sangarin Kwandere, Alhaji Ahmadu Almakura amongst others.
Other prominent personalities at the event include the Group Managing Director of NNPC, Mallam Mele Kyari, Major General Nuhu Angbazo (Rtd) and Prof. Lazarus Angbazo.

As expected, reactions have trailed the judgment by the Supreme Court which affirmed Engr. Abdullahi Sule as the winner of the Nasarawa State Governorship Election which held March 18, 2023.

Soon after the declaration of the Supreme Court, people suspected to be supporters of the Peoples Democratic Party (PDP) took to the streets of Lafia, particularly Jos Road to express their displeasure.

As a result, Jos Road, which is the major express road in the state capital was completely blocked as the protesters set fire to tyres thereby forcing motorists and other commuters to take alternative routes.

As at the time of filing this report, a combine team of security personnel including the police and army have moved to the site of the protest in order to stem any further breakdown in law and order.

Meanwhile, the Speaker of the Nasarawa State House of Assembly, Rt. Hon. Danladi Jatau has described the Supreme Court victory of Gov. Abdullahi Sule as the victory for the people of Nasarawa State.
Speaker Jatau stated this while reacting to the Supreme Court Judgement in Abuja today.

He said the verdict was a clear manifestation of the people's mandate given to Gov. Abdullahi Sule during the general election in the State.

He called on the opposition especially Peoples Democratic Party (PDP) that challenged the result of the election in court, to join hands with Governor Abdullahi Sule to build Nasarawa State of the people's dream.

The Speaker also called on all citizens of the State irrespective of their political, religious and ethnic differences to support and joined hand with the government of the day under Engr. Abdullahi Sule to deliver on his mandate.

He assured of the 7th Assembly under his watch to give the Governor all the necessary support to succeed.

In another reaction, the Nasarawa State chapter of the Keffi Old Boys Association (KOBA) has hailed the verdict of the Supreme Court affirming Governor Abdullahi Sule’s victory.

This was contained in a statement signed by Architect Umar Sh*tu, the President of KOBA in Nasarawa State.

KOBA described the judgment as a victory for democracy and expressed their readiness to support and partner with the government of Engr. Abdullahi Sule especially with his interventions in the education sector of the State.

The Supreme Court on Friday (January 19, 2024), upheld the election of Governor Abdullahi Sule of Nasarawa State effectively bringing to an end the legal tussle that has ensued since result of the March 18 2023 governorship election was declared.

A five-member panel of the Supreme Court, led by Justice Kudirat Kekere-Ekun, dismissed the appeal filed by David Emmanuel Ombugadu of the Peoples Democratic Party, challenging Governor Sule’s victory.

In the judgment, the jurist said, “The issues in this appeal are resolved against the appellant. The appeal lacks merit and it is hereby dismissed.”

She affirmed the position of the Court of Appeal in Abuja to “set aside the decision of the tribunal” which had declared Hon. Ombugadu the winner of the poll.

Another member of the panel of justices, Tijani Abubakar while contributing to the lead judgment, described PDP’s appeal as “frivolous, vexatious and lacking in merit. It is hereby dismissed”.

Recall that the Court of Appeal had, on November 23, 2023, reversed the decision of the Nasarawa State Governorship Election Petitions Tribunal, which sat in Lafia, the state capital.

In its ruling, the appellate court said the tribunal was wrong to have concluded that Governor Sule of the All Progressives Congress (APC) did not win the majority of lawful votes cast at the polls.

Recall, that the Independent Electoral Commission (INEC), had on Monday, March 20, 2023, declared Engineer Abdullahi A. Sule as the elected Governor of Nasarawa State.

The election results were collated and announced in Lafia by the INEC’s Returning Officer in Nasarawa State, Prof. Ishaya Tanko.
In declaring Engineer Abdullahi Sule elected, Tanko, who is the Vice-Chancellor, University of Jos, Plateau State, averred: “Having satisfied the requirements and having received the total votes of 347,209 by the APC with the candidate, Sule Audu, is hereby returned and declared the winner of the governorship election in Nasarawa State.”

Not satisfied with the declaration, Hon Davematics David Emmanuel Ombugadu of the Peoples Democratic Party (PDP) challenged the results at the Governorship Election Tribunal.

On October 2, 2023, the Governorship Election Petition Tribunal sitting in Nasarawa State nullified the election of Governor Abdullahi Sule of the All Progressives Congress and declared PDP’s David Ombugadu as the winner of the March 18, 2023 governorship election in the state.

Delivering the judgment virtually, the Chairman of the tribunal, Justice Ezekiel Ajayi, declared Ombugadu of the PDP as the lawfully elected governor of Nasarawa State.

In the same vein, not satisfied with the Tribunal verdict, Engineer Abdullahi A. Sule headed to the Court of Appeal.

On Thursday, November 23, 2023, the Court of Appeal upturned the Tribunal verdict and declared the appellant, Engr A A Sule as the winner of the election.

Exercising his constitutional rights, having not been satisfied with the judgment of the Court of Appeal, Hon Davematics Ombugadu approached the Supreme Court.

This is the final lap. At this moment, all parties concerned are sitting on tenterhooks in a state of nervous anticipation of the final verdict.
