President fuels tensions with Zambia after Russia remarks

ZIMBABWEAN President Emmerson Mnangagwa arrived home from oveseas amid a diplomatic storm in which he fueled a simmering diplomatic crisis with Zambia by negatively branding it a Western puppet destabilising the region, while isolating Harare.

Mnangagwa’s statements in a private meeting with his host, Russian President Vladimir Putin, which were leaked afterwards, characterised Zambia as an American client state wreaking havoc in the region.

In international relations, a client state is a country economically, politically and militarily dependent on a powerful controlling nation. Ironically, Mnangagwa saw nothing wrong with his actions rendering Zimbabwe Russia’s satellite state while complaining about Zambia and its ties to the United States.

CIO needs urgent reform

ZIMBABWE’S state security agency, the Central Intelligence Organisation (CIO), needs urgent reform to ensure transparency and accountability in its structures and operations in terms of the constitution and the law, an international investigative organisation says

The Sentry, an American investigative organisation which seeks to disable multinational predatory networks that benefit from violent conflict, repression, and kleptocracy, also says the CIO must close its shadowy companies which it uses for various purposes, but whose operations are murky.

The Sentry recommends secret CIO companies be closed to ensure openeness in its work because it is publicly funded through a framework rooted in legislation and parliamentary processes.

Chivayo comes out guns blazing against partners

CONTROVERSIAL local tycoon Wicknell Chivayo has come out guns blazing against his estranged business partners Mike Chimombe and Moses Mpofu, describing them as “serial extortionists” trying to extract money from him by falsely claiming they are owed millions from the corrupt US$40 million Zimbabwe Electoral Commission (Zec) tender which has caused uproar.

In several letters flying back and forth between Chivayo on one side and his bitter business partners Chimombe and Mpofu on the other, the Intratrek Holdings boss says he will not be intimidated and succumb to pressure from fraudsters.

Chivayo says Chimombe and Mpofu are “serial extortionists who survive on manufacturing fake telephonic messages, fabricating videographic images, forging documents, and engineering voice recordings which they in turn use to blackmail unsuspecting businessmen”.

ON 10 June 2018, President Emmerson Mnangagwa said soon after touring the Nyangani Renewable Energy solar project in Mutoko, Mashonaland East province, that controversial businessman Wicknell Chivayo is a candidate for Chikurubi Maximum Security Prison.

Mnangagwa was talking about Chivayo’s scandals and his botched US$172 848 597.60 (US$173 million) Gwanda solar deal in which he was paid US$5.8 million in advance for virtually doing nothing as the project did not take off.

But now the motor-mouthed buccaneering tenderpreneur says he has captured the President and has a dead man’s grip on him to get anything that he wants.

Kingpins of murky US$40mln ZEC deal emerge

THE kingpins of the murky US$40 million Zimbabwe Electoral Commission (Zec) deal in which flamboyant businessman Wicknell Chivayo is voraciously feasting have now been exposed through further investigations by The NewsHawks and documents.

Investigations show that the deal was put together by Moses Mpofu — previously involved in Zec tenders — Mike Chimombe, a Zanu PF activist and empowerment lobbyist, Chivayo, a leading tenderpreneur, and gold baron Pedzai “Scott” Sakupwanya in February 2023.

Chivayo and Sakupwanya are close to President Emmerson Mnangagwa. An agreement was struck to participate in Zec tenders for the supply of biometric voter registration kits and other voting materials.

President Emmerson Mnangagwa has met
Russian President Vladimir Putin at Konstantinosky Palace at the Baltic Sea port city of St. Petersburg, according to his publicity department.

The palace is located in the Petrodvorets district of St. Petersburg in the village of Strelna.

The Grand Palace in the southern Gulf of Finland, which was then called “the Konstantinovsky” was built almost the entirely during the 18th century.

It was intended for Peter the Great as his summer residence.

National Social Security Authority (Nssa) director corporate affairs David Makwara was yesterday cleared of charges of fraud involving US$182 661.77 in a paid-for home renovations project in 2021.

He was being charged in terms of section 136 of the Criminal Law (Codification and Reform) Act.

It was alleged Makwara had misrepresented that Zivo Project Management (Pvt) Ltd was hired to do renovations for US$182 661.77 at his home at 5 Ruwanga Road in Mandara and generated two quotations.

Makwara approached Nigel Mahachi, the project manager at Zivo Project Management, to give him a quotation for the proposed renovations.

THE Zimbabwe National Roads Administration, under its 2019 board says it has managed to address 66 of the 71 governance issues raised in the Grant Thornton forensic audit ordered by the Government following abuse of public funds by the parastatal, Parliament’s Public Accounts Committee (PAC) has heard.

Appearing before the Public Accounts Committee on Monday, Zinara chairman Dr George Manyaya said Zinara was working on the final five issues, but these also involved other stakeholders.

“I would like to notify the committee that of the 71 issues that were cited in the Grant Thornton forensic report, with Government support and the committee’s support, we have managed to resolve 66 of them with five of them being work in progress as they don’t involve us alone but other stakeholders,” he said.

The Dr Manyaya-led board and management was appointed in 2019 to turn around the performance of the parastatal.

Miners seek respite from tumbling prices

ZIMBABWE’S major mining companies are pinning their hopes on Treasury to announce a cocktail of measures to cushion platinum group metal producers from the tumbling prices on the international market and rising operating costs, The NewsHawks has established.

Early this year, the country’s major platinum miners — Zimplats and Mimosa — announced job cuts after warning that the current business environment was adversely affecting their operations.

Zimbabwe has the third-largest known platinum reserves in the world after South Africa and Russia.

The mineral is mainly used for manufacturing catalytic converters in the automotive industry. The devices are vital in reducing carbon emissions.

Chamber of Mines of Zimbabwe president Thomas Gono told The NewsHawks that miners are optimistic that the mid-term fiscal statement will help miners weather the storm.

President Emmerson Mnangagwa is on a witchhunt to flush out senior Zanu PF officials and ministers who are not backing his plan to extend his leadership to 2030 beyond his constitutional limit, Zanu PF officials say.

Mnangagwa's constitutional second term ends in 2028, but he wants to cling onto power until 2030 through the back door.

Zanu PF and ministers are now being publicly tested and asked to pledge loyalty by chanting party slogans which should include "ED 2030" if they want to pass the assessment.

Former adviser to the Reserve Bank of Zimbabwe governor and MP Munyaradzi Kereke is back to jail to complete his 10-year r**e sentence after losing a crucial Supreme Court appeal on the matter.

Justices Tendai Uchena, George Chiweshe and Samuel Kudya dismissed Kereke's appeal "in its entirety”.

This means that he now has to serve the remaining 20 months in jail.

Kereke had been out since August 2021 when he was granted ZW$500 000 bail pending appeal.

While out, he was arrested for fraud.
On 11 July 2016, Kereke was convicted by a magistrate of ra**ng his then nine-year old niece at gun point.

He was sentenced to 14 years in jail. Four years were suspended for five years on condition of good conduct.

Dissatisfied, he unsuccessfully appealed to the court a quo, against both conviction and sentence.

Dismissing his appeal, Kudya says: "The submission that, in the absence of rebuttal evidence other than evidence derived from cross-examination, an alibi in r**e cases would, as a matter of course, prevail is not part of our law.

"The submission is contrary to the approach taken by this court in S v Mhlanga, in para [64] of this judgment and in S v Madeyi.
"In these cases, the defence of alibi was measured against the totality of the evidence bearing on the sexual assault and found wanting.

"After all, cross-examination constitutes an irreplaceable and invaluable tool for ascertaining the probative value of any evidence.

"The prosecution did not lead any special evidence in the mode suggested by the appellant, other than the evidence of the complainant, the witnesses to whom the report was made, other relevant witnesses and the medical evidence.

"This evidence was then measured against the evidence of the alibi and the other evidence adduced by the appellant and his witnesses."

The judge continues: "The further submission that special rebuttal evidence is required to establish coaching is also not part of our law.

"The existence or non-existence of coaching like an alibi, is a question of fact, which depends on the particular evidence led during trial.

"There is therefore no magic to the determination of coaching. The complainant was the primary witness, whose testimony passed the requisite threshold of credibility set out in case law.

"It was also supported, especially by medical evidence and the deliberate lies that were propagated by the appellant and his witnesses. We are therefore satisfied that the defence of an alibi was properly disproved and shown to be false beyond a reasonable doubt.

"Similarly, the prosecution established beyond a reasonable doubt that all the defence witnesses were coached by the appellant.

"The defence of an alibi and the other exculpatory evidence of the defence witnesses were clearly shown not only to be reasonably untrue, but also to be palpably false.

"In the circumstances, it is ordered that:
The appeal be and is hereby dismissed in its entirety”.

WELL-connected Zanu PF activist Mike Chimombe and his business partner Moses Mpofu wrote a scathing letter to ex-convict businessman Wicknell Chivhayo complaining that he had fraudulently changed their contract between South African company Ren-Form and Better Brands - Pedzisayi Scott Sakupwanya's entity - for the US$40 million tender to supply biometric voter registration kits and other electoral materials to the Zimbabwe Electoral Commission (Zec) during last year’s general elections.

This is the letter which The NewsHawks quotes extensively in its exclusive investigation last week which details the corrupt Zec deal in which invoices were inflated by up to 235%.

Chivayo is now feasting on the US$40 million tender, while keeping at bay his partners - Chimombe and Mpofu - after running away with the loot.

The flamboyant tenderpreneur, known for buying expensive top-of-the-range cars, designer clothes from world's most glitzy shopping centres and building or purchasing mansions, is spending the money from the corrupt tender like confetti at a wedding.

THE Ministry of Higher and Tertiary Education, Innovation, Science and Technology Development cannot account for more than US$500 000 half a million in seed money disbursed towards capacitating seven state universities to produce personal protective equipment (PPE), hand sanitisers and face masks during the Covid-19 pandemic.

This was revealed by Auditor-General Rhea Kujinga revealed in her report titled Value for Money Audit Report on Covid-19 Support Towards Production of Personal Protective Equipment and Sanitisers under the Ministry of Higher and Tertiary Education, Innovation, Science and Technology Development. The report is dated 15 January 2024, but has not been carried by the media.

In her report, Kujinga says universities got more than they had budgeted for and cannot account for the excess.

Zimbabwe's opposition leader Nelson Chamisa says the Southern African Development Community (Sadc) leaders have a duty to ensure that President Emmerson Mnangagwa does not continue as if it is business as usual when they have openly condemned last year’s disputed general elections that brought him back to power.

Chamisa says Sadc cannot condone and endorse what they have already condemned.

AS flamboyant Zimbabwean tycoon Wicknell Chivayo splurges money on an imposing mansion and donates cars to selected individuals weeks on end, while also making cash donations, questions abound as to where the money is coming from.

The NewsHawks has decided to follow the money around Chivayo and see where it leads to: Follow the money, the bank and the proxy, then get the answer.

Chivayo is making money out of the state-owned power utility Zesa and Zimbabwe Electoral Commission. His deals with the electoral body are not in the public domain.

The NewsHawks is digging deeper into the contracts and will get to the bottom of it, but first the background.

Media reports say Chivayo has spent a fortune on luxury cars donated to high-profile individuals.

In total, he has bought more than 50 cars, spending over US$5 million in donations.
In January, he gave 50 members of his congregation Toyota Aqua vehicles worth US$400 000.

Some of the cars he has bought include a Toyota Hilux, Toyota Hilux D4D, Toyota Fortuner, S500 Mercedes-Benz, Mercedes-Benz GLE, Mercedes-Benz GLE400d and Mercedes-Benz GLE350d 4matic, among others, for prominent people.

For himself, Chivayo has a fleet of supercars.

Last year, he showed off a fleet of six all-white imported luxury vehicles worth a staggering US$3.5 million parked at his mansion in Harare.

Chivayo has built an imposing mansion in the capital.

The Hollywood-style imposing residential property in Gletwyn suburb, Chishawasha Hills, Harare — furnished by South Africa’s iconic interior design brand Norman Bakos Signature Collection — closely resembles former police Commissioner-General Augustine Chihuri’s estate in the same area. But the controversial tycoon says it is not the same villa. Chivayo told The NewsHawks through messages: “No it’s a completely different house. I built it from scratch.”

Chivayo, who is a convicted criminal and controversial businessman entangled in corrupt state tender projects, has of late been donating cars and money to individuals and organisations like confetti at a wedding. Zimbabweans are asking where his money comes from given his history of corrupt activities and proximity to Mnangagwa. The NewsHawks is currently investigating the story in detail.

He says his own cars are white because he is an apostolic sect member, hence the colour white.

CONTROVERSIAL businessman Wicknell Chivayo, who is close to President Emmerson Mnangagwa and other high-profile government officials, corruptly got a windfall from a murky Zimbabwe Election Commission (Zec) US$40 million tender to supply electoral material for the 2023 general elections, inflating some invoices by up to 235%, an investigation by The NewsHawks has revealed.

The NewsHawks has been investigating the story since last year’s elections after getting tips that Zec under chairperson Priscilla Chigumba had entered into a shady deal with Chivayo and his business partners to supply biometric voter registration kits for the disputed polls.

The procurement deal to supply the kits, equipment and other election materials was valued at US$40 million in total.
