Property Owners are in a difficult position:

- insurance carriers delaying payment on claims those damages
- now, NOAA National Severe Storms Laboratory is predicting hurricane season to start on May 15 (instead of June 1st) 17 named storms, 8 hurricanes, and 3 of these expected to be “major”.

Our message, property owners / business owners need a break, and insurance companies NOT actively denying and underpaying claims would be a good start!

The The Cincinnati Insurance Company filed lawsuit yesterday refusing to support ERCOT's massive liability due to , which means Electric Reliability Council of Texas and ultimately the property owner and consumer is going to lose.

Our advice: File Early, file often for your own claims, who knows how much money will be left.

TLDR

Their reasoning in two statements:

1. There is no duty to defend or indemnify the Underlying Matters because there is no occurrence. In order for there to be an occurrence, there must be an accident. An accident is a fortuitous, unexpected, and unintended event,”

2. The Underlying Lawsuits allege the power outages caused by Winter Storm Uri were a result of the exact same failures including failures of the same generators which failed in the previous winter storms, and therefore, the power outages were foreseeable, expected, and/or intended,”

Coming out of the National Oceanic and Atmospheric Administration (NOAA), the NOAA National Severe Storms Laboratory and The University of Oklahoma.

They are combining a couple different sources of data to give pin-pointed traffic advisory based on if roads are freezing or not.

Any thoughts on applying that temperature data as it applies to plumbing and $18B in anticipated property damage in alone from the past two months?

E.g. advisories to commercial property owners in a targeted way they need to be shutting shutting off water pumps, etc.

Bulletin B-0010-21 further states that property policies of homeowners, renters, and others:

“may include provisions that loss caused by freezing is covered if the policyholder took ‘reasonable care’ to maintain heat or shut off the water supply and drain pipes.”

- Whether the frequency and length of power outages which prevented many policyholders from maintaining heat in their homes and other covered properties. “This was beyond the control of policyholders.”

- Whether policyholders may have been told that power outages would be short and intermittent, making it less likely for policyholders to believe shutting off water was necessary.

- Whether renters may not have had access to water mains or have any control over the power of water supplies to their unit.

- Whether confusion on best practices for caring for pipes in freezing weather may have been caused from listening to differing advice and sources,

- Whether icy conditions may have created a risk of injury if policyholders had attempted to shut off the water at a water main.

"The 2020 hurricane season ended with a record 30 named storms, topping the previous record of 28 set in 2005. Of the 30 named storms this year, 13 reached hurricane strength of at least 74 mph. sustained winds.

That’s good for second all-time behind 2005. This year saw six storms become major hurricanes with sustained winds of at least 111 mph. That’s tied for second behind the seven major hurricanes in 2005."
