The Ministry of Law on Wednesday told President Arif Alvi that he has no role in the announcement of date for general elections “following the amendment in Elections Act”, ARY News reported.

The law ministry has forwarded its response to President Alvi’s letter, seeking opinion on Election Commission of Pakistan’s (ECP) stance that “only it had the authority to decide the election date”.

In the letter, the Law ministry said that the right of announcing the date of election rests with the Election Commission of Pakistan (ECP).

“According to Article 48(5) of the Constitution, where the National Assem­bly is dissolved by the President, he shall appoint a date for election and appoint a caretaker cabinet in accordance with the provision of Article 224 or as the case may be under Article 224-A,” the ministry said in the letter.

Under Article 58, the letter noted, the President shall act on and in accordance with the advice of the Prime Minister and such advice shall be binding on him. “An advice sent under Article 58a shall take effect within 48 hours”, it added.

The ministry further said that the system will witness a distortion if President’s authority to give election date is accepted. “The purpose of amending the Election Act was a single authority can give date of elections,” it added.

The development came after Chief Election Commissioner (CEC) Sikandar Sultan Raja responded to President Alvi’s letter for meeting to “fix an appropriate date” for general elections, saying that participating in such a meeting would be of “scant importance” after changes to the election law.

The president had written to Sikandar Raja Sultan, inviting him for a meeting regarding holding general elections in the country.

In his letter, President Alvi quoted Article 244 of the Constitution, saying he was duty-bound to get the elections conducted in the 90 days’ prescribed period once the National Assembly is dissolved prematurely.

Responding to the latter, ECP CEC said it was “imperative” to point out that Section 57 of the Elections Act had been amended due to an act of Parliament, which had empowered the commission to “announce the date or dates for the general elections”.

“Where the president dissolves the National Assembly, in his discretion, as provided in Article 58(2) read with Article 48(5) of the Constitution then he has to appoint a date for the general elections. However, if the assembly is dissolved on the advice of the prime minister or by afflux of time as provided in Article 58(1) of the Constitution, then the commission understands and believes that power to appoint a date or dates for elections rests exclusively with the Commission.

The Pakistan Telecommunication Company Limited (PTCL) has announced its board's decision approving the acquisition of a telecom company, Telenor Pakistan — a cellular and digital services provider.

The development by the telecommunication authority, according to The News, was confirmed on Tuesday following its board's approval for making a binding offer to finalise the purchase.

The PTCL, earlier, gave a non-binding offer to the company. The authority will now make a binding offer after getting a confirmation from the State Bank of Pakistan (SBP) with regard to the mode of payment.

The offer is likely to be made to Telenor Pakistan on September 1 or 2.

Telenor Pakistan has also received a bidding offer from a Lebanese investor and the company will now take the final decision.

The sources said that the sale of Telenor Pakistan is expected to be finalised somewhere between $500 to $700 million.

The PTCL communique sent out to the Pakistan Stock Exchange on Tuesday stated that after a due diligence process, the board of directors on August 29, 2023, authorised the company to make a binding offer to the target firm.

At the start of the year, the PTCL made a non-binding offer to acquire Telenor Pakistan after eyeing to buy it at a possible price range of $800 million to $1.2 billion.

The PTCL's board of directors, which gave a nod to acquiring majority shares of Telenor, was interested in buying the cellular company with management control.

Etisalat, the PTCL’s parent company, gave guarantees to raise commercial loans to finalise the deal.

Islamabad High Court (IHC) has barred the authorities from shifting human rights lawyer Imaan Mazari outside the federal capital, ARY News reported.

As per details, the IHC judge Mian Gul Hassan Aurangzeb ordered Interior Secretary, IG Islamabad and FIA to not take Iman Mazari out of Islamabad.

The court also directed the authorities to not arrest the daughter of Shireen Mazari in any case registered after August 20.

Saudi Crown Prince Mohammad Bin Salman will be in Pakistan for a brief visit next month, sources told Geo News Wednesday.

Officials, who spoke on the condition of anonymity, said the Saudi crown prince is likely to travel to the country in the second week of September.

After staying here for 4-6 hours on September 10, Mohammad Bin Salman will depart for India.

During the visit, the diplomatic sources confirmed to Geo News, that the Saudi crown prince is expected to meet Caretaker Prime Minister Anwaar-ul-Haq Kakar and Chief of Army Staff (COAS) General Asim Munir.

"The discussions between the leadership of the two countries will focus on the promotion of Pak-Saudi Arabia relations, defence ties, and joint military exercises," as per the sources.

The establishment of a Saudi-funded oil refinery in Pakistan will also come under discussion.

Pakistan and Iran on Wednesday agreed to enhance bilateral cooperation in diverse sectors, ARY News reported.

The understanding was reached at a meeting between Caretaker Minister for Planning, Development and Special Initiatives Sami Saeed and newly appointed Iranian ambassador to Pakistan Reza Amiri-Moghaddam and in Islamabad.

During the meeting, the both sides discussed various avenues of collaboration between the two nations including bilateral trade, the China-Pakistan Economic Corridor, cooperation in energy and economic sectors.

The planning minister emphasised the importance of the long-standing friendship between Pakistan and Iran and reiterated the commitment to further strengthening bilateral ties.

Special Assistant to the Prime Minister (SAPM) on Overseas Pakistanis and Human Resource Development Jawad Sohrab inaugurated the state-of-the-art 24/7 Complaint Monitoring Cell at the Overseas Pakistanis Foundation (OPF), said a press release issued on Wednesday.

As per the statement, the cell will provide a “dedicated platform” for overseas Pakistanis to register their complaints from around the world and ensure the prompt addressal of their grievances.

During the visit, the SAPM was briefed on various other welfare measures undertaken by the OPF in the education, housing, and social services sectors. These efforts were lauded by the SAPM for their comprehensive impact on the lives of overseas Pakistanis.

SAPM Sohrab expressed his satisfaction on the establishment of the cell and the integration of modern communication channels to facilitate overseas Pakistanis in voicing their concerns.

Terming the Supreme Court (Practice and Procedure) Act 2023 “unconstitutional”, Chief Justice of Pakistan (CJP) Umar Ata Bandial on Tuesday remarked that this legislation was an attempt to interfere with the top court’s jurisdiction.

CJP Bandial made the remarks while hearing former prime minister Imran Khan’s — who was removed from office via a no-confidence motion last year in April — plea challenging the former government's amendments to the National Accountability (NAB) Ordinance.

Former Pakistan Democratic Movement (PDM)-led government had on April 10 gotten the bill passed in the joint session of parliament amid the strong protest from the Pakistan Tehreek-e-Insaf (PTI) after President Arif Alvi had returned the bill seeking to curtail the CJP’s suo motu powers. Later, former law minister Azam Nazeer Tarar announced that the bill — which aims to curtail the chief justice's powers to take suo motu notice in an individual capacity — become law on April 20.

Meanwhile, an eight-member larger bench of the SC on April 13 ordered that even if the Supreme Court (Practice and Procedure) Bill 2023 received the assent of the president, the bill would not be acted upon in any manner till further order.

“The moment that the Bill receives the assent of the President or (as the case may be) it is deemed that such assent has been given, then from that very moment onwards and till further orders, the Act that comes into being shall not have, take or be given any effect nor be acted upon in any manner,” read the interim order.

At the outset of today’s hearing, the top judge noted, “There was an attempt to interfere in the court’s jurisdiction by expanding the ambit of appeal in the Supreme Court (Practice and Procedure) Act 2023.”

A three-member top court bench comprising CJP Bandial, Justice Mansoor Ali Shah and Justice Ijazul Ahsan, resumed hearing the petition filed last year by Khan against the amendments to NAB law.

“The attorney general himself had admitted that there are flaws in the SC (Practice and Procedure) Act 2023,” he stated.

The top judge said that the attorney general had said that the Nation Assembly would review the act but the assembly did not do so. “I am unaware of the caretaker government’s stance on the law,” he added.

Later the top court adjourned the hearing till tomorrow.

During the course of proceeding, CJP Bandial, while addressing Advocate Khawaja Haris, said, “Good to see you. I hope that I will not be targeted for saying this.”

Earlier, the country had witnessed a heated debate when the CJP had exchanged greetings with former premier by saying “good to see you” during his appearance before the top court.

After heavy criticism, the CJP had to clarify his cordial greeting to Khan.

Amid a recent increase in global oil rates along with depreciation in the value of the rupee against the US dollar — which has impacted the exchange rate impact by Rs12 — Oil and Gas Regulatory Authority (Ogra) is likely to recommend a hike in the petroleum products prices for the next fortnight, The News reported Tuesday.

It is likely that the price of petrol will go up by Rs12 per litre, while diesel will see a rise of Rs14.83 per litre from September 1, 2023.

“This would expose the masses to a further surge in inflation making the lives of the masses more miserable. At present the inflation rate is at 28%,” a senior official of the Energy Ministry told The News.

“However, the government which is already under tremendous pressure because of the countrywide protests over the inflated electricity bills, may reduce the increase or stop it," the official added.

But doing so would put the caretaker government in a tight spot.

"If the government does that it would be considered that the caretaker government has defaulted on the IMF terms and conditions for its $3 billion standby agreement (SBA) loan under which the government is bound to pass fluctuation in prices of the POL products.

The dollar’s value has reached Rs301.75 in the interbank while it is selling at around Rs319 in the open market,” the official said.

As per the data, over the month of August, petrol prices have already increased by Rs37.50 while diesel has gone up by Rs40 per litre.

"However, the authorities last time worked out the POL prices at the value of the dollar at Rs287 and now they have decided to calculate the prices of POL products from September 1, 2023, at Rs299.

"The big impact of the exchange rate of Rs12 will be reflected in the hike in POL prices.

"The LC confirmation charges that have increased by 10% are also embedded in the price of PSO petroleum products," the Energy Ministry official told The News.

"The existing price of Mogas stands at Rs290.45 per litre which may go up by Rs12 per litre to Rs Rs302.45 per litre. Likewise, the HSD price which stands at Rs293.40 per litre is also likely to increase by Rs14.83 per litre to Rs308.23 per litre."

Diesel price is highly inflationary as it is mostly used in heavy transport vehicles, trains and agricultural engines like trucks, buses, tractors, tube wells and threshers and particularly adds to the cost of vegetables and other eatables.

On the other hand, petrol is also mostly used in private transport, small vehicles, rickshaws and two-wheelers and directly affects the budget of middle and lower-middle-class citizens.

The cypher case against Pakistan Tehreek-e-Insaf (PTI) chief will be heard in the Attock jail tomorrow, ARY News reported.

As per details, the notification issued by the law ministry stated that the ministry has permitted the hearing of cypher case against the former prime minister in Attock jail.

The cypher case against the PTI chairman will be heard by Judge Abual Hasnat Zulqarnain in Attock jail.

Earlier today, A special court in Islamabad ordered Attock Jail authorities — where the former premier is incarcerated — to keep the PTI chairman in judicial lockup in cypher case.

The order comes hours after IHC suspended PTI Chairman Imran Khan’s three-year sentence in the Toshakhana case.

In a letter addressed to the Attock jail superintendent, the special court ordered jail authorities to produce Imran Khan on Aug 30 (tomorrow) in connection with the cipher case.

Sources told ARY News that the Law Ministry hasn’t forwarded the response to President Dr Arif Alvi, who sought its opinion regarding the authority of giving an election date.

Earlier, it was reported that the ECP decided to hold general elections in the second week of February 2024.

Sources privy to the development told ARY News that the election commission is likely to issue general elections schedule after December 2023. “The election schedule will be issued 54 days after the completion of the delimitation process,” said sources with ECP.

The National Accountability Bureau (NAB) on Tuesday was granted a four-day extension in the physical remand of Punjab's former chief minister and Pakistan Tehreek-e-Insaf (PTI) President Chaudhry Parvez Elahi in a case related to alleged kickbacks in development projects.

Earlier, NAB officials produced Elahi before the accountability court on the expiry of his physical remand.

At the outset of today’s hearing, Elahi’s counsel — in response to the NAB’s allegation — apprised the court that PML-Q President Chaudhry Shujaat Hussain, his client’s cousin, had deposited Rs120 million in Elahi’s bank account.

The NAB’s prosecutor pleaded with the court to extend the physical remand of the PTI leader for another 14 days to complete the investigations. The court, however, extended the physical remand of Elahi till September 2.

LHC reserves verdict
Meanwhile, the Lahore High Court (LHC) reserved its verdict on a plea seeking implementation of its earlier order restraining the authorities from arresting Elahi in any undisclosed FIR or pending inquiry.

Earlier today, the PTI leader moved the court to challenge his detention “in violation of the LHC’s order”. In his plea, Elahi requested the court to ensure implementation of its previous verdict and declare his arrest null and void.

NAB accused Elahi of receiving over Rs1 billion as kickbacks through intermediaries in more than 200 development projects of Gujrat district, during his second term as chief minister of Punjab.

Elahi was initially arrested on June 1 from outside his residence in a Rs70 million graft case related to the embezzlement of development funds allocated for the Gujrat district.

Since then, the former Punjab chief minister has been behind bars on various charges. During a span of around two and half months, the PTI leader was released multiple times on the courts’ orders but was re-arrested immediately every time.

The PTI president was taken into custody during a crackdown launched against the party’s leadership following the May 9 riots.

The caretaker Minister for Information and Broadcasting on Tuesday stated that the caretaker setup has enough ‘financial resources’ to hold elections as we [caretaker setup] are appointed to facilitate it, ARY News reported.

During his visit to the Election Commission of Pakistan (ECP) office, the information Minister – Murtaza Solangi – said that, “it is ECP’s responsibility to hold elections, and the caretaker government will fulfill all the requirements of ECP.”

While answering a question about his ECP office visit, the minister said that he had a meeting with the member of Election Commission, Nasir Durrani, and it was personal in nature.

The National Electric Power Regulatory Authority (NEPRA) is likely to approve another hike in electricity tariff by Rs2.07 per unit in terms of July’s fuel charge adjustment (FCA), ARY News reported on Tuesday.

People across Pakistan are protesting against the inflated electricity bills to put pressure on the government for relief, but it seems that the government has other plans.

The power companies sought the Central Power Purchasing Agency (CPPA) to hike the electricity tariff by Rs2.07 per unit for July fuel charge adjustment (FCA).

The National Electric Power Regulatory Authority (NEPRA) will hear the pleas on August 30 (tomorrow). The plea stated that the ratio of power generation from thermal resources was 37.18%, 14.68% from coal, 1.98% from furnace oil and 1967% from Liquefied Natural Gas (LNG) in July.

The rate of local power production was 7.61%, 14.29% from nuclear fuel for generating 14.388 billion units of electricity. The production cost was recorded at Rs8.96 per unit, whereas, the reference cost was fixed at Rs6.89 per unit.

Earlier in the month, the National Electric Power Regulatory Authority (NEPRA) launched an investigation into the issue of over-billing on faulty and slow-speed electricity meters.
