Suisun City has 160 Duck clubs which comprise the Suisun Marsh which is protected by the Suisun Marsh Preservation Act and governed by BCDC. The land owners are represented by SRCD which is a reclamation district of sorts. SRCD is working with State Water Agencies to reclaim managed wetlands and make them tidal wetlands. Its an open forum with no rules anyone can post anything.

Then-AG Kamala Harris's $39M Island Debacle in San Francisco Bay

In 2011, John Sweeney purchased several key delta islands (Chipps and Point Buckler Islands) located on the edge of San Francisco Bay. These islands, spanning approximately 1,000 acres of wetlands and levees, had historically been used since the turn of the century as duck clubs for San Francisco elites but had fallen into disrepair.

Between 2011 and 2014, Sweeney invested in rebuilding levees and repurposing old buildings for windsurfing and hunting clubs. Unbeknownst to him, these properties were listed in federal and state databases as "newly completed tidal restored wetlands for fish.” The San Francisco Estuary Institute, a non-profit organization, had been paid by the EPA in 2002 to map every wetland acre in the San Francisco Bay area. They included private land in their maps without proper authority, as if the state had acquired it.

In 2014, then-Attorney General Kamala Harris initiated multiple lawsuits against Sweeney to silence him, using the Bay Conservation and Development Commission (BCDC), the Regional Water Quality Control Board, and the EPA. The fines amounted to $39 million, prompting an FBI investigation. The question arose: why would legally required levee repairs trigger such a reaction from Harris, especially against a family and not some Exxon corporation?

During court depositions in a federal trial in 2016, it was revealed that state and federal agencies had illegally claimed these islands without the owners' consent. They fabricated tidal restoration sites, permits, and construction activities to create the appearance of wetlands needed for increased water diversion from the Delta to Los Angeles. This fraudulent activity was overseen by a single scientist, Stuart Siegel, who either did not verify the accuracy of the data or was paid to falsify his study.

The CA Department of Water Resources had previously approached the island owners to sell their land in 2002, but the offers were below market value and rejected. In response, the state opted for a wildly different approach: faking ownership and restoration of the wetlands. When Sweeney acquired Point Buckler and Chipps Island in 2012, he unknowingly became target #1 for the state AG Harris.

Since AG Kamala Harris filed the lawsuits, the state Attorney General's office has incurred $30 million in attorney fees over a decade. Sweeney declared bankruptcy and handed the island to Attorney General Rob Bonta in 2022, hoping for resolution. However, Bonta continued the legal battle, returning the island a month later.

AG Harris moved on, but her actions as California's AG, involving substantial fines designed to silence whistleblowers and prolonged legal battles, cast doubt on her integrity and credibility. The State of California's falsification of tidal and fish restoration projects to meet EPA water diversion rules remains a significant issue. When the EPA realized the fraud, it chose to sue the whistleblower, Sweeney, instead of addressing the violations initiated under AG Kamala Harris's watch.

Point Buckler is again being taken by AG Rob Bonta and is expected to be sold by Solano Sheriff’s sale this summer. Sweeney listed the island for sale for $75 million in September 2023.
