CIVIC GROUPS ASK COMELEC TO CANCEL COC OF PRESIDENTIAL ASPIRANT BONGBONG MARCOS

MANILA, Philippines, November 2, 2021 — A group of political detainees, human rights and medical organizations on Tuesday asked the Commission on Elections to cancel former Sen. Ferdinand “Bongbong” Marcos Jr.’s Certificate of Candidacy for the 2022 presidential elections.

Six petitioners from civic groups on Tuesday filed a 50-paged Petition to Cancel or Deny Due Course the COC of Marcos before the Comelec, as they accused him of filing the certificate that “contains multiple false material representations.”

Bongbong Marcos announces bid for presidency “Specifically, Marcos falsified his [COC] when he claimed that he was eligible to be a candidate for President of the Philippines in the 2022 national elections when in fact he is disqualified from doing so,” the petitioners said in a statement.

The petitioners are from Task Force Detainees of the Philippines, Kapatid-Families and Friends of Political Prisoners, Medical Action Group Inc., Families of Victims of Involuntary Disappearance, Philippine Alliance of Human Rights Advocates and Balay Rehabilitation Center.

Marcos filed his COC for presidency on October 10, marking his family’s bid to return to the Malacañang 35 years since the historic ouster of his dictator father.

Section 78 of the Omnibus Election Code states that a CoC may be cancelled or denied due course “on the ground that any material representation contained therein as required under Section 74 hereof is false.”

They told the Comelec: “In the instant case, not only has respondent Marcos Jr. been convicted of a crime by final judgment which carries the penalty of disqualification, his repeated violations of the [National Internal Revenue Code] and his continued evasion/non-payment of taxes renders his conviction as one involving moral turpitude.”

Failure to file income tax returns conviction

Arguing for Marcos’ disqualification, the petitioners cited Marcos’ 1995 conviction from a Quezon City Regional Trial Court on multiple failures to file income tax returns.

They said the QC RTC Branch 105 found Marcos guilty beyond reasonable doubt for violating Sections 45 and 50 of the NIRC and sentenced him to imprisonment of nine years and pay the find for his failure to file his income tax returns and/or pay taxes for the years 1982, 1983, 1984 and 1985.

Marcos elevated the conviction to the Court of Appeals which upheld the lower court’s finding but modified the decision to only impose a fine against him.

“Notwithstanding the foregoing, the Court of Appeals ordered respondent Marcos Jr. to pay the [Bureau of Internal Revenue] the deficiency income taxes due with interest at the legal rate until fully paid,” the petition read.

Marcos withdrew the appeal to contest his conviction. But the petitioners stressed: “In this regard, while it is improper for the Court of Appeals to disregard the penalty of imprisonment in the conviction of respondent Marcos Jr., the absence of any appeal therefrom only affirms the incontestable fact that respondent Marcos Jr. is a convicted criminal,” they added.

The petitioners pointed out that Marcos declared under oath that he has never been found liable for any offense, which carries the accessory penalty of perpetual disqualification to hold public office. This was when he ticked the NO box on the COC he filed.

They pointed out that following Presidential Decree No. 1994, the NIRC has been amended to state that in cases of conviction of a crime penalized under the said law, the accessory penalty of perpetual disqualification from holding any public office, to vote and to participate in any election is included.

They asserted that the penalty of disqualification is an inevitable consequence of conviction, and is not dependent on the penalty actually imposed.

“Clearly, the inescapable fact is that the mere fact of conviction for violations of the provisions of the NIRC perpetually disqualifies respondent Marcos Jr. from participating in any election, more so to run for any public office,” the petition read.

Crime involving moral turpitude

They also argued that Marcos is not eligible to hold any position of public office due to his convicting of a crime involving moral turpitude.

Section 12 of the Omnibus Election Code provides that a person sentenced by final judgment for a crime involving moral turpitude shall be disqualified to be candidate and to hold any office, unless granted pardon or amnesty.

The petitioners cited the 1967 case of In Re: Atty. Isidro Vinzon where the Supreme Court held that “moral turpitude” involves acts done contrary to justice, honesty or good morals.

They also noted that Marcos’ “repeated failure” to file his income tax returns from 1982-1985 “cannot be characterized as a mere ‘omission,’ but already constitutes willfulness and fraudulent intent on the part of respondent Marcos Jr. This plainly shows respondent Marcos Jr.’s moral turpitude.”

“Having been convicted by final judgment of a violation of the National Internal Revenue Code (NIRC), Marcos is perpetually disqualified from holding any public office, to vote and to participate in any election as mandated under the NIRC,” they added.

The petitioners also said they are unaware of any record showing Marcos Jr., as heir of his late dictator father, having paid estate taxes. Citing an opinion column of retired SC Senior Associate Justice Antonio Carpio, they said that the estate tax liability of the Marcoses would already amount to P203.8 billion.

“Considering the propensity of respondent Marcos Jr. to evade his positive duties as a taxpayer, and the totality of the circumstances of his prior conviction for the violation of the NIRC is one with moral turpitude,” they added.

A 95-YEAR-OLD COVID SURVIVOR AND OTHER STORIES OF RECOVERY

August 31, 2021 - It’s par for the course when you write commentaries that you get both positive and negative comments.

A certain Gochong Go writes that our ivermectin-plus-melatonin-based recommendation for COVID-19 prevention and treatment should be printed in the animal section, insinuating that it’s not fit for humans.

But with every negative comment like this, we get at least five positive comments, which reassure us that the isolated negative comments are not a metric of the usefulness of the information we try to convey to our readers.

Dr. Carmen Mayugba-Sugai, who has now retired from a successful practice in the United States, shares: “Thanks for the [treatment] protocol. I was able to use it for the husband of my niece who lives in Baton Rouge, Louisiana. He was positive for COVID—possibly Delta variant—was unvaccinated and not observing safety precautions like [wearing] masks and social distancing. He responded favorably within three days of the regimen and continues to improve. My niece was at first [a] skeptic, but I insisted, citing examples of recovery from this regimen. Thank God she listened.”She adds: “This example demonstrates the effectiveness of targeting the virus in the earliest stage of infection—getting rid of the virus from the body and preventing replication of the virus while at the same time working on improving the patient’s immune system.”

Working treatment

Bill Cowper of Pasig City shares: “The entire family of my friend got COVID. Everyone took IVM (ivermectin), melatonin and the entire vitamin regimen of Dr. Raffy Castillo, except the dad. He doesn’t believe in IVM. He was the only one hospitalized and he died 18 days later. The entire family including the house help got well within days, staying all at home. The treatment regimen really works.”

Lorna Adlawan-Fernandez of Kawit, Cavite, shares her double close encounter with COVID-19. First, her mother-in-law succumbed to the infection in the hospital during the last surge in April, then her husband Chin, who took care of his mother, also got infected with severe COVID.

There were no more available hospital rooms in Metro Manila when Chin fell ill. They had no choice but to treat him at home, despite the findings of bilateral COVID pneumonia and dipping oxygen blood levels. Since he’s middle-aged with several comorbidities, he was considered a high-risk patient.

Lorna writes: “With our second bout of battling this disease, we chose the unorthodox method [and used] your treatment … my husband’s cocktail of drugs was a mix of known supplements, traditional scientifically based medicines, megadoses of melatonin, and that controversial drug ivermectin (human dose). And of course truckloads of prayer.”

By the grace of God, Chin recovered.

Fe Sedilla of Manila, whose 95-year-old mother, Nanay Purificacion, also got afflicted with COVID-19 during the last surge, shares with us her mother’s miraculous recovery.

“Habang buhay po naming tatanawing utang na loob sa inyo ang tulong na ipinagkaloob nyo sa amin sa oras ng aming pangangailangan. Thank you po, Doc, for your treatment,” she writes.

Fe adds: “Nanay Purificacion had fever and cough … the swab test result was positive. At the start of the second week, her oxygen level started to drop. My niece had sent us two tanks of oxygen before Nanay’s oxygen dropped. The following days were very stressful for the whole family. At 8 p.m. every day, all the children of Nanay prayed together via Zoom.

“Until today, my siblings and I never stopped praying at 8 p.m. via Zoom because we believe that with the right medication and lots of prayers, COVID can be defeated. Thank God for extending the life of my Nanay. Thank you, Doc, for your treatment guidance.”

Feedback

These are just samples of the feedback we’ve been getting on the treatment guidance we offer to COVID patients free of charge. Many offer to pay but we politely tell them to pay it forward to others who may need their help. Some of them give generous donations to the foundation we support, which also helps COVID-19 patients.

We emphasize, though, that what we offer is a guidance, not a prescription. We recommend it has to be given under a doctor’s supervision, and if symptoms are severe, particularly in the elderly and high-risk cases, they have to be hospitalized. During surges, many resort to the treatment guidance while looking for a hospital.

We get calls asking us what to do for a relative who’s feeling ill with COVID symptoms. We advise them to start the treatment regimen and urge them to continue looking for a hospital the following day. Some of them report that the patient feels much better the next day, their oxygen levels are improving, and they decide to just continue treatment at home. This approach is quite risky, but at least it’s giving many a fighting chance rather than resign in their fate with a sense of hopelessness.

Losing credibility

Last week, we received more than a dozen feedback from readers, patients and even colleagues about the recent salvo of negative comments from our Department of Health (DOH), warning everyone about the use of ivermectin for the prevention and treatment of COVID-19.

As usual, the DOH is again mimicking the announcements of authorities in the United States such as its Food and Drug Administration (FDA), which misinforms the public by saying ivermectin is mainly a livestock medicine. They’re again badmouthing ivermectin because they likely noted that the prescriptions for the drug have increased elevenfold since July in the United States.

A similar trend is happening here. Many doctors are already silently prescribing ivermectin, melatonin and other treatments off-label for COVID-19.

We’re just relaying the feedback of the majority who come to us for advice—that our DOH is fast losing its credibility, not only because of its questionable budgetary transactions, but because of its inexplicable insistence to deny the public of a cheap and effective regimen.

It’s unthinkable why, in the absence of anything better to offer COVID-19 patients, the DOH should discourage the public and rebuke physicians who offer them an ivermectin-based treatment.

The DOH’s old refrain that there remains no evidence that ivermectin would work to help COVID patients, and could instead pose harmful effects, is already taxing the incredulous minds of many. We discourage those who put one and one together, by associating this aversion for ivermectin and other cheap medicines, and the seeming propensity, based on the Commission on Audit reports, for expensive or overpriced medicines and supplies. But if you come to think of it, with a modicum of governance paranoia, that seems to be a possible reason.

Challenging experts

We have been challenging the local experts who still oppose the use of ivermectin and the rest of the regimen we propose to just try it on 10 patients. If they do it with an open mind, we’re confident that many will change their minds, and perhaps do penance for the countless lives that may have been saved if they were just given the fighting chance.

In our group, we have treated thousands of COVID-19 patients and, by God’s grace, as far as I know and can remember, everyone who took the regimen within three days of symptoms all recovered with no need for hospitalization. If they start late within six days, some of them may require confinement, but they still eventually recover.

It’s an ivermectin-based regimen but it’s actually a multipronged, multidrug strategy to hit the virus hard as early as possible so as not give it any chance to replicate itself into a billion viral invader in the body. Aside from ivermectin, we recommend pure melatonin, vitamins C and D, zinc and virgin coconut oil. We also use antiandrogen drugs, antihistamines and steroids in some cases.

With this regimen, God has allowed us to heal all patients so far, a 100-percent recovery rate. We don’t think it was us who healed them, and we were just privileged to be used by God as His channel.

If the government does not support the regimen we propose, we can take our health matters into our own hands, and decide for ourselves what we feel is best for us and our loved ones. Let’s also try to help our indigent Filipino brethren with this self-help prevention and early treatment regimen. Truly, we can heal as one nation, in the palm of God’s loving and healing hands. INQ

A gentle reminder from Hong Kong Specialist: Those who suffer stroke is not advisable to take the vaccine.
北京市防疫中心提示接種科興疫苗的要求 : Beijing City Vaccine Prevention Center list down the requirements for vaccination:

1. 惡性腫瘤病者不予接種。 Those with malignant tumor are not fit to inoculate/vaccinate

2. 有基礎疾病時如高血壓,糖尿病等藥物控制不好的,不予接種。 Those people taking maintenance pills for High Blood Pressure, Diabetes are not fit to vaccinate.

3. 精神類疾病者如抑鬱症不予接種。 Those qualify for mental health like Depression is not suitable to vaccinate.

4. 家族遺傳性疾病如白化病,不予接種。 Those with hereditary diseases like Albinism are not suitable to vaccinate.

5. 心腦血管疾病不穩定,不予接種。 Those with unstable Cardiovascular diseases are not suitable to inoculate.

6. 做過心臟手術時如心臟搭橋,不予接種。 Those underwent operation such as Coronary Bypass are not fit to vaccinate.

7. 大手術後恢復期,不予接種。 Those who are recovering from major surgery are not fit to inoculate.

8. 近三個月內使用過血液制品和免疫抑制者,不予接種。 Those who used Blood products and immunosupressive within the last three months are not suitable to vaccinate.

9. 服用優甲樂的人,不予接種。 Those taking Euthyrox are not suitable to inoculate.

10. 被孕期婦女三到六個月,不予接種。 Pregnant women in their first to second trimester are not fit to vaccinate.

11. 長期服用免疫抑制劑者,不予接種。 Those taking long term immunosuppressive drugs are not fit to vaccinate.

12. 有中重度貧血者,不予接種。 Those suffer from Moderate to severe anemic should not be inoculated.

13. 三個月內服用過抗病毒藥物抗過敏藥,抗生素的必須停藥,症狀消失,一到二週後方可接種。 Those taking antiviral and antibiotics drugs within three months time can be vaccinated after one to two weeks once the drugs stop, and no symptoms persist.

14. 乙肝l和幽門螺旋杆菌抗病毒期間不予接種。 Those with Hepatitis B and Helicobacter Putlori can’t be vaccinated.

15. 高血壓控制穩定140/90以下才接種。 Those people with stable high blood pressure of 140/90 below can be vaccinated.

16. 流感禁忌的本苗都禁忌接種。 Those with root origin from Flu prevention are prohibited to inoculate.

17. 接種流感疫苗至9隔14天後才可接種。 Those people vaccinated with Flu virus can be inoculated after quarantine of 9-14 days.

1-YEAR DEVELOPMENT PLAN NG PCC-MARIKINA, KASADO NA

MARIKINA CITY, Pebrero 18, 2021 - Sa espesyal na pulong ng City Executive Committee (CEC), People's Council for Change (PCC) - Marikina City, pinangunahan ni Sol Diaz ang deliberasyon at pagpapatibay ng 1-year Development Plan para sa taong 2021.

Tampok sa plano ang mga sumusunod na hakbang na nakatutok sa paghahanda sa ikalawang City Assembly sa Abril. Bahagi ng paghahanda ang paglulunsad ng Barangay PCC Assembly sa loob ng buwan ng Marso at Abril, partikular dito ang: i) Barangay Malanday ii) Barangay Tumana, iii) Barangay Marikina Heights, iv) Barangay Parang at Barangay Fortune. Ilulunsad naman ang assembly sa iba pang barangay sa buwan ng Mayo at Hunyo.

Bilang CSO partner ng DILG Bantay-Korapsyon PMO, ang PCC-Marikina ay aktibong kikilos laban sa mga anomalya at korapsiyon sa LGU, kabilang ang mga korap sa City Hall, Punong Barangay at iba pang kawani ng LGU, alinsunod sa prinsipyo ng Participatory Governance policy framework.

Batay dito, buuin sa antas lunsod at barangay ang Bantay-Korapsyon Team (Legal & Para-Legal Committee). Magtalaga ng 3 lider-organisador bawat team para dito. Pangkalahatang gawain nito ang “case build-up” - mangalap ng mga ebidensiya, dokumento, affidavit, saksi, datos at mga impormasyon laban sa inirereklamo.

Kaugnay nito, nagpahayag ng renewal of commitment ang buong City Executive Committee (CEC), para sa puspusang gawain sa pagmumulat, pag-oorganisa at pagpapakilos sa malawak na masa:
Sol Gabs Diaz - President; Josefina Flores Andes - Vice President; Esther Regellana - Secretary-General; RC Faminiano - Deputy Secretary-General, District 1; Edmundo Mission - Deputy Secretary-General, District 2; Pastor Mickel Marin - Treasurer; Pastor Freddie Corpuz - Auditor.
