Amid the controversy trailing the intervention of President Bola Tinubu in the crisis rocking Rivers State, human rights lawyer, Femi Falana, has said that the President cannot reinstate 27 cross carpeting members of the Rivers State House of Assembly.

In a statement on Tuesday, Falana, a Senior Advocate of Nigeria (SAN), said that presidential interventions must always be grounded in the provisions of the constitution.

“With respect, the presidential reinstatement of the 27 cross carpeting members of the Rivers State House of Assembly by the Presidency is alien to the Constitution in every material particular,” Falana said.

Rivers State has been a theatre of the absurd in the last three months with the state House of Assembly serving as the “boxing ring”. The rift between Governor Siminalayi Fubara and his predecessor, Nyesom Wike, split lawmakers in the House with 27 of them decamping from the Peoples Democratic Party (PDP) to the ruling All Progressives Congress (APC), a party in whose central government Wike currently serves as minister.

The feud also saw the emergence of parallel sittings, an impeachment plot against the governor, the demolition of the Assembly complex, and a gale of resignations of pro-Wike commissioners in Fubara’s cabinet.

The President had on Monday met with Fubara and Wike at the A*o Villa in Abuja.

After Monday’s meeting, the President directed that the warring parties withdraw all matters instituted in the courts by Fubara, and his team, and that the leadership of Martin Amaewhule in the Rivers State House of Assembly be recognised, and not that of Edison Ehie.

Amaewhule and his 26 allies were also said to have been reinstated in the House following the presidential directive.

However, Falana said, “The seats of the cross carpeting members have been declared vacant by the Speaker known to law. To that extent, the Independent National Electoral Commission (INEC) is mandatorily required to conduct the by-election once the ex parte order issued by the Federal High Court last Friday is quashed.”

27 Lawmakers Who Defected To APC Have Lost Their Seats In The Parliament – APC Chieftain Discloses

A Chieftain of the All Progressives Congress (APC), Kalu Kalu, has said the 27 lawmakers from Rivers State who defected from the Peoples Democratic Party (PDP) to the APC have lost their seats in parliament.

He explained that the law states that an elected official can only defect from his party to another during his term if there is a leadership struggle within the party.

The lawyer explained that there is no division within the PDP.

Kalu revealed this in an interview on Arise News on Tuesday.

Kalu also affirmed his membership with the APC, saying his affiliation with the PDP is purely a lawyer-client relationship.

Speaking on the case of the lawmakers who defected, Kalu said, “The proviso in section 109-1g is clear that if there is a division in the party upon which the member came to the house in question, that the person has the right to move to another political party.

The question here now is, is there a division or a split in PDP? And the answer is clear that there is no division in PDP.

“Yesterday, PDP came out with a position that they are against what happened in Rivers State, and today, there is no conflicting or dissenting opinion from another quarter or from another group in PDP saying that what honourable Debo said is not the position of PDP. Even in Rivers State as we talk, there is only one PDP in Rivers State, and there is no other faction of PDP in Rivers State. At the national level, there is only one PDP at the national level.”

Kalu further said, “It is only when there is a leadership crisis, when there is a split in the leadership of the party at the national level that you can now say that there is a split. But as we speak today, PDP is conducting its affairs without any faction in anywhere in the country, precisely at the national level and at the Rivers State level. So, there’s no split, there’s no division in the PDP, and I stand to be quoted wrong.

“The 27 affected constituencies, their seats are already vacant, going by the provision of the 1999 constitution of the Federal Republic of Nigeria as uttered.

Court confirms Fubara’s ally, Rt. Hon. Ehie as authentic Rivers Assembly Speaker

"APC will drag Justice Danagogo before NJC" - APC Chairman, TONY OKOCHA

The Progressives Congress, APC, in Rivers State has threatened to petition Justice M. W. Danagogo of the Rivers State High Court before the National Judicial Council (NJC) over his ruling on the crisis rocking the State House of Assembly.

A Rivers State High Court sitting in Port Harcourt on Tuesday, presided over by Justice Danagogo had confirmed leader of pro-Fubara lawmakers, Rt. Hon. Edison Ehie, as the authentic Speaker of the Assembly, restraining Rt. Hon. Martins Amaewhule, from acting as Speaker.

The Court also issued a fresh order stopping Amaehule and 26 other lawmakers loyal to Nyesom Wike from accessing the House of Assembly Complex.

But reacting to the ruling by the court, the Chairman, Caretaker Committee of APC in Rivers State, Chief Tony Okocha described the confirmation of the Edison Ehie as authentic Speaker of the state Assembly by Justice Danagogo as an abuse of court processes.

Okocha while addressing newsmen in Port Harcourt on Tuesday said the exparte order issued by Justice Danagogo was a clear violation of the law and NJC principles.

The APC Chairman hinted that the ruling and exparte order granted to Edison Ehie was to pave way for Governor Siminalayi Fubara to present the 2024 Budget to the Assembly as well as the passage of the Appropriation Bill by only four members of the House which is in minority.

He stressed that the PDP is jittery following the defection of 27 assembly members elected on the platform of the party, to APC.

His words, “Today, Rivers people woke up to hear that one Justice Danagogo of the Rivers State High Court granted with impunity, an exparte order to one Hon. Edison Ehie recognizing him as Speaker of the Rivers State House of Assembly.

“It will be recalled that the same Hon. Edison had approached a Federal High Court in Rivers State seeking to be declared as Speaker in the case in the issue, arguments have been taken and judgement reserved for January 2024.

BREAKING: 27 House Of Assembly Members in Rivers State Defect from PDP to APC [PHOTOS]

27 Members of the Rivers State House of Assembly have defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

This may not be unconnected to the unending political tension in the state.

The crisis came into public light following the burning of the Rivers State Assembly Complex on 29th October. In reaction, the Minister of the Federal Capital Territory (FCT), Nyesom Wike, accused Rivers State Governor, Siminalayi Fubara, of orchestrating the burning of a section of the State House Assembly complex.

The rift among members of the State House of Assembly had led to some lawmakers commencing impeachment proceedings against Governor Fubara. This move was, however, halted following the intervention of President Tinubu.

A member of the Assembly, Enemi George, who confirmed the development to Channels Television said the 27 lawmakers were under the leadership of Martin Amaewhule.

According to him, the decision to defect to APC was taken during their sitting on Monday.

70% Of Nigerian Students Are Criminals — EFCC Boss

The chairman of the Economic and Financial Crimes Commission (EFCC), Ola Olukoyede, has raised concern over the growing prevalence of Nigerian youth involvement in cybercrime.

According to him, it is alarming that seven out of ten students in Nigeria are now engaging in cybercrime.

Speaking during a courtesy visit from Daar Communication PLC, Olukoyede called upon the media to play a crucial role in enlightening the youth about the detrimental consequences of such activities.

“We are looking towards Daar Communications to enlighten our youths on the evils of cyber crimes. It is worrisome that seven out of ten students today are involved in cyber crimes,” Olukoyede said.

“These are the youths we are preparing to be leaders of tomorrow. The media should not relent in enlightening them on the evils of such criminal practices,” he added.

While describing the practice as a menace and cankerworm in the society, Olukoyede called for a wider media enlightenment of the youth across the country on the effects of indulgence in internet fraud.

Igwuruta based Medical Doctor Re- Arrested For Allegedly Killing 20-year-old Woman And Selling Her Baby Weeks After He Was Arrested For Trafficking 3 Kids in October

Dr Happiness Eyinnaya Iheukeumere, aka Dr Hagi, of Hagi Medical Center, located at Abohga Igwuruta Market Road, Port Harcourt, who was arrested in October over allegations of child trafficking has now been rearrested.

This time, he is accused of killing a 20-year-old pregnant woman and selling her baby.

Dr. Hagi allegedly performed surgery on a pregnant woman identified as Racheal Sampson to remove her baby. She did not survive the surgery.

Subsequently, the doctor took her baby away and it is believed he sold the child.

According to the sister of the deceased, Dr. Happiness told a nurse to inform their family that Racheal died in a car accident.

She said, “On the 15th of November, 2023, an anonymous lady called us to inform us that my sister had died in a car crash. The informant sent us a fake number and told us that she got from the tip-off from that number. We asked her where my sister’s dead body was deposited and she couldn’t say.

“We tried contacting the number she sent but it proved abortive. Then, my parents went to Aba in search of my late sister’s body since an accident happened there. But the police and medical personnel told my parents that no woman died at the scene of the accident.

“We reported the development to the police and they helped us to track the anonymous lady who gave us the tip-off.

“The anonymous lady had claimed that she was POS agent and resided at Choba in Rivers State but that was false as we found out that she was a nurse.

“She was eventually arrested and confessed that Dr. Happiness had brought my sister to stay with her for one week but came to pick her up on Monday, November 13.

“Two days later, he called the nurse and told her that my sister died while he was operating on her and instructed her not to tell the family. He ordered her to blacklist our numbers. We weren’t even aware that Racheal was pregnant and we never took her to the doctor’s hospital.”

The nurses who worked with Dr. Happiness were questioned and they admitted to being present

The power struggle between the FCT minister, Barrister Nyesom Wike and his estranged political godson and governor of Rivers state, Sim Fubara, has taken a different dimension, despite the call by several stakeholders, who called on both parties to sheathe their sword to embrace peace.

In the latest row, an Ijaw group, under the aegis of Ijaw Renaissance Force (IRF), threatened a resurgence of militancy in the oil rich Niger Delta if Governor Sim was unconstitutionally removed through either an illegal impeachment or a stage- managed judicial judgement.

In a statement jointly signed by the coordinator of the group, Wisdom Oniekpar Ikuli and its spokesperson, Sir White Kalio, the group berated the role of some state and non-state actors in aggravating the matter, through an attempted illegal removal of Fubara.

Part of the statement read, “We, Ijaw Renaissance Force, a coalition of over 100 ethnic nationalities and youth groups operating in Rivers and Bayelsa have watched with grave concern, the ongoing power tussle between the former governor of Rivers state, Barrister, Nyesom Wike, now minister of FCT and Governor Sim Fubara of Rivers state.”

“We have also watched with baited breath attempts by some elected officials and other non-state actors to stage manage the forceful removal from office of a duly elected Governor Fubara through the back door without any justifiable reason.”

The group sounded a note of warning for trouble makers, reminding them of the grave implications of their actions.

“We, therefore, state unequivocally that any attempt or vexed impeachment or stage-managed judicial removal of Governor Sim Fubara from office would spell another return to the oil war struggle in Rivers state. A word is enough for the wise.”

The group also asked President Bola Tinubu to resolve the ongoing conflict between Fubara—an Ijaw ethnic group member—and Wike, his predecessor.

The group’s coordinator, Joseph Evah, made this known while speaking on Channels TV on Tuesday.

He said, “What is happening in our River State, fire is on the mountain in River State. We want the President to intervene in this matter. Call the FCT minister to order. We don’t want fire on the mountain in River State. That is our demand.

“Ijaw people will never fold hands. Just like Ikwerre people would not fold hands if they want to mess up their own son. The Urhobo people will not fold hands. The Yoruba people never folded their hands when annulment of June 12 took place.”

According to The PUNCH, Tinubu and the governors of the Peoples Democratic Party intervened in October to halt the impeachment proceedings against Fubara.

The state House of Assembly was the scene of an explosion on October 29, which seriously damaged property valued at millions of naira.

Moreover, it is stated that on October 30, early in the morning, while the governor was visiting the Assembly, law enforcement officers shot him with tear gas.

Wike and Fubara’s relationship reportedly soured since the Assembly was about to consider impeaching the governor.

Wike, a former state governor, has been accused by some of orchestrating the impeachment process.

VOICE NOTE: Rivers Police TELLS 2 BABA To Submit Himself FOR INVESTIGATION Over Killing OF DPO

Gift Okpara, who is also known as 2Baba, the leader of the Iceland cult gang, remains wanted by the Rivers State Police Command.

The Command said 2Baba is the prime suspect in the gruesome murder of the Divisional Police Officer of Ahoada East Local Government Area of the State, SP Bako Angbashin.

In a statement issued in Port Harcourt by the spokesperson for the state police command, Grace Iringe-Koko, 2Baba has been urged to submit himself for investigation.

The police statement is sequel to the voice note, purported to be that of the notorious cultist, which was aired on a popular Radio Station, 92.3 Nigeria Info in Port Harcourt last Monday.

In the voice, the wanted cultist denied any involvement in the crime alleged against him.

“The Rivers State Police Command has taken note of a recent radio announcement in which Gift David Okpara, also known as 2Baba, a notorious cultist and murder suspect wanted in connection with the killing of Superintendent of Police, SP Bako Angbashim, former DPO of Ahoada Police Division in Rivers State, denied his involvement in the tragic incident.

”The police understand the importance of listening to the other party, and it is crucial to note that everyone is considered innocent until proven otherwise.

“As such, the Rivers State Police Command urges Gift David Okpara, aka 2Baba, to come forward and submit himself to the authorities, providing the opportunity to present evidence that could support his claims of innocence.

“The police are committed to upholding the principles of due process and are open to receiving any information that can aid in the ongoing investigation.

“It is imperative for Gift David Okpara to cooperate with law enforcement to ensure a thorough and transparent resolution to this serious matter.”

Appeal Court Affirms Siminalayi Fubara as Governor of Rivers State

The Appeal Court sitting in Lagos State has affirmed Governor Siminalayi Fubara of the Peoples Democratic Party (PDP) as the duly elected governor of Rivers State.

The court dismissed the petition filed by the governorship candidate of the All Progressives Congress (APC) in Rivers State, Patrick Tonye-Cole, against the governor and the Independent National Electoral Commission (INEC).

The court affirmed the verdict of the Tribunal, which had in October upheld Fubara’s electoral victory. According to the court, the APC that sponsored Cole had withdrawn the petition against Fubara’s victory.

Cole, who came in person to the court, had petitioned the court to declare him the rightful winner of the election, alleging irregularities and misconduct in the electoral process.

Rivers guber: Appeal Court fixes today Nov 28 for judgement

• The camp of Rivers State Governor Sim Fubara had earlier alleged that former Governor Nyesom Wike plans to use the courts to remove him.

The Court of Appeal sitting in Abuja will deliver judgement on the Rivers State governorship election on Tuesday.

The former governor, now Minister of the Federal Capital Territory, is said to be ready to throw his weight behind another candidate from another party in a fresh election.

The All Progressives Congress (APC) had appealed the judgement of the Governorship Election Tribunal, which upheld the election of Fubara of the Peoples Democratic Party (PDP), in a petition by its candidate, Patrick Tonye-Cole.

The three-man panel of the tribunal, in their judgement, dismissed the petition of Tonye-Cole for lacking merits on the grounds that he lacked the power to independently challenge the victory of Governor Fubara without his political party, amongst other grounds
