“GBAJABIAMILA’S APPOINTMENT AS TINUBU’S CHIEF OF STAFF IS A CONSTITUTIONAL ABERRATION" - Inibehe Effiong

The appointment of the current Speaker of the House of Representatives, Mr Femi Gbajabiamila, as the Chief of Staff to the President by Mr Bola Tinubu is a constitutional aberration.

Nigeria operates a constitutional democracy based on the principle of separation of powers. Sections 4, 5 and 6 of the 1999 Constitution vest the legislative, executive and judicial powers of the Federation in the National Assembly, President and established Courts respectively.

The principle of separation of powers under our constitutional framework applies both to functions and personnel of the different organs of government. The intention of the framers of the Constitution was to give each arm independence from the other arms of government.

It is a travesty of this principle, for Gbajabiamila’s appointment as Tinubu’s Chief of Staff to be announced without him first resigning not only his speakership position, but also his membership of the House of Representatives.

The position of Chief of Staff to the President is not a trivial position. It is a very significant executive position. By virtue of 68 of the Constitution, it is forbidden for a member of the National Assembly to occupy executive position while still a legislator.

Section 68 of the Constitution further provides that a member of the National Assembly shall cease to be a member, if circumstances arises which would have disqualified such a member, had it arisen at the time of the election. This appointment is such a circumstance.

The relevant question is: if Gbajabiamila was the Chief of Staff to former President Buhari, would he have been qualified to seek re-election as a member of the National Assembly without first resigning his appointment as mandated by Section 84(12) of the Electoral Act, 2022.

The answer is obviously in the negative. The attempt to strike-down Section 84(12) was defeated at the Supreme Court.

Also, the Code of Conduct for Public Officers under Part 1 of the Fifth Schedule to the Constitution forbids a public officer from enjoying double emoluments.

The fact that the tenure of the current National Assembly will elapse in a few days time, does not lessen the controversial character of this appointment. Gbajabiamila’s appointment has trivialized the status of the National Assembly as a separate arm of government.

As a legal practitioner, he ought to know the implications of his conflicting dual roles on our nation’s nascent democracy and constitutional order. His acceptance to serve two masters in this circumstance has eroded whatever was left of the independence of the National Assembly.

I have however noted that Gbajabiamila in his acceptance statement on his social media accounts, indicated that his appointment will take effect on June 14, 2023; a day after the inauguration of the 10th National Assembly.

It would have been tidier for the appointment not to be announced until he has vacated his position as Speaker of the House of Representatives in order to preserve the institutional integrity of the National Assembly as a separate arm of government.

If urgent national issues arises that requires the National Assembly to assert its independence, and call the Executive to order, can the Speaker discharge his functions effectively and independently given his conflicting positions following his appointment as Chief of Staff?

The fact that the appointment has not yet taken effect does not extinguish the appointment or render the instrument of appointment (letter of appointment) void. It only means that he’ll begin to perform the factions of his new position at a later date. But he has been appointed.

President Muhammadu Buhari approves redesign, production, and circulation of new series of N200, N500, and N1,000 banknotes.

Central Bank of Nigeria Governor, Mr. Godwin Emefiele says the issuance of new Naira banknotes, 20 years after last redesign exercise, will commence December 15, 2022.

CBN says new and existing currencies shall remain legal tender and circulate together until January 31, 2023 when the existing currencies shall cease to be legal tender.

CBN frowns at high rates of counterfeiting of N500 and N1,000 banknotes.

CBN says Bank seeks to mop up about N3.32 trillion outside the banks’ vaults to take control of money supply in Nigeria.

“The integrity of a local legal tender, the efficiency of its supply, as well as its efficacy in the conduct of monetary policy are some of the hallmarks of a great Central Bank,” – Emefiele

CBN faults hoarding of banknotes by members of the public; says over 80 percent of currency in circulation are outside the vaults of commercial banks.

ON NNAMDI KANU'S TRIAL. [TRIAL CONTINUES...]

The Office of the Attorney General of the Federation and Minister of Justice has received the news of the decision of the Court of Appeal concerning the trial of Nnamdi Kanu. For the avoidance of doubt and by the verdict of the Court, Kanu was only discharged and not acquitted.

Consequently, the appropriate legal options before the authorities will be exploited and communicated accordingly to the public.

The decision handed down by the court of appeal was on a single issue that borders on rendition.

Let it be made clear to the general public that other issues that predates rendition on the basis of which Kanu jumped bail remain valid issues for judicial determination.

The Federal Government will consider all available options open to us on the judgment on rendition while pursuing determination of pre-rendition issues.

Justice Jummai Hanatu who lead the three man panel said the 15 count charge against Nnamdi Kanu didn't disclose the place, date and time and nature of the alleged offences they charged him with before they forcefully brought him back to Nigeria.

The court said the whole process is clear violation of international laws.

ASUU strike: End in sight as union meets with Gbajabiamila and House leadership
..Industrial action end in a matter of days

The ongoing industrial dispute between the Academic Staff Union of Universities (ASUU) and the Federal government could be over in a couple of days, Speaker of the House of Representatives, Rep. Femi Gbajabiamila said Monday evening.

He also disclosed that the leadership of the striking lecturers is set to sign an agreement to end the dispute based on the recommendations by the House that was presented to President Mohammadu Buhari by the House Leadership.

The Speaker also revealed that having received the House recommendations on the issue, President Buhari would on Tuesday, make a pronouncement towards the final resolution of the issue.

Having assured the leadership of the striking workers at the last meeting with the House leadership and other stakeholders that they (ASUU) would be invited for feedback from the meeting with Mr. President, Gbajabiamila expressed delight that the President's disposition to the House's intervention was positive.

He said: "I have visited the President twice. We spoke with Mr. President. There was one of the sticking points, the issue of no work no pay, the President did ask to digest the recommendations and would have one more meeting, which we did on Friday after the budget presentation.

"That meeting was even better than the first one we had with him and Mr. President has agreed to certain things but I'm not going to talk about that now.

"He would disclose whatever it is tomorrow (Tuesday) on that one remaining issue.

"But beyond that, the other issues have been taken care of. We were able to make sure that what ASUU was asking for in terms of the Revitalization Fund, in terms of salary, there has been significant improvement.

"Revitalization has been provided for in the budget, we made sure of that. The salary structure has been looked at, and there's been an improvement as well and we made sure of that.

"The issue of UTAS is another important issue, both ASUU and the Office of the Accountant General and the government have agreed that they would work together to resolve the peculiarities of UTAS required for the payment plan and IPPIS. They will sit down together, and the Chairman of the House Committee on Tertiary Education will also be part of that tripartite sit-down arrangement to include all those things that are required by ASUU in the IPPIS platform.

"So I believe we've covered ground, we've covered most of the thorny issues and what we have agreed with ASUU now is basically to put everything on paper and sign off.

"I believe if we had met yesterday and the papers had been drawn up, I'm sure ASUU would have called off the strike today.

"But we've only just met today.

"As I have stated, hopefully in the next couple of days, of course, once ASUU gets back to its base as well, once that is agreed, I'm very hopeful and very excited about the possibility or probability that the strike will be called off in a matter of days".

Gbajabiamila appreciated the union leadership for allowing the House leadership to make an input towards a lasting solution to the crisis, noting that short notices for meetings as well as public holidays were not enough to stop the union leaders from honouring invitations to meetings.

In his response, ASUU President, Prof. Emmanuel Sodeke, who led other members of the union to the meeting, corroborated the views expressed by the Speaker over the signing of the agreement to end the strike.

He said: "My union operates bottom-up. We don’t take decisions without their consent. So we have agreed that between now and tomorrow.

"We are going to get some documentation signed so that we can take them to our members, and we will do that as quickly as possible in the interest of Nigerians and the students so that this can be resolved as soon as possible.

"From what we have seen today, I think for the first time since our actions started, we are seeing the light at the end of the tunnel".

While appreciating the efforts of the Speaker and the House towards the resolution of the dispute, Osodeke, however, expressed optimism that the end of the strike is in sight.

Saying that the interest of the children who have been at home for so long is paramount, Osodeke noted that the union believed that the intervention of the House is genuine and could be trusted.

EXCLUSIVE: Protest Against EFCC Turns Bloody As Nigerian Police Shoot 3 Protesters, Over 20 Trucks Burnt

Tuesday's protest embarked upon by youths against the operations of the anti-graft agency, Economic and Financial Crimes Commission (EFCC) in Delta State has turned violent and bloody as the protestors allegedly encounter incessant harassment, molestation and arrest by officials of the anti-graft agency.

The protest, which caused serious commotion and panic took place at the Otovwodo junction of Ughelli community, Ughelli North Local Government Area of the state. It allegedly involved suspected internet fraudsters, popularly known as ‘Yahoo Boys.

According to report, over 20 trucks with goods worth several millions of naira were burnt and more than three youths were allegedly shot by personnel of the state command of the Nigeria Police Force.

The victims are currently in a life-threatening condition at an undisclosed hospital in the area where they were taken for treatment.

Several trucks loaded with granites, petroleum products and other goods were burnt by the protesting youths, who also barricaded the busy Otovwodo junction, Ughelli, along the East-West Road.

Meanwhile, reports gathered that the protestors chanted war songs as they burnt tyres on the affected road. The protest which was tagged ' ' started around 11:00 am, disrupting vehicular movements.

They displayed placards with different inscriptions such as " ", "EFCC, leave us alone, we are not criminals", and "Stop the harassment, molestation, intimidation and indiscriminate arrest".

Femi Gbajabiamila the speaker of the House of Representatives, in a recent report disclosed that the President has accepted the report of their engagement with the Academic Staff Union of Universities, ASUU, on how to resolve the ongoing industrial action embarked upon by the union.

“As you know, what is on the front burner today, even beyond the politics, is that our universities, our lecturers, and our children are out of school.

“The House of Representatives decided to step in at that point four weeks ago and we’ve had a series of meetings that lasted hours and we’ve been able to get both sides to shift grounds to an extent and what we came to discuss with Mr President is about those recommendations.

“Mr President, as usual, had a very good listening ear, he took the report of the House, accepted it. We discussed at length, the details of the report and he wanted to go through them himself. We have another meeting on Thursday (tomorrow) between our good selves and Mr President for his final decision. We had a good engagement, with a very positive response.

“He asked us a couple of questions on some grey areas which we clarified, and he accepted the report and he wanted a couple of days to go through it.

“We are working and we are hopeful that this (strike) will soon be a thing of the past. I know once this is agreed upon, the strike will be called off.’’ he concluded.

Speaking with journalists after the meeting, the speaker highlighted the reason for their visit, saying, “After a series of engagements with ASUU and with people on the executive side, we’ve been able to come to some kind of decisions and recommendations to be made to Mr. President for his approval.

Rev father Ejike MBAKA Removed from Adoration Ministry Enugu

Bishop Callistus Onaga Of The Catholic Diocese Of Enugu has appointed Rev Fr Anthony Amadi as the new director Adoration Ministry Enugu Nigeria - AMEN.

While Rev Father Ejike Mbaka was instructed to go to Monastery for deep prayers to ask God for proper directions over his CALLING which he made controversial.

Recall that Fr Mbaka had on last week Thursday announced in a statement that Adoration Ministry activities would resume on Sunday.

However, it was gathered that drama unfolded as an attempt to replace Mbaka with another priest by the Enugu Catholic Bishop Callistus Onaga was resisted on Sunday as the congregation attempted to mob the new priest.

Meanwhile, some of the Adoration faithful, who spoke to newsman, vowed that no other priest would be welcome to the Chaplaincy, alleging a gang-up from certain quarters in the church against Mbaka.

The Catholic Bishop of the diocese, Most Rev Onaga, on June 3 banned Fr Mbaka from commenting on partisan politics.

Shortly after the initial ban was lifted, Mbaka violated the ban and verbally attacked Peter Obi, the Labour Party presidential candidate, describing him as a ‘stingy man’.

Following outrage and condemnation that trailed the attack on Obi, the Bishop issued a pastoral injunction on attendance to Catholic Adoration Ministry Chaplaincy Enugu, and enjoined all Catholics to stop visiting the ministry till further notice.

The Bishop also advised the Catholic faithful to pray for Mbaka.

Onaga had said, “In the light of the happenings in the Catholic Adoration Ministry Chaplaincy Enugu; capable of undermining the Catholic faith and teachings; and after several fraternal corrections and admonitions to Fr. Camillus Ejike Mbaka, the Chaplain of the Ministry; and after having given him pastoral directives and guidelines for the Ministry Chaplaincy, which he persistently violated. And in fulfilment of my pastoral duties as the Chief Shepherd with the obligation to promote and safeguard the Catholic faith and morals in Enugu Diocese, I hereby prohibit all Catholics (clergy, religious and lay faithful) henceforth from attending all religious and liturgical activities of the Catholic Adoration Ministry until the due canonical process initiated by the Diocese is concluded. My decision is based on the fact that some of the teachings and utterances of Fr. Camillus Ejike Mbaka at the Catholic Adoration Ministry are not consistent with the teachings and faith of the Catholic Church.”

Men of the Rapid Response Squad and the Lagos Task Force have embarked on a patrol of the Lagos metropolis ahead of Saturday’s Independence Day and planned political rallies in the state.

Alleged Kidnaper, John Ewa And Other Members of his Gang Paraded in Yenagoa

Suspected kidnap kingpin, John Ewa, who was arrested few days in Abuja was on Monday paraded alongside three other members of his gang by the Bayelsa State Police Command at the Police Officers Mess, Yenagoa Bayelsa State.

He was kidnap at his residence at Okaka, Yenagoa, on 30th June 2022, he was released on 14th July 2022 after paying a ransom of 60 million naira. Thirty (N30) Million Naira cash and US Dollar equivalent of Thirty (N30) Million Naira.

The four alleged kidnappers arrested by the Police are Emmanuel Charles Angase, a 37 years, native of Azuzuama Community, Southern Ijaw LGA, Bayelsa State who is the leader of the kidnapping gang

John Ikechukwu Ewa aka John Lion, a native of Eruan Community in Boki LGA, Cross River State. Innocent Kingsley, a native of Egbu Community Etche LGA, Rivers State and Timi Werikumo, a 21 years, native of Azuzuama Community Southern Ijaw LGA, Bayelsa State.

All the suspects will be charge to court at the conclusion of the investigation.

A 21-year-old man identified simply as Chukwudi who k!lled his mother and father in Nnewi, Anambra state has been arrested.

Meanwhile, the suspect said to be an undergraduate of a university in Anambra, is the only son of the couple, Mr. and Mrs Micheal Ulor, from Nsukka, Enugu State.

The already decomposing corpses of the parents were found with machete cuts in their apartment at Mr. Moses Nnodu’s compound, Abubor Nnewichi-Nnewi, close to Orie Agbo Market on Thursday evening, September 22, 2022.

It was gathered that the suspect allegedly k!lled his parents after a heated argument over their refusal to give him money.

It's suspected that Chukwudi killed his parents three days ago before he fled to an unknown destination.

The corpses were reportedly discovered by neighbours, who started perceiving offensive smell from their bedroom. It was also claimed that Chukwudi is a drug addict and known for taking Mkpurummiri (Methamphetamine)

Spokesperson of the State Police Command, DSP Ikenga Tochukwu, who confirmed the incident on Friday September 23, said it has launched a manhunt for the suspect.

"The commissioner of police, CP Echeng Echeng described the discovery of the already decomposing d€ad bodies in an apartment in Nnewi on 22/9/2022 at about 5:20 pm with machete cuts, as an act of man’s inhumanity to man.

“He has ordered an immediate manhunt of the suspect. He further directed the immediate transfer of the case to State Criminal Investigation Department for discreet investigation.”

The Ukranian Ministry of defence has released shocking photos showing the devastating condition of a Ukranian soldier captured by Russia.

Mykhailo Dianov, a Ukrainian soldier was released on Wednesday, September 21 by the Russian government after the UAE helped broker a prisoner exchange between Ukraine and Russia.

Before his capture, Mykhailo Dianov, helped defend the Azovstal plant in Mariupol. He trended in Ukraine after the release of a photo where he smiles despite the serious injury to his arm inside the Azovstal steelworks during the early stages of the war.

After four months in Russian prison, Diano said he did not receive any adequate medical help according to the Russian ministry of defence.

The Ukranian ministry of defence tweeted on Friday evening;

"Ukrainian soldier Mykhailo Dianov is among the fortunate ones: in contrast with some of his fellow POWs, he survived russian captivity. This is how russia “adheres” to the Geneva Conventions. This is how russia continues the shameful legacy of Na**sm."
