Gvn..*Statutory bail granted to Kashmiri separatist leader Shabir Shah in PMLA case*

New Delhi, June 14: Delhi's Patiala House Court recently granted statutory bail to Kashmiri separatist leader Shabir Ahmad Shah in a money laundering case under PMLA. Despite the grant of bail, he will remain in custody as there are other cases pending against him.

He was arrested in 2017 in this case. He sought statutory bail on the grounds that he has undergone more than half of the maximum sentence for an offence under PMLA.

Additional Sessions Judge (ASJ) Dheeraj Mor granted bail to Shabir Ahmad Shah under Section 436 A Cr.PC on furnishing a personal bond of Rs one lakh and one surety bond in the same amount.

While granting bail, the court has imposed several conditions, including that he will not leave the country without the prior permission of the court.

While granting bail, the trial court referred to the judgement of Supreme court in Vijay Madanlal Chaudhary's case.

ASJ Mor said, "The applicant is not required to satisfy the mandatory twin conditions of bail as contained in Section 45 PMLA, as he has been in custody in this case for 6 years and 10 months, which is way more than half of the total prescribed maximum punishment of 7 years."

"The total prescribed maximum punishment of 7 years shall be over within one and a half months from today, if he does not succeed in the present application," the judge said in the order passed on June 7.

The court noted that Shah is stated to be in custody in other cases unrelated to the scheduled/predicate offences.

"Admittedly, the said cases are very serious in nature. However, that cannot be a sufficient ground for declining the present statutory bail application, all the more, when he has not been convicted in any of the said offences," the court said.

It further said that Even if he is granted bail in this case, he is not likely to be released from jail for the other said offences before July 24, 2024, i.e. the date on which the maximum punishment of 7 years in the present case expires for him as an under-trial prisoner.

The court also observed that co-accused Mohd. Aslam Wani has been acquitted in all predicate offences except that under the Arms Act.

An application under Section 436A CrPC was moved on behalf of Shabir Ahmad Shah for seeking his regular bail on the ground that he has already suffered more than half of the period of the maximum punishment prescribed in the offence of money laundering punishable under Sections 3/4 of the Prevention of Money Laundering Act, 2002, the offence for which he is being tried.

Advocates Prashant Prakash and Qausar Khan appeared for Shah. They submitted that he has been in custody in this case since July 26, 2017 and he would complete his entire 7 years of maximum imprisonment as an under-trial prisoner in this case on July 25, 2024, within one and a half months from today.

The counsels argued that, as per the Vijay Madanlal Chaudhary vs.. Union of India case judgement , for disposal of the present bail application under Section 436A CrPC, the applicant is not required to qualify for the mandatory twin tests contained in Section 45 PMLA.

Advocate N K Matta, Special Public Prosecutor (SPP) for ED, opposed the plea on the ground that the allegations against him are grave and serious in nature, which entails severe punishment.

It was argued that if released on bail, he may run away from justice, as based upon his previous conduct, there is a propensity that he may flee from the country.

ED's counsel further contended that the applicant was found involved in the commission of serious crimes and the generation of huge amounts of proceeds from crime from various countries, including Pakistan, to carry out unrest in Kashmir and he was also found involved in terror financing activities. Therefore, if released on bail, he may again indulge in similar criminal activities.–(ANI)

Ganderbal, Jun 14 : Jammu and Kashmir Lieutenant Governor Manoj Sinha said over 30,000 devotees paid obeisance at Mela Kheer Bhawani at Tulmulla, Ganderbal while as a Yatri Niwas to accommodate 1000 pilgrims will be completed next eight months in the district.
Talking to reporters, after paying obeisance at the Mata Kheer Bhawani Temple at Tulmulla, Ganderbal, LG Sinha, as per news agency—Kashmir News Observer (KNO), said that over 30,000 devotees visited the Temple this time. “The devotees were ferried in over 200 buses from Jammu,” he said.
The LG said that administration, relief trust and the locals of the area had ensured best possible facilities to facilitate devotees at the Temple. “Last year, when I came here, pilgrims requested for a Yatri Niwas. I spoke to officials concerned and the Yatri Niwas that will accommodate 1000 pilgrims will come up in the next eight months,” he said.

Misra Baktoo Foundation organised a social service camp for the devotees attending the Mela Kheer Bhawani here on Friday 14th of June 2024.
Scores of devotees including men, women and children, who had come from different corners of the Valley and other parts of the country, thronged the camp and consumed the refreshments served by the volunteers and members, MBF. The devotees expressed gratitude to the MBF for serving the refreshments during the day-long Mela.
In his message, Mr Tariq Ahmad Baktoo Chairman Misra Baktoo Foundation appreciated the volunteers and other members of the organization for participating in the camp and providing refreshments to the devotees. He said the Foundation has been conducting such camps regularly and offering its services during the annual Mela since last several years.

Srinagar, June 14: Weatherman here on Friday forecast heatwave over plains of Jammu and hot and dry weather over rest of the places in J&K during next five days.
However, a meteorological department official here told GNS that there is likelihood of a “brief” spell of rain/thunder/lightning on June 19 and 20.

He said on June 15-18, generally dry weather is expected even as light rain and thunder at isolated places can't be ruled out.

From June 19-21, he said, generally cloudy weather is expected with a spell of light rain/thunder at scattered places towards afternoon.

“Heat wave over plains of Jammu & hot and dry weather over rest of the places of J&K is expected during next 5 days,” he said, adding, “fresh brief spell of rain/thunder/lightning is likely during June 19 and 20.”

Regarding the temperature, he said, Srinagar recorded a low of 13.4°C against 14.0°C on the previous night and it was 0.9°C below normal for the summer capital of JK for this time of the year.

Qazigund recorded a minimum of 10.2°C against 13.0°C on the previous night and it was 2.7°C below normal for the gateway town of Kashmir, he said.

Pahalgam recorded a low of 6.9°C against 8.1°C on the previous night and it was 1.3°C above normal for the famous resort in south Kashmir.

Kokernag, also in south Kashmir, recorded a minimum of 11.2°C against 12.9°C and it was 0.9°C below normal, the official said.

Kupwara town recorded a low of 10.9°C against 11.8°C on the previous night and it was below normal by 1.7°C for the place, the official said.

Gulmarg recorded a minimum of 7.6°C against 6.0°C on the previous night and it was below normal by 1.3°C for the world famous skiing resort in north Kashmir’s Baramulla district.
Jammu, he said, recorded a low of 25.4°C against 28.8°C on the previous night and it was below normal by 0.3°C for the winter capital of J&K. Banihal recorded a low of 13.4°C, Batote 14.6°C and Bhaderwah 12.6°C, he said. (GNS)

Srinagar, June 14 : A teenage girl hanged herself to death in her home at Harwan area of Srinagar late on Thursday evening, officials said.
They told news agency Kashmir Scroll said that an 18-year-old girl (name withheld) hanged herself to death at her home in Harwan Srinagar yesterday evening.
“After spotted hanging from a ceiling, her family members rushed to nearest hospital where doctors declared her as dead on arrival,” They said.
Meanwhile, police have taken cognizance of the incident and started investigations to find out the reasons that forced the girl to take extreme steps.(KS)

Ganderbal, Jun 14 : Mela Kheer Bhavani is being celebrated with religious fervor and gaiety at Tumulla in District Ganderbal.
Devotees from various parts of country thronged to pay obeisance at the temple of Goddess Ragniya Devi Popularly Known as Mata Kheer Bhavani.
According to the news agency—Kashmir News Observer (KNO), a strong bond of love was experienced between Muslims and pandits at the occasion.
Tulmulla area of Ganderbal wore a festive look after thousands of devotees from various parts of country arrived at the temple of Mata Ragnya Devi, a revered goddess of Pandits to celebrate the annual festival of Kheer Bhawani.
Nestled in shades of mammoth Chinar trees, the temple witnessed rush of devotees, mostly Kashmiri Pandits performing the rituals of the festival around the temple. Special prayers were held in the temple where devotees offer milk and kheer to the sacred spring.
This year, a good number of devotees were witnessed compared to last year.
Emotional scenes were witnessed and exchanged between the Kashmiri Pandits and Muslims. This annual festival becomes a source of income as well for the local Muslims who set up stalls outside the temple to sell everything needed to perform the rituals of the festival.
The stalls are established by both men and women folk of the area.
The arrangements made by district administration through various departments remain appreciable during the festival. Besides other essential services adequate medical facilities are also put in the place.

New Delhi, Jun 14: The Congress on Friday said the BJP’s chest-thumping and “hollow” claims of return of peace and normalcy in Jammu and Kashmir have been thoroughly exposed by the three terror attacks in the region during the past three days.
Congress leader Rahul Gandhi said the country is demanding answers as to why those plotting against the country are not being caught under the BJP rule.
“Narendra Modi is busy responding to congratulatory messages and cannot even hear the cries of the families of the devotees who were brutally killed in Jammu and Kashmir,” he said in a post in Hindi on X.
There have been three separate terror incidents in the last three days in Reasi, Kathua and Doda in Jammu and Kashmir, “but the Prime Minister is still busy celebrating,” he said.
Congress leader and in-charge of media and publicity department Pawan Khera also questioned the silence of Prime Minister Modi on the matter, claiming he has time to respond to Pakistani leaders, but no time to condemn the brutal terror attacks.
“BJP’s loudmouth chest-thumping and hollow claims of return of peace and normalcy in Jammu and Kashmir have been thoroughly exposed. The fact that BJP did not even bother to fight elections in Kashmir valley is a testament to the fact that their ‘Naya Kashmir’ policy is an abject failure,” Khera said in a statement.
His remarks come amid a rise in terror incidents in the twin border districts of Rajouri and Poonch.
Khera claimed that in the past 10 years, “loud chest-thumping” by the Modi Government has made national security a “casualty.” While innocents suffer the consequences of cowardly terror attacks, business as usual continues, he said.
“Even as Narendra Modi and his NDA Government was swearing in, and heads of States were visiting the country, India suffered a horrific and gruesome terror attack in Reasi district of Jammu and Kashmir, where 9 precious lives were lost and at least 33 people were injured, when terrorist fired upon a bus filled with pilgrims from Shiv Khori Temple to Katra,” he said.
“Not even innocent children were spared. Did the victims not deserve a word of sympathy from the self-proclaimed ‘divine’ Prime Minister,” he asked.
Following that, the Congress leader said, another terror attack took place in Kathua, where one civilian was injured.
On June 11, he said, six security personnel and a civilian were injured in an encounter with terrorists at Chhatargalla in Doda district of Jammu region.
According to officials, terrorists opened fire on a joint checkpoint manned by the 4 Rashtriya Rifles and police in Chhatargala area along Bhaderwah-Pathankot.
“A spate of terror attacks has gripped Jammu and Kashmir in the past three days, whilst PM Modi is busy posting responses to congratulatory tweets by Pakistani leaders Nawaz Sharif and Pak PM Shahbaz Sharif. Why has he not spoken a single word on the dastardly terror attacks? Why has he maintained a stoic silence,” Khera asked.
“Is it not a fact that Pir Panjal Range of Rajouri and Poonch districts has now become a hotbed of cross-border terrorism in the past 2 years, as over 35 soldiers have been martyred, following terror attacks in these areas in the past two years, alone? And now terror has also spread to neighbouring Reasi district, which was considered relatively peaceful,” he said.
The Congress leader noted that at least 19 major terror attacks have taken place on security installations under the Modi Government, including on CRPF camps, Army camps, Air Force Station and Military Stations in Pulwama, Pampore, Uri, Pathankot, Gurdaspur, Amarnath Yatra attack, Sunjwan Army camp and Poonch terror attacks where scores of precious lives have been lost.
“Is it not true that Modi Government invited the rogue ISI to investigate the Pathankot attack in 2016,” he asked.
Is it not true that Modi Government endangered national security even as 2,262 terror attacks took place in J-K, in which 363 civilians died and 596 jawans were martyred, Khera added.–(PTI)

Rajouri/Jammu, Jun 13: An army personnel was killed and four others sustained injuries when their vehicle skidded off the road and rolled down into a gorge in Rajouri district of Jammu and Kashmir on Thursday, officials said.
The accident took place near Bhawani village near the Line of Control (LoC) in the Nowshera sector in the evening, they said.
Rescuers took the five soldiers travelling in the vehicle to a hospital where one of them was declared brought dead.–(PTI)

Jammu, June 13: Police have detained over 53 suspected persons in connection with the last weeks militant attack on yatra Bus following which the vehicle veered off the road and fell into deep gorge in Reasi district, resulting in death of 9 pilgrims and injuries to 41 others.
A senior police officer told GNS that 53 suspected people were detained for questioning in connection with the attack near Pouni area of the Reasi district on 9th June.
" The detentions were made following an intensive investigation led by the police at the Kanda Barakh area Police Station, Pouni," the senior officer said, adding, " Significant leads have been uncovered, aiding in the identification and capture of those who may potentially be involved in orchestrating the attack".
To ensure a comprehensive probe, he said, search operations have been expanded to encompass the far-flung areas of Arnas and Mahore.
"These operations aim to uncover further evidence and apprehend terrorists who may be hiding in these remote regions.
The law enforcement agencies are committed to bringing the perpetrators to justice and ensuring the safety and security of all residents and visitors in the area, the officer said.
Meanwhile, police urged the public to remain vigilant and report any suspicious activity to the authorities immediately, he added.(GNS)

Gvn...*CRPF bus catches fire in Ramban, occupants escape unhurt*
Ramban/Jammu, Jun 13: A CRPF bus on its way to Jammu from Srinagar caught fire due to a technical snag in Jammu and Kashmir's Ramban district. The occupants escaped unhurt, officials said on Thursday.
The bus, part of a Central Reserve Police Force (CRPF) convoy, caught fire near Battery Chashma on the Jammu-Srinagar National Highway in the afternoon, the officials said.
The fire was brought under control and no one was injured. The vehicle suffered some damage, they added.
Ramban SHO Vijay Kotwal said preliminary investigations suggested the fire was caused by a short circuit in the engine wiring.
"The CRPF personnel travelling in the bus are safe," he said.–(PTI)

Srinagar, Jun 13 : The School Education Department (SED) has said that the morning assemblies in the educational institutes shall begin with National Anthem as per the standard protocol.
According to the news agency—Kashmir News Observer (KNO), Principal Secretary to government for School Education Department, Alok Kumar said this in a circular issued regarding the guidelines for conduct of morning assemblies in schools.
“To kickstart a school day on a positive note and to instill a sense
of unity and discipline amongst students, the morning assemblies at the start of school day have proved to be an invaluable ritual of the schooling system,” it reads.
Kumar in a circular further said that the morning assemblies serve as platforms to nurture the values of moral integrity, shared community, and mental tranquility.
“However, it has been observed that such significant ritual ans tradition is not being carried out uniformly across various schools of JK UT,” it reads.
The Principal Secretary said that in order to maintain uniformity, it is impressed upon all the
stakeholders to conduct Morning Assemblies across the
respective schools as per the guidelines.
Morning Assembly shall be of 20 minutes duration and all students and teachers shall assemble at the designated area at the commencement of school schedule,” reads the guidelines.
It further states that the ”Morning Assembly shall begin with National Anthem as per standard protocol.”—(KNO)
