Kurang Blames Lack of New Constitution on Power Struggles between 6 and 9

Alhagie Mamadi Kurang,Former Executive Secretary at the Janneh Commission and member of PDOIS party, during an exclusive interview with Reality TV Gambia, spoke at length about the draft constitution, and genesis regarding his untimely resignation from the then Janneh commission. While highlighting plans in placed stage by PDOIS if they ascends to power.

He pointed out that UDP have the chance to changed the constitution in 2017, when they were the majority in Parliament but they do not for obvious reasons.

He argued that UDP members said they should go for draft constitution and spend more than 100 million on it when they actually have the numbers to amend certain clauses in the current constitution.

Stating his opinion about President Barrow, Kurang said he (Barrow) should step down for political reasons to put the country on track and further ensured the current economic situation is resolved.

He said, President Barrow came with 2024 draft knowing that it will be very difficult for the people to cope with it ,the 1997 and 2020 together with the 2024 draft constitution favours Barrow’s gov’t as it gave him the powers as a sitting president .

Alhagie Mamadi Kurang submitted that “the reason why [we] do not have a third republic is simply because of power struggle between the NPP and UDP.”

He added that: “the executive power [is] control by two political parties that is UDP and NPP if they settle their differences Gambians will have a new constitution” .

“However, the reason why they remove me from my position is simply because the government failed to published the assets of former President Jammeh stuffs together with people who bought them and the amount they where bought which he Kurang wrote about which did not go down well with the people close to power that trigger his resignation” he charged.

Iman Ba Kawsu Fofana Continues his Advocacy on FGM/C

Appearing in an exclusive interview on Reality TV Gambia on the program called Know Your Scholars on August 18th 2024, Iman Fofana continues to maintain his stand that FGM/C is Islamic.

Female Ge***al Mutilation/Cutting according to the Women Amendment Act 2015 and other international organizations is harmful to women and girls, therefore, has been ban in the country.

However, the Islamic Scholars go with the belief that the practice is religious. It could be recalled that few months ago the National Assembly voted against the repeal of the Bill that sought to left the ban on FGM/C.

Despite their ruling that the practice has no religious basis a submission that the Independent Permanent Human Rights Commission (IPHRC) of The Organization of Islamic Cooperation (OIC), with other Islamic Scholars also stand on.

Iman Fofana stills carries the belief that the practice is religious arguing that at the time of the Prophet Muhammad (S.A.W) both children and elders were practicing FGM/C, moreover, he said the Prophet told his people when they are exercising the practice they should only cut small.

In his view, the tribes that do not practice FGM/C are the ones that normally said the practice is a tradition not religious .

Iman Ba Kawsu continued his argument highlighting that "what I want to said to the government is that FGM is both traditional and religious if the government said they will infuse law in every situation certain things won’t be possible, am pleading with them not to emphasize much on FGM we are all one, people that are still into FGM let them practice it in secret and those who do not want to practice it let them leave".

He emphasized that president Barrow should be a flexible ruler and also follow the rules and regulations of the country he concluded.

Presidential Term Limit: A Crisis in the Making.

Gambians must brace themselves for a future crisis if this Cabinet-drafted constitution passes with its current text on presidential term limits. In Section 5 of Schedule 5 on ‘Transitional and Consequential Provisions’ the Cabinet has provided this text on the ‘Term of Office of Incumbent President’,

“The person duly elected President of The Gambia prior to the effective date and serving in office as at the effective date shall be the first President of the Third Republic of The Gambia and shall continue to hold the Office of President in accordance with the provisions of this Constitution.”

Of course, it is basic knowledge that the president in power at the start of the Third Republic will be its first president. But when does the presidential term limit itself begin exactly? The provision did not say that thereby making it the cause of a future political turmoil in this country. The provision is totally meaningless yet severely controversial.

Does the term limit begin during the term in which the constitution comes into force (suppose that is before 2026) or does the term limit start after the current term (i.e., 2021 – 2026). In other words, if the constitution is approved in a referendum in 2025 does that mean Pres. Barrow, who was re-elected in 2021 will be serving his first term up to 2026 or that his first term would instead start at 2026? That is what the draft should establish but woefully failed to do so.

With this provision, it is effectively opening the gates to any kind of interpretation. That is, if the constitution comes into force before 2026, will Pres. Barrow be able to stand in the 2026 elections or will 2026 be the end of his two terms given that he was elected in 2017. Otherwise, will he say his first term 2017 – 2021 does not count, and even 2021 to 2026 would also not count because that was when the new constitution came into force? Will this therefore mean Barrow will claim that his first term should start in 2026, which also makes him eligible to stand in 2031 for his second term? If he wins all these elections, it means he will have served 20 years as President just like Jammeh!

Already the Minister of Information Ismaila Ceesay and presidential advisor Saihou Mballow have said that Barrow’s first term started in 2021, and not in 2017. They said 2017 – 2021 was not to be counted as Barrow’s first term because that was the term of the coalition government. Judging from this narrative, it appears the drafters of this Cabinet draft constitution are eyeing 2026 to be the start of Barrow’s first term after already serving for 10 years in office.

Therefore, they have cunningly crafted the above provision thereby playing a dangerous game of interpretation on Gambians which may end up at the Supreme Court hopefully to rule in Barrow’s favour. This game has not started with the Gambia but has been the story around West Africa for a while.

History recalls when Senegal’s former Pres. Wade sought a third term in 2012 amidst deadly riots across Dakar. Wade was first elected in 2000 and re-elected in 2007. In 2008 he conducted a constitutional referendum to reduce the presidential term from seven to five years. Because of that referendum, Wade said therefore he was eligible to stand in the 2012 elections because the new constitution had reset his tenure. Amidst the chaos he ran to the constitutional court of Senegal which approved his candidacy for a third term.

Next it was Macky who was first elected in 2012 after defeating Wade, and then re-elected in 2019. In 2016, Macky also triggered a constitutional referendum. Since then, he insisted that his first term under the old constitution should not be counted. Unfortunately for him, unlike Wade there was a strong political movement, PASTEF, with strong leaders which mobilized the masses in unending protests. After attempting every means to silence Senegalese people unsuccessfully, Macky was forced to concede in July 2023 not to seek a third term in March 2024. Because of him tens of Senegalese were killed and millions destroyed.

The same scenario unfolded also in Côte d’Ivoire where Pres. Alassane Ouattara was first elected in 2010 and then re-elected in 2015. In 2016, he carried a constitutional referendum which got approved and immediately said his first term does not count because the constitution came into effect in 2016. He also went to the supreme court which ruled in his favour that the new constitution in 2016 had reset his presidency.

We saw another attempt in Guinea where former Pres. Alpha Conde sought a third term by manipulating a constitutional referendum in 2020. Conde was first elected in 2010, and again in 2015. Like Wade, Sall and Ouattara before him, Conde also claimed his first term under the old constitution did not count as the 2020 referendum had reset everything anew. Once again, he went to the constitutional council which ruled in his favour. Unfortunately for him, after winning the 2020 election for his third term, in September 2021 the military overthrew him.

In Senegal, Guinea, and Côte d’Ivoire like similar places across Africa, incumbents have used referendums and new constitutions to entrench themselves in power. As a result, they cause massive bloody protests and deadly riots in which hundreds of lives would be lost while millions of damages in properties thereby further exacerbating insecurity, polarization, corruption, and poverty in their countries.

Is this what we are going to face in the Gambia too thanks to this Cabinet constitution? Another political impasse after having gone through one terrible experience in 2016/17 when Tinpot Dictator Jammeh refused to hand over power.

I hereby alert NAMs and indeed all citizens to this extremely dangerous provision which must be re-written to bring definite clarity that the presidential term should begin in 2017. The Year 2017 was the end of the dictatorship and the beginning of the hard-fought and hard-earned liberation of the people for democracy. This Cabinet constitution is intended to entrench self-perpetuation in power which must be rejected. No Gambian should serve as president for more than 10 years.

On Friday 16th August marks another archivement for the Mayor of Banjul Rohey Malick Lowe.

The Honourable Mayor of Banjul received the African Woman of the Year 2024 Award in Nairobi, Kenya.

In her words she noted that she accept the recognition on behalf of the people of Banjul in particular and The Gambia in general.

Jammeh’s Alleged Death Squad Member to be Prosecuted Next Month

Alleged Gambian hit- squad member, Micheal Correa will stand trial in September 2024 for alleged torturing in The Gambia in 2006. He is accused of being part of the “Junglers,” a death squad that committed human rights abuses on the orders of former President Yahya Jammeh.

However In 2020 ,the US department of justice charged Correa with torture and conspiracy to commit torture of at least six people. The indictment alleged that Correa and other junglers beat their victims, put plastic bags over their heads and used electric shocks during they interrogations , causing victims severe pain and sufferings.

Correa was first arrested in September 2019 for overstaying his visa in the U.S and had been under detention since then. In June 2020, he was indicted for torture and conspiracy to commit torture. He continued to remain in prison while awaiting his faith in court.

Noting that Correa’s trial will take place in the U.S. District Court of Colorado in Denver, where he (Correa) was initially found and arrested.Lawyers for the prosecution and defense will present evidence and arguments before Juries during the trial. The prosecution might ask victims to testify at the trial. After hearing the evidence, the
Jury will decide whether it found Correa guilty of each of charges or not.

In addition, under U.S. law, criminal defendants such as Correa cannot be forced to testify. While he is not required to testify, he can choose to testify in his own defense, if he does so he can be cross-examined by the prosecution.

Noting that if the accused is found guilty, the court will schedule a sentencing hearing, where a judge will decide his punishment.

Correa could receive a maximum sentence of 20 years imprisonment for each count of torture and
conspiracy to commit torture. If he is found guilty of all charges pressed against him,he
could face a total of up to 140 years in prison.

The TRRC’s final report concluded that Jammeh and 69 others who are believed to be his alleged associates committed crimes against humanity and recommended that they should face justice for their crimes. Correa is among the first of these individuals to face prosecution. His prosecution may allow victims to speak out about Correa’s alleged crimes and will raise awareness of the human rights violations that took place during the Jammeh’s regime.

Subsequently the trial is scheduled to take place between September 16 to 27, 2024. While criminal trials in the U.S. are typically open to the public, a judge may grant a request to restrict public access under exceptional circumstances to protect the safety of a witness.

PRESS RELEASE:
The Gambia Armed Forces wishes to inform the general public about the arrest of ex-Brigadier General Bora Colley, a former senior officer of GAF and an alleged member of the 'Junglers' who escaped the jurisdiction following the departure of the former President, Yahya Jammeh to Equatorial Guinea in January 2017.

Ex-General Colley was arrested on Friday 9 August 2024 around midnight when he voluntarily surrendered himself to the GAF Military Police in Yundum Barracks.

It might interest the public to know that surveillance was mounted by GAF intelligence operatives, acting on information, around his residence within the Greater Banjul Area the same day. Meanwhile, the senior officer is currently detained and cooperating with the Military Police in their investigations.

Further information on how the ex- General entered into the country and for how long he has been in The Gambia, among other issues, will be shared with the public in due course.

Cham Claims UDP Can Never Wins Against Barrow: Reminds Darboe of his words to President

The National People's Party (NPP) National Campaign Manager has reminded opposition United Democratic Party (UDP) Leader, Hon. Ousman Darboe of his advices to Barrow to stay to power despite the three years agreement of the coalition.

Mr Cham made these remarks during an interview with this medium at Statehouse on Wednesday, 7th August 2024.

Speaking to Reality TV Gambia, the Campaign Manager of the National People's Party (NPP), Mr. Lamin Cham cited that Hon. Ousainou Darboe has once advised the President that 3 years is not in the country’s law that every president should maintain the presidency for 5 years.

He added that President Barrow will contest in the next presidential election because the law did not opposed his third term bid.

President Adama Barrow came to power in 2017 after winning against former President Yaya Jammeh.

Mr Cham argued that President Barrow will win the upcoming presidential election which is slated for 2026.

Cham insisted that UDP will not win against Barrow at the polls, adding that the presidential election is different from any other election as there are people who only participate in presidential election but when it comes to other elections they will not vote.

He said the ruling party is different from the opposition parties and their responsibilities is far beyond the opposition party. While adding that some opposition parties base their campaign on things that are not factual.

The NPP and UDP have being at loggerheads over the years after Hon Ousman Darboe’s unexpectedly sacking as the Vice President of The Gambia.

Recently while speaking at the launch of the new NPP bereau in Brikama President Barrow swear that he "will be president until Ousainou Darboe dies. That’s the only time I will leave power. But so long he is not dead, I will be president. I will leave only when he dies and we bury him that I will quit as president."

After his statement several individuals including politicians took to social media to condemn his remark where some demanded apologize and withdrawal of statement.

However, the NPP Campaign Manager Mr Cham asserted that president Adama Barrow doesn’t mean that Ousainou Darboe should die, rather spoke in a common language which is a saying among our tribes.

Mr. Cham explained that UDP party leader Ousainou Darboe was the one who first make a statement that he will take President Barrow’s allocated land that’s the reason why the President said he will die but will never see that happened.

My fellow citizens, I greet you all in the most revered way, Asalamu Alaikum Warahmatullahi Ta Ala Wabatakatuhu. Today, I speak to you in my capacity as the Mayor of Banjul, as a mother, as a sister and as a friend. But most importantly, as a Gambian.

I listened to the president's statement in Brikama last night with shock, disappointment and concern. It is my strong conviction that the president's statement against H.E Ousainou Darboe, is unfortunate, untimely and unpresidential. H.E Daboe's contribution to the advancement of Gambia's democracy is unquestionable. He has dedicated his entire life to serving this nation.

In this country, we live as one people. And this we must continue to nurture. We must never allow politics to divide us such that we would wish death upon each other. As political leaders, it is important to always be mindful of statements we make especially at public gatherings. For if there were to be chaos, women, children, the elderly and persons with disabilities who are the most vulnerable would suffer more. And as leaders we must never allow to create situations where we make their lives uncomfortable.

Therefore, I would implore on the president to withdraw his statement and apologize to H.E Darboe and the Gambian people for his unfortunate statement. I wish to also seize this opportunity, to encourage us all to continue to promote peace and avoid making such divisive statements. I pray that peace continues to reign in our dear country.

RELEGATION BATTLE: BRIKAMA UTD JUMPS OUT, BOMBADA DROPS, WAA BANJUL AND WALLIDAN STILL IN DANGER AFTER DROPPING POINTS.

Brikama Utd have jumped ship and are already out of the relegation battle after a hard fought 2-1 victory over BST Galaxy at the Basori Mini Stadium last evening.

Coach ModouLamin Touray(Katongo) and his Brikama Utd going into BST Galaxy game, were battling for their lives but jumped ship thanks to goals from captain (Sainey Bojang) and Lamin Jatta to record a 2-1 victory over BST Galaxy.

The victory for Brikama Utd has now propelled them away from relegation and sit on 10th with 35 points on the GFF Men's Division1 table standing.

Elsewhere, at the Boxba Mini Stadium, Bombada FC recorded a humiliating 3-1 defeat in the hands of Marimoo PakFood at a quiet Boxba Mini Stadium yesterday.

Marimoo PakFood got their goals through Ousman Joof and Amadou Jatta in the first half before Ebrima Bah pulled one back for Bombada in the second half.

Team captain(Modou Manneh) added the third to add mystery to Bombada's quest of saving themselves from relegation.

Manneh's third goal was enough to record an empathic 3-1 victory for Marimoo PakFood over Bombada FC at the Boxba Mini Stadium.

With a defeat for Bombada has now dropped to 14th on the table standing on 32 points, which means they have to defeat Samger in their last fixture and expect other results to favor them to be totally safe from relegation.

Wallidan who are not also safe from relegation played out a nail-biting 0.0 scoreline against second place(Falcons FC) at the Bakau Mini Stadium.
The draw has also maintained a relegation battle for Wallidan as they sit on 13th with 32 points on the table standing.

Relegation threatening WAA Banjul side also played out a 1-1 scoreline against TMT FC at the Late Ousman Saho Football Field and the scoreline has left WAA Banjul languishing at the relegation zone on 15th only above Sanger who are already relegated.

Who is safe and who isn't remains the biggest task and question as the battle for survival in the GFF Men's Division1 moves to the final day.

Yes, I have tendered my resignation as chairman of the Victims’ Center since 12th June, 2024, which was prompted purely by personal reasons and nothing to do with any grievances against anyone or anything in particular.
When I was unanimously elected as chair in September 2023, I had my own pre-conceived ideas about how I intended to carry out my functions. However, as time went on, it dawned on me that the situation on the ground was not the same as I had anticipated and no matter how hard I had tried, I was not able to fit in the existing equation. Therefore, I thought it was only fair that I stepped down to give chance to someone else to take over and probably steer the Center to safer waters.
I wish to take this opportunity to thank the staff of the secretariat and also wish the Center and all its stakeholders, including the victims, success in their future endeavours and to assure them of my cooperation at all times.
