Egypt submits a memorandum to the International Court of justice on Israel's practices in the Palestinian Territories

Amid the ongoing war in Gaza, and amid Egyptian fears of an invasion of the Palestinian city of Rafah, the announcement by the Egyptian authorities to submit a memorandum to the International Court of justice on Israeli practices in the Palestinian Territories raised questions about its legal feasibility and political significance .

Dia Rashwan, head of the Egyptian General Information Authority, said that Cairo will participate in the advisory opinion requested by the UN General Assembly from the International Court of justice on Israeli policies and practices in the Occupied Palestinian territories since 1967, noting that Egypt has submitted a memorandum to the court, and will present an oral argument before it on February 21.
The upcoming hearings come in response to a request submitted by the UN General Assembly in December 2022 to obtain an advisory opinion from the court on the legal consequences of Israel's policies and practices in the Palestinian territory.
It is expected that the oral argument sessions for obtaining the advisory opinion will last from February 19 to 26 of the same month, with the participation of 52 States and 3 international organizations.
Egypt's presence and its case represent pressure to obtain a positive advisory opinion on what it has requested regarding the fact that the Israeli presence in the West Bank is illegal and contrary to international law, as Israeli practices amount to crimes of apartheid.
Although these hearings are separate from the South African case, a ruling in favor of the Palestinians will have a political impact, despite being a non-binding advisory decision, as it further deteriorates Israel's image internationally, and may put an end to the Western world's perception and support for Israel.
The chairman of the Egyptian General Information Authority said that the oral argument includes confirming the jurisdiction of the International Court of justice to consider the advisory opinion, as the UN General Assembly is one of the organs authorized in accordance with the Charter of the organization to request an advisory opinion from the court, and given that the matter deals with the legal dimensions of illegal Israeli settlements in the Occupied Palestinian Territories, contrary to the principles of international law and resolutions of international legitimacy.
The UN resolution also asked the International Court of justice to provide advice on how these policies and practices affect the legal status of the occupation, and what legal consequences this situation has for all states and the UN.

A US proposal for a temporary ceasefire in Gaza

The airstrikes continued throughout the night in the vicinity of the European Hospital in the south-east of Khan Younis with the aim of putting the hospital out of Service, and the siege continued on Al-Amal Hospital, the Palestine Red Crescent Society and Nasser Hospital, and most of the services and operations were disrupted.

For his part, the spokesman of the United Nations Office for the Coordination of Humanitarian Affairs (OCHA), Jens Laerke, expressed deep concern about the explosion of the situation in light of the worsening "despair" in Rafah, while Israeli Defense Minister Yoav Gallant warned Thursday that the army, which began its military operation in the northern Gaza Strip and gradually advanced towards the South, will also reach Rafah.
