*Khayah Cement Limited Initiates Corporate Rescue Amid Financial Struggles*

Khayah Cement Limited has voluntarily entered corporate rescue proceedings under the Insolvency Act [Chapter 6:07] to address its financial challenges and pave the way for a sustainable recovery.

The decision comes after a series of operational and financial setbacks, including significant equipment breakdowns, rising production costs, and market pressures. The company’s kiln, crucial for producing cost-effective clinker, was mothballed in 2023, leading to reliance on more expensive imported clinker.

These challenges, coupled with trade restrictions affecting key consortium members and the influx of cheaper imported cement following a government policy change in 2024, hampered the company’s ability to compete and meet creditor obligations.

Despite these hurdles, Khayah Cement has shown resilience, with promising growth in volumes and revenues driven by cost-containment measures, improved product quality, and strong market demand. The board believes that recommissioning the kiln, expected in the first half of 2025, will significantly reduce production costs and enhance profitability. With valuable assets, including land, equipment, and industry expertise, the company is optimistic about its prospects for recovery. The corporate rescue process will allow Khayah Cement to restructure its operations, protect assets, and restore financial stability while continuing to provide quality cement to the market.

Zimbabwe Abolishes Death Penalty Through Historic Legislation
January 1, 2025 News

Zimbabwe has officially abolished the death penalty following the enactment of the Death Penalty Abolition Act [Chapter 9:26], marking a significant milestone in the country’s justice system.

The law, signed by President ED Mnangagwa after being passed by Parliament, prohibits courts from imposing the death sentence for any crime, regardless of when it was committed. Instead, judges are now required to impose alternative punishments deemed appropriate for each case.

The act also mandates the Supreme Court to review and overturn all death sentences previously imposed, replacing them with alternative sentences.

Furthermore, it ensures that no ex*****on, irrespective of when the sentence was issued, will be carried out in the future.

This legislative shift comes with amendments to critical legal statutes, including the Criminal Procedure and Evidence Act [Chapter 9:07], the Genocide Act [Chapter 9:20], the Criminal Law (Codification and Reform) Act [Chapter 9:23], and the Geneva Conventions Act [Chapter 11:06].

The abolition of the death penalty aligns Zimbabwe with international human rights trends, as more nations move away from capital punishment.

Justice advocates have lauded the move as a bold and progressive step towards protecting human dignity.

However, critics have raised concerns about whether alternative sentencing will adequately deter heinous crimes.

With this landmark decision, Zimbabwe takes a definitive stance on the global stage, reinforcing its commitment to human rights while igniting debate on the role of retributive justice in modern society.

GABORONE – Botswana’s newly elected President, Duma Boko, has proposed formalizing the status of undocumented Zimbabwean workers, recognizing their significant contributions to Botswana’s economy while also addressing rising tensions caused by their undocumented status.

Speaking on the BBC Africa Daily podcast, President Boko highlighted the crucial role many Zimbabweans play in industries where local interest is limited, particularly in construction and other essential jobs
“Many Zimbabweans are already here, doing jobs that would otherwise not get done,” President Boko stated.

However, he pointed out that because many are undocumented, their access to essential amenities is often limited, forcing them to live “outside the law,” which has led to increased resentment within the community.

President Boko proposed a “twin programme” approach, allowing Zimbabweans with valuable skills to work in Botswana legally, while also initiating skills transfer programs to benefit Botswana’s local workforce. He stressed the importance of integrating these workers properly, saying,

“In any and every construction site in Botswana, the majority of people with those skills are from Zimbabwe, so we need to do a twin programme of allowing them to come in, utilize the skills they have, and in the process of utilizing these skills, engage in some sort of skills transfer.

”Acknowledging Botswana’s pressing unemployment rate – currently nearing 30% of the 2.4 milli

A Letter to Harare Residents
November 8, 2024 News

The City of Harare has finally come under scrutiny from across the political spectrum for its undeniable incompetence. No longer can the council hide behind claims of ZANU PF interference, as even staunch opposition supporters have started to question the performance of the Citizens Coalition for Change (CCC)-led City Council. Prominent opposition figures, including Brian Rupiya, William Madzimbamuto, and Kuda ‘Begottenson’ Musasiwa, have voiced their concerns about the CCC-run council’s failure to perform basic functions, such as clearing the streets of rubbish. The once-proud Sunshine City has become a shadow of its former self, with litter piling up in every corner.

The time has come for Harare residents to rise up and demand accountability from the Mayor Mafume-led council. Legal action and civil protests may be necessary to compel the council to fulfill its duties. A boycott of rate payments could send a strong message that residents will no longer pay for services that the council fails to deliver. The council’s excuse of lacking arresting powers to deal with littering is baffling, considering that it exercises those same powers to clamp vehicles and confiscate vendors’ goods. This selective enforcement is both inconsistent and frustrating for residents.

Harare residents need to abandon the habit of

*CCC Council Must Shape Up, or Ship Out!*

Former Citizens Coalition for Change (CCC) City of Harare Deputy Mayor Kudzai Kadzombe has recently highlighted the inefficiencies of the Harare City Council (HCC), attributing its failure to collect garbage to the lack of arresting powers for municipal police. In a statement on X, Kadzombe argued that the absence of these powers hinders enforcement, expressing frustration over the Attorney General’s prolonged delay in approving by-law amendments requested 15 years ago. The streets of Harare, once known as the “sunshine city,” are now plagued by mounds of uncollected trash, a situation the former Deputy Mayor attributes to these enforcement constraints.

However, blaming the lack of arresting powers for Harare’s waste management crisis is an inadequate explanation. Critics argue that municipal police seem to find no difficulty in enforcing laws when chasing commuter omnibuses, collecting bribes, or confiscating wares from vendors—yet seem ineffective against littering violations. The council’s selective enforcement has led many to question its true commitment to maintaining a clean and organized city.

The issue extends beyond arresting powers, as HCC has demonstrated an ability to enforce regulations when it suits them. With the council already collecting rates from residents and businesses, its continued failure to provide regular garbage collection services is indefensible. Business owners are often left with no choice but to dump their refuse in the city, exacerbating the litter problem. Furthermore, the lack of accessible rubbish bins across the Central Business District (CBD) encourages

Bribery Scandal Exposes Systemic Loopholes in Zimbabwe’s Traffic Law Enforcement Amidst Rising Road Carnage
November 4, 2024 News

Zimbabwe is grappling with a devastating surge in road carnage, prompting government officials to implement various policies aimed at improving road safety. Despite these efforts, the effectiveness of such measures is being undermined by rampant corruption within the traffic enforcement system. The recent arrest of two police officers—Sergeant Chifamba and Constable Gunzva—at the Mabvuku turnoff along the Harare-Mutare Road, serves as a stark reminder of how deeply entrenched bribery has become, allowing public transport operators to operate with alarming impunity.

These officers were caught accepting bribes from commuter taxis and public transport vehicles, a practice that has emboldened drivers to flout traffic laws with little fear of consequences. Overloading, reckless driving, and illegal ranking have become common, contributing significantly to a rise in accidents and loss of life on Zimbabwe’s roads. The government’s attempts to reform and strengthen policies aimed at ensuring road safety are rendered ineffective when enforcement agencies are compromised.

Zimbabwe has witnessed numerous tragic incidents where lives have been lost due to preventable road accidents. These incidents highlight a critical issue: the current enforcement system is failing to uphold the very laws designed to protect citizens. The bribes that t

*ZRP in a Policy Move to Curb Corruption at Roadblocks and Traffic Spot Checks*

Recent actions by police officers at roadblocks and traffic checkpoints have raised public concerns over potential corruption within the Zimbabwe Republic Police (ZRP). Observations of officers engaging in conversations with motorists out of passengers' sight or hearing, as well as physical interactions like handshakes, have created a negative perception of the ZRP. These behaviors are often associated with corrupt practices, casting doubt on the force's integrity.

In response, the ZRP’s Operations Department has crafted a policy aimed at curbing any actions that might damage the organization’s image. This policy outlines strict guidelines that officers must follow to prevent any appearance of corruption or unethical behavior during roadblock operations. The key measures include prohibiting the collection of fines at roadblocks; all fines must be paid at police stations. Motorists who commit traffic offenses will be issued Form 265, requiring them to settle fines at a police station within seven days.

Additionally, the policy states that officers found disregarding these protocols will be subject to disciplinary action in line with the Police Act [Chapter 11:10]. Officers responsible for managing roadblocks must ensure compliance with the Police Duties and Investigations Manual, the Coin Manual, Circular 12 of 2005, and this circular during all traffic-related operations. Prior to deployment, officers are also required to declare any cash, cell phones, or valuables they carry, which are to be documented in the Dec
