YOUTHS SENTENCED TO LIFE FOR BURNING TO DEATH WOMEN THEY ACCUSED OF WITCHCRAFT

The High Court of South, Eastern Cape Division, Mthatha, sitting in Ntabankulu, sentenced Lwandiso Mzaza (29), Lufefe Mzaza (28), Zithini Rhayisa (34), Yamkela Nonjojo (31), Odwa Nonjojo (34), Anelisiwe Nonjojo (32) and Mkhonzeni Ngcabangcosi (24) to life imprisonment. The court found them guilty of two counts of murder and arson for which they were sentenced to two life terms and ten years, respectively, ordered to run concurrently. The Mzazas and Nonjojo’s are biological brothers while all the convicted persons are from the Ngonyama Administrative Area in the district of EmaXesibeni (formerly Mount Ayliff), where the crimes were committed.

On 12 December 2018, the group of young people had two meetings that were chaired by the older Mzaza brother, Lwandiso, where it was decided that the deceased must be killed by burning them because they were practising witchcraft. They clubbed money and bought petrol to burn the deceased, their houses, and their families. On the night of the same day, Nothethisa Ntshamba was at her home with her husband, three children and her sister Ntombekhaya Ndlanya. When Nothethisa went out of the house, accompanying her sister home, they were accosted by the group, assaulted, pelted with stones, petrol poured on them and then set alight. The group then proceeded to burn the Ntshamba homestead to ashes.

During the trial, all the accused pleaded not guilty and put into question their identity as they claimed it was at night. Rhayisa, who had confessed to the police attempted to distance herself from it, necessitating a trial-within-a-trial. The court found the confession admissible. The state further led the evidence of the eyewitnesses, some being the children of the deceased.

Senior State Advocate Mbulelo Nyendwa submitted to the court that violence against women accused of unfounded claims of practising witchcraft was very prevalent not only in the Eastern Cape but in the country at large. He added that the children of the deceased had not only lost their mothers but had been displaced, fearing for their lives and still carrying the stigma of being called the children of witches by some members of the community. Judge Nozuko Mjali agreed and noted that no self-respecting state can condone what the accused did, and they deserved to be punished severely punished, as a society must be protected from people who do not respect the law. “This court alone has lost count of cases of this nature in this Ntabankulu circuit alone,” she remarked

COMPANY DIRECTOR AND HIS BUSINESS ENTITY ARRESTED FOR ALLEGATIONS OF TENDER FRAUD

EASTERN CAPE: Mthatha based Serious Commercial Crime Investigation (SCCI) of the Hawks arrested Nceba Ntlokwana (43) and his business entity, Squad Five Productions CC on 26 June 2024 for charges of fraud, forgery and uttering.

It is alleged that in January 2020, the Eastern Cape Department of Human Settlement (ECDHS) advertised a tender for the appointment of a service provider to supply and erect 292 temporary shelters in the OR Tambo region. Among the pre-qualifications of the specification when the tender was advertised was that the prospective service provider must have a business in the OR Tambo region and also previous experience in similar projects. At the close of bids, eight (8) tender documents were reportedly received by the department with Squad Five Production CC included.

Ntlokwana, the director of Squad Five Production, allegedly submitted a tender document with a proof of business address in Mthatha, OR Tambo region and a certificate of completion of works issued by eThekwini Metropolitan Municipality. Based on the documentation submitted, both the Bid Adjudication Committee (BAC)and the Bid Evaluation Committee (BEC) recommended and subsequently awarded the tender to the amount of more than R18.3 million to Squad Five Production CC.

The report further says, during the supply and er****on period, a whistle was blown about the irregular awarding of a tender which led to the investigation by the Hawks. The investigation revealed that the proof of business address on the lease agreement and the certificate of completion of work were indeed fraudulent. The owner of the property reportedly had no knowledge of the lease agreement and the eThekwini Metropolitan Municipality rejected the certificate of completion of work. At the time of whistle blowing, the department was already prejudiced more than R6 million.

On 26 June 2024, Ntlokwana and his company were arrested by the Hawks and made a short appearance before Mthatha Specialised Commercial Crime Court where they were released on R10 000 bail. The matter is remanded to 27 August 2024 for docket contents.

It is believed that the acting Provincial Head Brigadier Fernando Luis gave a thumbs up to the investigating team for their swiftness in finalising the investigation for the perpetrator to face Lady Justice sooner than expected.

President Cyril Ramaphosa will visit Gqeberha in the Eastern Cape tomorrow, Friday, 7 June 2024, to assess the response by government departments and entities as well as civil society groupings to floods that have resulted in the loss of life and destruction of public infrastructure and private property.

Severe weather conditions have impacted on the Eastern Cape, KwaZulu-Natal, Western Cape and Free State in recent days, with loss of life, disappearance of resident and loss of public infrastructure and private property reported extensively.

Officials of the National Disaster Management Centre have been deployed to the affected areas and national, provincial and local departments and agencies - including the Department of Cooperative Governance and Traditional Affairs, the Department of Home Affairs, The National Department of Transport, the Department of Basic Education, the Department of Human Settlements and the South African Social Security Agency – are attending to challenges faced by communities.

More departments and entities will join this efforts as needs are identified.

Government is working alongside non-governmental organisations and humanitarian agencies such as the South African Red Cross Society, Gift of the Givers and others to bring relief.

President Ramaphosa said: “Even though we know winter can be harsh, we are nonetheless saddened when we lose loved ones and face devastation on the scale we have seen in the Western Cape, Eastern Cape and KwaZulu-Natal.

“At this difficult time, national and provincial authorities as well as civic organisations are working tirelessly to assist the affected communities with much-needed, immediate psychosocial support and humanitarian relief.

“This relief is the first step on the demanding journey of rebuilding lives, homes, businesses and public infrastructure after events of this nature.

“Government will do its best to ensure that the recovery process meets the needs of residents and enables a renewal of the affected areas.”

MAN SENTENCED TO THREE LIFE TERMS FOR R**E AND MURDER

The High Court of South Africa, Eastern Cape Division, Mthatha, sentenced Bongani Zini (28), to three life imprisonment for r**e, compelled r**e and murder of an 18-year-old woman. The court further sentenced Zini to 15 months for assault with intent to cause grievous bodily harm he committed against a male companion of the deceased r**e victim. The incident happened on just after midnight of 01 January 2023, during New Year’s celebrations at Ntsundwana village in the district of Ngqeleni.

On the fateful night, the young woman was in the company of her sisters at local tavern. While walking home, she was left behind with a male schoolmate when they were accosted by three men. One of the men attacked the woman and her companion with a knife, demanding that they handover their cell phones. He stabbed the male schoolmate who then fled for his life. The man then instructed his two friends to drag the woman to a dark place where he forced one of them to stand guard, and the other to r**e the woman before his turn his r**ed her. When the woman, who knew her attackers, asked, “Bongani why are you doing this to me?”, he stabbed her multiple times on her chest, and they left her for dead. Police found Zini’s wallet next to the lifeless body of the victim, which led to his arrest. Subsequently, he abandoned his bail application after community members torched his home.

During trial, State Advocate Thabo Dease led the evidence of Zini’s two companions, who were 18 years old during the incident. They told the court that they cooperated with him out of fear because he was a known dangerous character in their village. In his defence Zini mounted a bare denial, but under cross-examination he changed his tune and claimed an alibi that was rejected by the court. In aggravation sentence, Advocate Dease prayed for the court to impose the harshest sentence because the offences were brutal, brazen and with no regard for the young female, adding that femicide is very prevalent not only in the court’s jurisdiction but, nationally. Acting Judge Mpumelelo Notununu agreed with the prosecutor’s submission adding that the community expected the courts to deal with serious crimes harshly.

Eastern Cape Director of Public Prosecutions Barry Madolo commended the prosecutor, the investigating officer, and the witnesses, particularly the village headman who assisted in police investigations, ensuring that justice is served for the young woman and the community.

SERIAL RA**ST SENTENCED TO EIGHT LIFE TERMS PLUS 158 YEARS

The High Court of South Africa, Eastern Cape Division, Mthatha, sentenced Xolani Gcelu (34) to eight life imprisonment terms and additional 158 years for his four-year reign of ra**ng, kidnapping, robbery and attempted murder of young women between the ages of 17 and 26 years at the neighbouring villages of Sidwadweni and Zandukwana near the district of Tsolo. The court sentenced Gcelu to life for each of the nine counts of r**e, and sentences ranging between two years and 15 years for multiple charges of housebreaking with intent to commit an offence, kidnapping, common robbery, attempted murder, robbery with aggravating circumstances, assault with intent to commit grievous bodily harm, as well as compelled s*xual assault. The court ordered the culminative 158 years to run concurrently with the nine life terms.

Between March 2016 and June 2019, Gcelu targeted the young women who were either walking on their own at night or sleeping on their own and r**ed them, while fully aware that he had contracted HIV. His modus operandi was to threaten the women with a knife and take them to secluded areas or unfinished building structures where he would r**e and rob them of their belongings, including cell phones and cash. He was linked to all the r**e charges through DNA, as all the victims immediately reported their attacks and were thus, timely referred for medical attention.

Gcelu was arrested after he attacked two women. While threatening them with a knife, he r**ed them while forcing them to perform s*xual acts on one another. Even though they did not know Gcelu, they managed to describe him to their older brothers who traced and handed him to the police. During trial, he challenged the procedure followed when buccal samples were collected from him DNA comparison. He further claimed that he was in romantic relationships with five of the victims and had bought liquor for others in exchange for s*x. Under cross examination by the State Advocate, Loyiso M**huso, Gcelu contradicted himself. Advocate M**huso had earlier led the evidence of the victims, some of whom were assisted by the Court Preparation Officer (CPO), Nonkululeko Mcimbi. The Judge, Buyiswa Majiki found Gcelu to be an untruthful witness, and agreed that there were no substantial and compelling circumstances for deviating from the prescribed minimum sentence of life imprisonment terms for the r**es.

The Eastern Cape Director of Public Prosecutions, Barry Madolo commended the Investigating Officer, CPO and the prosecutor for the meticulous collection and presentation of evidence, noting that the sentence reaffirms the NPA’s commitment to the protection of women
