CITY COMMISSION CAVES ON ATLANTIC AVE HEIGHT RESTRICTIONS: In a closed attorney/client session yesterday, the City Commission discussed settling a lawsuit filed by two Atlantic Ave property owners who want to build taller than the three story cap allows on buildings along the busy downtown street.
After the closed discussion, the City Commission took a public vote 3-2 to lift the height restrictions on two buildings that house popular restaurants Tramonti and Cabana El Rey. Mayor Shelly Petrolia and Commissioner Bill Bathurst voted against lifting the height restrictions. Commissioners Shirley Johnson, Adam Frankel and Ryan Boylston voted to approve lifting of the height restrictions on the two properties.
In 2015, the previous City Commission voted to restrict height on Atlantic Avenue between Swinton Ave and the Intracoastal, to three stories "to help maintain the unique character as the City's historic main street." Section 4.4.13 (B) The new land development regulations were widely praised as a step in the right direction as Delray grappled with explosive growth that threatened to erode its charm.
How disappointing that two recently elected Commissioners, who pledged to champion "The Village by The Sea" on the campaign trail, failed to support the ordinance preserving our historic downtown.
