CLIP: Body-worn camera footage shows four men who were accused — and later acquitted — of possessing fi****ms on school property during a July 2023 school board meeting held at Gloucester’s T.C. Walker Education Center.

At the July 2024 trial, Defendants argued the Head Start program located at the building was closed for the summer, thus making the property not subject to Virginia’s school gun ban at the time the board meeting was held. Virginia law does not prohibit the carrying of fi****ms onto the premises of “child day centers” outside of operating hours.

This time-dependent exception also applies to private or religious preschools. Prosecutors, however, insisted that TCWEC houses a public preschool, where fi****ms would be prohibited 24/7/365 under state law.

A Gloucester County jury deliberated for just over an hour before acquitting all four men of the felony charge of possession of a firearm on school property.

One defendant, Trevor Herrin, was convicted of a misdemeanor for carrying a concealed handgun without a valid permit and sentenced to 30 days in jail, which was stayed pending appeal.

Less than a month after the acquittals, the Gloucester County School Board unanimously voted to designate the T.C. Walker Education Center a gun-free zone.

While digging through the crates, we found some evidence from the trial of Tre Von K. Price, who was the only person arrested after a Chesapeake police sergeant was grazed by gunfire on Seaboard Avenue on September 2, 2021.

A bench (non-jury) trial was held on July 25, 2023, and a Chesapeake Circuit Court judge found Price guilty of attempted malicious wounding, use of a firearm in the commission of a felony, shooting in a public place causing injury, and malicious shooting at an occupied vehicle.

On January 23, 2024, Price was sentenced to five active years in state prison (18 total with 13 suspended). Price is currently scheduled for release in May 2027.

Tony Garza, 59, of Houston, Texas was sentenced Thursday in downtown Suffolk to a ten-year active term in state prison, with an additional ten years suspended, along with an indefinite revocation of his operator's license.

We wanted to address why some videos and posts seem like they don’t have all the context for every incident — and also why you never see any Chesapeake Police Department pursuits on this page.

Regarding videos with abbreviated length — that’s because Virginia Beach Police Department is so secretive that we can only obtain videos filed in open court, and those are usually narrowly-tailored clips, not full AXON recordings.

Moreover, most eluding cases end with guilty pleas, without any video evidence placed into the public record, meaning all the AXON footage in those cases will stay secret forever (unless VBPD has a change of heart about transparency in the future — more on that below).

VBPD has a written policy requiring denial of any and all FOIA requests for any AXON footage that they aren’t explicitly forced to release under state law — even if the case was closed years ago. Yes, they really do have a written policy of absolute AXON video secrecy — if you doubt us, ask VBPD Deputy Chief William Zelms at (757) 385-8727 or [email protected].

Same bu****it with Chesapeake Police Department, only they won’t admit that they have such a policy in place.

As for written context, we recognize some videos lack contextual information and we will work to improve on that front — it has to do with the limited amount of time we have outside of our regular lives to obtain written court filings, because that can be quite time-consuming on top of all the time it takes to research, obtain, review, and process the videos.

Lamont Lyman Malone, 44, was sentenced on October 8, 2024 to serve one year and four months in prison for eluding police and being a felon in possession of a firearm after he drove recklessly on the interstate and city streets and crashed his car, in which he left behind a gun that he was not legally allowed to have.

On November 17, 2022, Malone was driving at a high rate of speed westbound on Interstate 64 and making unsafe lane changes. A Virginia State Police trooper pulled Malone over near the Granby Street exit, and Malone initially cooperated by providing his identification information to the trooper.

Mr. Malone claimed that he was en route to a hospital in Newport News to attend a childbirth and informed the trooper that he was on probation. The trooper ran Malone’s information and saw that Malone had outstanding warrants out of a different city. As the trooper was gathering this information at his patrol car, Malone drove off.

Mr. Malone continued driving off the interstate onto Granby Street, accelerated at a high rate of speed, passed multiple vehicles by driving off the road onto grassy areas, made multiple other unsafe lane changes, and ran a red light at the intersection with Bayview Boulevard.

The trooper initially pursued Mr. Malone, but he called off the pursuit due to high traffic and instead slowly canvassed the area. Soon after, the trooper saw Mr. Malone’s vehicle crashed into a tree in the median at the intersection of Granby Street and Dupre Avenue.

The driver’s door was open, and a witness told the trooper that Mr. Malone had taken off running. The trooper searched the abandoned vehicle and found a firearm in the center console. Mr. Malone has a history of felony convictions and is prohibited from possessing a firearm.

Mr. Malone entered an agreement on Oct. 8 to plead guilty to felony eluding and being a felon in possession of a firearm. The plea agreement called for Mr. Malone to serve one year and four months in prison and have another three years and eight months suspended conditioned on Mr. Malone completing two years of uniform good behavior. Norfolk Circuit Court Judge Jamilah D. LeCruise accepted Mr. Malone’s plea agreement and sentenced him per the agreement.

“Mr. Malone endangered himself, the trooper, and everyone around him by eluding the police, and Mr. Malone should never have been in possession of a gun,” said Commonwealth’s Attorney Ramin Fatehi.

“We will continue to hold accountable people who possess weapons illegally and who endanger the people around them,” Fatehi added.
