America's National Defense Remains Strong

While we ready ourselves for the end of another year with a new Congress on the horizon, make no mistake that there is still much work to be done. This week, the House voted to pass the Servicemember and Quality of Life Improvement and National Defense Authorization Act for Fiscal Year 2025 (FY25 NDAA). House Republicans continue to deliver on their promise to the American people to increase border security, bolster national defense, deter global adversaries, support Israel, and provide the support necessary to improve the lives of our servicemembers and their families.

It goes without saying that the men and women who put their lives on the line daily in order to protect our freedoms should never have to experience negative impacts due to a lack of resources provided to them by the military. We owe a debt of gratitude to each of our servicemembers, and I'm pleased that the FY25 NDAA will work to improve the quality of life for our servicemembers and their families.

These negative impacts are also affecting our military through low recruitment numbers, retention, and lack of military readiness. Through boosting compensation for junior enlisted servicemembers to better compete with the private sector, to improving and addressing housing issues like chronic underfunding and repairs, ensuring access to better medical care, and providing better support for their families, we will be setting up our service men and women for success.

The Fourth District and Arkansas were also the recipients of many wins in the NDAA's passage. The Natural State is proudly home to numerous facilities that directly impact the national defense industry. The FY25 NDAA will authorize full funding for joint US-Israel cooperative missile defense programs such as the Iron Dome, Arrow, and David's Sling – all big wins, specifically for East Camden.

Additionally, this bill authorizes $74 million for a military construction project located in Arkansas, expands programs to help Arkansas' 1,800 military spouses attain and retain employment, and provides greater access to childcare for the 2,900 children of military families across Arkansas.

As global adversaries continue to threaten democracy around the world, House Republicans are determined to bring the hammer down heavily upon our adversaries like China, Russia, and Iran, while continuing to provide aid to our ally in the Middle East – Israel. By severing all dependence on China from the semiconductor supply chain, maintaining the integrity of U.S. nuclear facilities, to cutting ties on any information exchange, the United States is taking back the power wrongfully and dangerously given to China which undermines our military's integrity and might.

This bicameral, bipartisan work will provide substantial investments in military modernization, counteract the deep impacts of inflation on our military, and deliver a well-deserved pay raise for our servicemembers and relief to their families. Our nation has a history of strong national defense, and House Republicans will continue holding the line to ensure that legacy holds fast for generations to come.

Did you know that there was a very distinct possibility that The Highwaymen might have never been called “The Highwaymen,” if it wasn’t for a young, scrappy mandolin/guitar player named Marty Stuart, The Highwaymen as a name and a song would likely have never happened. LITTLE ROCK – Arkansas won a long and hard-fought legal battle against large pharmaceutical manufacturers when the United States Supreme Court let stand a lower court ruling in the state’s favor.

The decision means that Act 1103 of 2021 is constitutional and remains in effect. “This is a big win for Arkansas’s drug access law,” the state Attorney General said in a statement after the Supreme Court ruling.

In essence, the Supreme Court upheld Arkansas law that allows hospitals to use contract pharmacies without financial penalty, under a federal drug pricing law commonly known as the 340B program. It requires pharmaceutical companies to offer discounts to eligible hospitals in order for their drugs to be on the approved list of drugs paid for by Medicaid and Medicare.

Some hospitals pass along the savings to patients, while others use the savings to pay physicians and nurses, or to expand services. The Supreme Court has noted that “340B hospitals perform valuable services for low-income and rural communities…”

A few years ago pharmaceutical companies began refusing to offer the discount to drug stores under contract with hospitals. The manufacturers would only offer the discounts to in-house pharmacies located within hospitals, a development that had a significant financial impact on many hospitals.

Only four percent of hospitals use their own in-house pharmacies, according to evidence entered in the case. More often, hospitals contract with pharmacies all around the state, which means that patients who have been treated in a Little Rock hospital don’t have to return to Little Rock to get their prescriptions filled. They can get their prescriptions at a contract pharmacy closer to their hometown.

Act 1103 of 2021 was a bipartisan bill, with sponsors from both political parties. It passed the Senate by a vote of 35-to-0.

Pharmaceutical manufactures quickly sued the state Insurance Department, alleging the Act 1103 was unconstitutional and that it was an attempt by the state to pre-empt federal regulations and that it violated federal patent law. A federal judge in Little Rock ruled in favor of the state and his ruling was upheld by the Eighth Circuit Court of Appeals in St. Louis.

Also, some pharmaceutical companies argued that some hospitals used the discounts to boost profits, rather than to add services or lower prices for patients.

By refusing to hear any further appeals, the U.S. Supreme Court affirmed the lower court rulings and essentially declared Act 1103 to be constitutional.

The Insurance Department said earlier this year that 23 of 32 listed pharmaceutical manufacturers are now in compliance with Act 1103.

The original legal challenge was filed by a trade group, the Pharmaceutical Research and Manufacturers of America, also referred to as PhRMA.

Arkansas was the first state to enact a law requiring pharmaceutical manufacturers to offer equal discounts to contract pharmacies. Louisiana followed suit in 2023 and in 2024 six other states have enacted similar laws.
