AI and Copyright: Steering Around the Iceberg

Like any work that contains the "modicum of creativity" that is necessary for it to be entitled to copyright protection, the copyright in [my latest] work was established at the moment the work was created. But an extra step is often needed to ensure that a copyrighted work gets full legal protection: registering it with the U.S. Copyright Office.

Long before the proliferation of AI and the beginning of the AI legal debate, there have been on and off discussions in Congress and among policymakers of a need to reform the U.S. Copyright Act.

The Historians Council on the Constitution is a recently formed program of the progressive Brennan Center for Justice, with the intent to publicize and correct errors by the U.S. Supreme Court in its interpretations of American history. The council produces magazine articles, analytical reports, and amicus briefs, which are all available on the Brennan Center for Justice site.

The Supreme Court has always been at the center of legal attention and controversy, and rightly so: As the apex of the nation’s judiciary, its job is to take up the toughest and most consequential cases.
