🔴کلاهبرداری🔴

تعدادی از هموطنان ایرانی مقیم خارج از کشور خصوصاً ساکن کالیفرنیا، املاکی را در ایران بصورت قولنامه ای خریداری نموده و در بعضی موارد فروشنده با سوء استفاده از ضعف قانون و عدم حضور خریدار، همان ملک را جهت دریافت وام در رهن بانک قرار داده است!؟

این اقدام غیر قانونی فروشنده معضلات بسیاری را برای خریداران ایجاد می کرد، به نحوی که دادگاههای کیفری در ایران در خصوص مجرمانه بودن اقدامات فروشنده اختلاف نظر داشتند و در اغلب موارد نیز خریدار برای جلوگیری از ضرر بیشتر چاره ای جز تسویه وام اعطایی بانک به فروشنده و طرح دعاوی حقوقی پیچیده برای احقاق حق نداشت.

🔴 روز گذشته بيستم شهريور ۱۴۰۳، دیوان عالی کشور به این اختلاف نظرها خاتمه داد و با صدور یک رأي وحدت رويه اقدام فروشنده را از مصادیق اعمال مجرمانه با مجازات کلاهبرداری تشخیص داد.
