The European Journal of Law Reform is the leading scientific and peer-reviewed journal in the areas of law reform, legislative drafting, better law-making, and comparative study of the evolution of law. The U.S. has never ratified the Statute of the International Criminal Court in The Hague. After Clinton signed, it was not ratified by the Senate and Bush unsigned it as a clear message to the world that the U.S. does not accept oversight by an international war crimes court.
Apparently, the U.S. would still like the Court to investigate OTHER countries, however. While Russia should absolutely be investigated, the U.S. is setting the worst possible example for a leading democracy supposedly caring about the rule of law!

The step signals a major shift in American policy and ends months of resistance by Pentagon officials who feared setting a precedent that could pave the way for the court to prosecute U.S. troops.

Since pretty much all of the good books on this subject are expensive and largely unavailable outside the wealthiest law firms and universities in wealthy developed nations, we will be offering our book FREE OF CHARGE and OPEN ACCESS online. In this way, we are hoping to level the playing field and give developing nations the tools to defend themselves adequately and stand up for their rights when they are challenged by investors with deep pockets who may or may not have valid claims against their host countries. Professors Frank Emmert (Indiana University Robert H. McKinney School of Law) and Begaiym Esenkulova (American University Central Asia) are launching a major research and book project on International Investment Law reform, with a particular focus on Investor-State Dispute Settlement (ISDS). One of the intended outcomes is a multi-authored book on "The Crisis of International Investment Law and the Way Forward" to be published in the "Markets and the Law" series of Routledge Publishers (United Kingdom). Confirmed contributors so far include Professor Marc Bungenberg (Germany), Attorney-at-Law Kiran Nasir Gore (USA), Professor Csongor István Nagy (Hungary), and Professor Krista Nadakavukaren Schefer (Switzerland). Professors Andreas Ziegler (Switzerland), and Kyla Tienhaara (UK) will have an observer status and may provide occasional advice and input. A number of additional experts and progressive voices in International Investment Law are being invited to join. The project management will be in the competent hands of Konstantina Kloufetos.
