The support for California’s automobile emission waiver should be wavering. It once made some sense, but when it was repurposed from focusing on smog to focusing on greenhouse gas emissions, it made far less sense. Given that issue’s contentiousness today, it is worth revisiting.

When California was first granted a waiver from federal emission standards, there was a good reason. It was allowed because the Los Angeles region was particularly susceptible to smog as a result of a unique combination of geography and climate. And since such pollution is quite localized, that provided a good reason for stricter smog emission standards in the specific region where the problem was worse. In other words, effective regulation of local pollutants where they are worse could be more effectively done at a local level than at a national level.

A former manager of a West Virginia laboratory that conducted water sampling for coal mining operations in the state has been sentenced to two years in prison for his role in forging data to show compliance with pollution discharge rules. This week, John Brewer, a former manager with Appalachian Laboratories, was sentenced to prison after he pleaded guilty in October to one count of falsifying water sample reports later filed with the West Virginia Department of Environmental Protection, a violation of the US Clean Water Act's standards for water sampling for mining operations, according to local reports.
