OF THE TOWN‘S CODE OF ORDINANCES
Amend Section 58-151 of the Town's Code of Ordinances
To Amend Subsection 53-161 of Article Vl - Noise, to permit outdoor entertainment between the first day of March and the thirty-first day of October of each year
Sec. 58-161. Prohibited noises.
(a) The creation and continuation of any loud, disturbing, and unnecessary noise calculated to disturb the peace and quiet of the town, whether in public streets or within enclosures, public or private, is prohibited. It shall be unlawful for any person to cause, make, or contribute to creating any loud or disturbing noise of such character, intensity, or duration as to be detrimental to the life or health of any citizen or to the common peace of the town. The following acts, among others, are declared to be loud, disturbing, annoying and unnecessary noises in violation of this section; but such enumeration shall not be deemed to be exclusive:
(1) The use of any drum, noise makers or other instrument or device for the purpose of attracting attention to any performance or event, show, sale, or the display or advertisement of merchandise, by the creation of noise except as permitted by the chief of police.
(2) The use of any mechanical loudspeaker or amplifier used to create excessively loud noise except as permitted by the chief of police.
(3) The operation of any garage, service station, auto repair business, store or other place of business or construction activities between the hours of 8:00 p.m. and 7:00 a.m. in such a manner as to create loud and disturbing noises of such frequency or such volume as to annoy or disturb the quiet or comfort of any citizen and particularly the creating of disturbing noises of such frequency and volume as to annoy or disturb the quiet, comfort, peace or repose of any person in any dwelling or other type of residence.
(4) The hosting of or attendance at any gathering except at a public or commercial establishment as defined in subsection {5) of this section particularly between the hours of 10;00 p.m. and 7:00 a.m. in such a manner as to create loud and disturbing noises, of such frequency or such volume as to annoy or disturb the quiet and comfort of any citizen and particularly the creating of disturbing noises of such frequency and volume as to annoy or disturb the quiet, comfort, peace or repose of any person in any dwelling or other type of residence.
(5) The hosting of or attendance at any public or commercial establishment utilizing outdoor entertainment in such a manner as to create loud and disturbing noiset of such frequency or such volume as to annoy or disturb the quiet and comfort of any citizen and particularly the creating of disturbing noises of such frequency and volume as to annoy or disturb the quiet, comfort, peace or repose of any person in any dwelling or other type of residence except as otherwise permitted herein. Outdoor entertainment shall be described as any radio, phonograph, and instrument of sound- producing or sound-amplifying device and shall be further governed by the following provisions:
a. outdoor entertainment may be operated between the first day of March and the thirty-first day of October of each year as set forth in subsections b, q and d herein below:
b. operating on Friday and/or Saturday beginning at 12:00 noon and ceasing at
12:00 midnight;
c. operating on Thursday and/or Sunday beginning at 12:00 noon and ceasing at
9:00 p.m.; and
d. operating on national holidays beginning at 12:00 noon and ceasing at 9:00 p.m., provided however, if the national holiday falls on Friday or Saturday the time restrictions set forth in subsection {b} shall apply.
Nothing in this section shall be deemed to apply to youth-oriented events at which no alcoholic beverages are served, sold, present, or otherwise available, provided such events are concluded before 10:00 p.m. on Thursday nights only.
{b} nothing in this section shall be deemed to limit the use of audible signal devices on authorized emergency vehicles as provided in S.C. Code 1976,.
This ordinance shall take effect upon final reading.
