Pulaski County Circuit Judge Patricia James has ruled in favor of C**t Shelby of Franklin County, who filed a lawsuit challenging the timeline for a special election to fill the vacancy in State Senate District 26.

James’ order, filed today, granted Shelby’s petition that the special election should be set before Feb. 23, 2026.

The senate seat was left vacant after Sen. Gary Stubblefield’s death in September. District 26 includes portions of Franklin, Johnson, Logan, and Sebastian counties.

Gov. Sarah Huckabee Sanders initially issued a proclamation that the special primary would be held on March 3, 2026, and the general election to fill the seat would be Nov. 3, 2026. She later ordered the general election to be held June 9, 2026.

Sanders said her initial decision for the November 2026 election was made in part to save money and streamline the process, but community feedback led to the change.

Shelby filed a lawsuit contesting the election dates, stating the November election would occur 436 days after the seat became vacant and would leave District 26 residents without representation for the 2026 Fiscal Session in April as well as weekly legislative committee meetings.

"The citizens of Senate District 26 would be unconstitutionally impaired if this were to occur," James’ order states. "They would not be able to fully and effectively participate, nor would they be able to have an effective voice in the election of members of their state legislature."
