The Government, in agreement with attorneys for the defense, has filed a motion to stay(suspend) the deadline for pretrial motions until after the Department of Justice makes its decision whether or not to seek the death penalty against the five defendants currently charged in the FBG Duck murder case.

Two of the charges in the indictment, murder in aid of racketeering activities(count 1), and causing the death of a person through the use of the firearm(count 2) could potentially carry the death penalty should the Department of Justice decide to pursue it. This decision will likely effect any pretrial motions made by both parties.

Pretrial motions can effect many aspects of a case such as whether evidence can be used at trial, where the trial occurs, and what charges will be prosecuted. The current deadline for pretrial motions is Wednesday October 27th.

US Attorney JOHN R. LAUSCH JR also added that the discovery(evidence) in this case is quite voluminous and complex, and that due to the nature of the charges and the course of the investigation, the government will have to produce some discovery items on a rolling basis, and it may take counsel for the defense several months to review it.

A decision on the motion is expected before the deadline tomorrow.

The Baltimore rapper known as YGG Tay has elected to take federal drug and gun charges to trial, where his defense attorney told jurors Tuesday that the federal government was unfairly trying to portray his client as a drug trafficker. “Where there’s smoke, there might be fire,” defense attorney John Cox said. “There might also [just] be a barbeque.”

Prosecutors said that Davante Harrison was a “careful and calculated drug supplier,” who frequented casinos and was observed hanging out at what authorities believed to be a drug stash house in Federal Hill. After weeks of federal surveillance, Harrison was caught with a loaded handgun, cash, and drugs.
But Cox said Harrison’s casino records show he wasn’t laundering drug money, but rather liked to place bets on sporting events. The stash house was the home of a friend, and they ordered pizza and watched football before Harrison went to a Ravens game at nearby M&T Bank Stadium that night.

He conceded his client was later caught with the gun and drugs, but said it was part of his “persona” as a rapper. “It doesn’t mean he’s complicit in a [drug] conspiracy,” Cox said.
The gun spells trouble for Harrison on the charges he faces of possession of a firearm by a prohibited person. But Harrison also faces charges of conspiracy to distribute drugs and possession of a firearm in furtherance of a drug trafficking crime.

Harrison became one of the best known rappers in the city as he was becoming a target for federal investigators. In court papers FBI task force officers wrote that they believed Harrison had been supplying drugs to the violent Trained To Go gang that was taken down in 2017, and said they had at least one confidential source who told them that Harrison had been a drug supplier as far back as 2007.
“We’ve been investigating for a long time,” former FBI Safe Streets task force officer Daniel DeLorenzo testified.
