BIR FILES CRIMINAL CASES WITH AN ESTIMATED TAX LIABILITY OF P1.8B AGAINST 69 CORPORATIONS, CORPORATE OFFICERS & ACCOUNTANTS UNDER ITS RUN AFTER FAKE TRANSACTIONS PROGRAM The Bureau of Internal Revenue Commissioner Romeo D. Lumagui Jr. led the filing of 15 criminal cases against the Buyers and Sellers of Ghost Receipts under the Run After Fake Transactions Task Force of the BIR last November 22, 2023. A total of 69 Respondents (corporations, corporate officers, and accountants) were impleaded in the criminal cases filed before the Department of Justice, with an estimated tax liability of P1.8 billion pesos. "The sale and use of Ghost Receipts is a tax-evasion scheme of the highest order. The BIR is committed to filing civil and criminal charges against all corporations, corporate officers, and accountants involved in this syndicate. We are already preparing the next set of criminal cases." Commissioner Lumagui stated. These Buyers and Sellers of Ghost Receipts come from different industries such as construction and hardware, marketing of goods, equipments, office supplies, automotive oils, trading of metals, contractor electrical and mechanical systems, hotel, and food services. This shows the magnitude of this syndicate because it covers an array of industries. These Buyers and Sellers have violated Section 254 - Tax Evasion, Section 255 - Failure to Supply Correct and Accurate Information in the ITR and VAT Returns, Section 267 - Perjury and Section 257 - Making False Records or Report under the National Internal Revenue Code.

PTFoMS working for more benefits for members of the media QUEZON CITY – The Presidential Task Force on Media Security (PTFoMS) on Friday (Nov. 17) assured that they are doing their best in order to provide the members of the media more benefits while in the performance of their duty. In a press conference held at the Philippine Information Agency (PIA) hosted by PIA Director General Undersecretary Jose A. Torres, Jr. and PIA Deputy Director-General for Regional Operations Adolfo Ares P. Gutierrez, PTFoMS Executive Director Undersecretary Paul M. Gutierrez said that under Executive Order No. 1, their mandate is to investigate all violations on the life and liberty of all the members of the media. “It encompasses not only the tri-media (Radio/Television/Newspaper) but the quad-media (online/social media platform), as well,” Gutierrez said. He cited that on May 25, 2023, Cris Bundukin was ambushed while in the performance of his duty. Gutierrez stressed that all of these incidents have been solved or ongoing, including the ambush slay of Percy Lapid on Oct. 25, 2022. “On our own way, we are doing our best to work out for more benefits for the members of the media,” he said. The Public Attorney’s Office (PAO) has signed a memorandum of agreement (MOA) with the PTFoMS to extend legal assistance to members of the media who may have been facing legal problems in the performance of their respective duties. Gutierrez also said that the Department of Social Welfare and Development (DSWD) is also silently helping the members of the press pertaining to the problems they are encountering. NCCA URGES RESPECT FOR FILIPINO VALUES IN EVERYDAY LIFE QUEZON CITY – The National Commission for Culture and the Arts (NCCA) on Friday (Nov. 17) urged respect for Filipino values in everyday life. In a press conference at the Philippine Information Agency (PIA) here in this city hosted by PIA Deputy Director-General for Regional Operations Adolfo Ares P. Gutierrez, NCCA Commissioner for the Sub-Commission for the Arts Dr. Arvin Villalon cited Presidential Proclamation 9749 declaring November as the “Filipino Values Month”. Dr. Villalon noted that “Ang pagmamano ay isa lamang expression. Gayunpaman ito’y expression. Ang pagmamano ay buhay pa.” “Isa pang legal basis ng Filipino Values ay ang GMRC (Good Manners and Right Conduct) and Values Formation Law. Ang magtuturo talaga ng values ay tayo, kasama na ang media,” he said. “Napakadiverse kasi ng ating bansa pero pagdating sa values ay nagkakaisa tayo. Pinupush ng NCCA na iinstitutionalize ang 20 Filipino values sa school curriculum ng DepEd (Department of Education) from Grade 1 to Grade 6,” he added. The GMRC which has become a law, and seems to have become “problematic”, is taught to Grade 1 students until they graduate in elementary. “Two years ago, we had a short film about the “Filipino values”, which was “negative” in order to strengthen the values rooted to Filipino family culture,” Dr. Villalon said. “Years back, sinubukan namin ang values ng dance at isusunod na ang mga kanta na nagpapakita ng pagiging malikhain ng Filipino,” he added. BIR SEIZES ILLICIT CIGARETTES IN DAVAO REVENUE REGION WITH 252M IN TAX LIABILITIES Bureau of Internal Revenue, headed by Commissioner Romeo D. Lumagui Jr, had another successful operation against illicit cigarette traders and smugglers last November 6, 2023. A total of 717 master cases or 358,500 packs of illicit cigarette with an estimate of P 252 Million in tax liabilities were confiscated by the BIR. This was a joint enforcement operation with the Naval Forces of Eastern Mindanao Command based in Davao City. "The BIR will continue the fight against illicit tobacco traders or smugglers wherever they may be. The BIR will continue to protect compliant taxpayers while prosecuting illicit trade. We will not stop. Expect more enforcement operations," Commissioner Lumagui stated. The joint operation discovered that brands such as Canon, GreenHill, and Bros were being smuggled into the Philippines without proper payment of excise taxes. These traders are in violation of Section 130 of the National Internal Revenue Code as amended, Republic Act 11900, and Revenue Regulations Nos. 7-2021, 18-2021, and 14-2022. Another successful enforcement operation was conducted on November 8 by the BIR resulting to confiscation of 51 master cases or 25,500 packs of New Orleans smuggled cigarettes with an estimated tax liabilities of P 17.9 Million. This was a joint operation with the Davao City Police Office PS6 and Task Force Davao during the random checkpoint in Bunawan, Davao City.

LWUA’s DECISION ON THE METRO CEBU WATER DISTRICT LEADERSHIP The Local Water Utilities Administration (LWUA) maintains that water districts are autonomous agencies independent of local government units. This is in relation to the ongoing row at the Metro Cebu Water District (MCWD) wherein the chairman and two members of the MCWD Board of Trustees have been replaced by the Cebu City government without a confirmation of validity from LWUA. LWUA stands firm that local executives have no authority to remove board members of a water district, citing Section 7 of Presidential Decree 198 which created LWUA in 1973. The said section states, “Upon filing of resolution forming the Water District, the local government or governments concerned shall lose ownership, supervision, and control or any right whatsoever over the district except as provided therein.” Regarding the LWUA Board Resolution 35 for the agency’s intervention and providing an interim board for MCWD – in line with the Cebu City government’s move to replace members of the Board – LWUA clarifies that such resolution has not been approved by the LWUA Board. LWUA Administrator Vicente Homer Revil explains that the said resolution was only “hastily” submitted on the day of the LWUA Board meeting itself. “Copies of board materials have to be submitted in advance before it becomes part of the agenda in the board meeting. Moreover, there was no prior legal and technical review by the LWUA management on the proposed takeover of MCWD,” Revil said. Revil adds that the said resolution was only signed by two (2) out of five (5) members of the LWUA Board which is not a majority, hence, not a final and executory resolution. Aside from this, there is also an issue of forgery on the signature of the LWUA Board Secretary on Resolution 35, which was drafted by LWUA Chairman Ronnie Ong’s private staff.
