Vice President Sara Duterte attended a House panel hearing on Monday regarding the investigation into her use of confidential funds. This time, she took the truth-telling oath.

The House Committee on Good Government and Public Accountability resumed its inquiry into alleged irregularities involving confidential funds from the Office of the Vice President and the Department of Education.

While Duterte was present at the panel's first hearing, she refused to take the oath and subsequently skipped the following sessions.

As of now, no formal impeachment complaint has been filed in the House, where impeachment proceedings would typically commence.

Sa prinsipyo ng batas, ang burden of proof o ang tungkulin ng pagpapatunay ay nasa nag-aakusa.

Sa kasong ito, si Trillanes bilang nag-aakusa ang may responsibilidad na magpakita ng sapat at matibay na ebidensya upang patunayan ang kanyang mga alegasyon laban kay Pangulong Duterte.

Kung walang matibay na ebidensya, hindi obligado si Pangulong Duterte na pumirma ng waiver dahil hindi siya dapat mapilitang magbigay ng pruweba sa kanyang kawalan ng kasalanan.

Sa halip, kung hindi matibay ang mga ebidensya ni Trillanes, maaaring hindi kailangang pirmahan ni Pangulong Duterte ang waiver.

Sa sistema ng hustisya, mahalaga na ang sinumang nag-aakusa ay dapat may sapat na pruweba bago humingi ng aksyon mula sa inakusahan.
