SC RULES DEMOTION, VERBAL ABUSE GROUND FOR ILLEGAL DISMISSAL
The Supreme Court has ruled that demotion, verbal abuse, and indifferent behavior by an employer that forces an employee to resign constitute constructive illegal dismissal.

Constructive dismissal happens when an employer creates such unbearable working conditions that the employee feels forced to resign.

The Supreme Courtโ€™s Second Division, in a Decision penned by Associate Justice Amy C. Lazaro-Javier, stressed that actions demonstrating extreme dislike and hostile behavior, such as demotion, uttering insulting words, and apathetic behavior toward an employee, constitute constructive illegal dismissal when such actions cause the employment conditions to be so unbearable that there is no other choice but to resign.

The Court held that the standard for constructive dismissal is whether a reasonable person in the employeeโ€™s position would have felt forced to give up their employment under the circumstances.

While the Court said that strong words may be exchanged in the workplace where there are bound to be disagreements, these should not degrade the dignity of employees to avoid a hostile work environment.

SC: Pang-iinsulto at Masamang Pakikitungo sa Empleyado Maaring Ituring na Constructive Dismissal

Maaaring ituring na constructive illegal dismissal ang pagbitiw ng isang empleyado dahil sa demotion o pagbaba sa ranggo, pang-iinsulto, masamang pakikitungo, at kawalan ng malasakit ng employer.

Ito ang naging Desisyon ng Korte Suprema sa kaso ng isang empleyado na napilitang mag-resign dala ng hostile work environment.

Sa Desisyon na isinulat ni Associate Justice Amy C. Lazaro-Javier, sinabi ng Korte Suprema na ang mga kilos ng employer na nagpapakita ng labis na pagkayamot sa empleyado tulad ng demotion, nakakainsultong pananalita, at kawalan ng malasakit o pakialam ay maituturing na constructive illegal dismissal kapag hindi na nakayanan ng empleyado ang kanyang kalagayan at napilitang magbitiw sa pwesto.

Ang pamantayan para malaman kung merong constructive dismissal ay kung ang isang makatuwirang empleyado ay mapipilitang iwanan ang kanyang trabaho dahil sa kanyang kalagayan.

Bagamat sinabi ng Korte Suprema na hindi talaga maiiwasang may mga matitinding salita na maaaring bitawan sa trabaho dahil sa hindi pagkakaunawaan, hindi ito dapat nakasisira sa dignidad ng mga empleyado.

KIANGAN, IFUGAO - Umabot sa 192 katao sa bayan ng Kiangan ang nakilahok sa ginawang Unity Walk at Peace covenant signing na ginanap noong Biyernes ng umaga, ika-13 ng Oktubre 2023.

Nagsimula ang unity walk sa Kiangan Municipal Open Gym patungong Guinid COMPAC papuntang Kiangan Multipurpose Cooperative patungong Dait's Junction at pababa sa BFP building pabalik sa Muncipal Open Gym kung saan isinagawa ang maikling programa na pinangunahan ng Kiangan Municipal Police Station sa pamumuno ni Police Captain Brenda B. Sumawang.

Nagkaroon ng interfaith prayer rally, integrity pledge, at peace covenant signing kung saan bawat kandidato kabilang dito ang mga kinauukulang ahensya ay lumagda sa nasabing peace covenant para sa mapayapang halalan.

Kabilang sa mga lumahok sa aktibidad ay ang PNP, DILG, COMELEC, BFP, BJMP, AFP, CSOs, lokal na opisyal at mga empleyado ng munisipyo, at religious sektor.

Dumalo din sa nasabing aktibidad ang Alkalde ng Kiangan na si Atty. Raldis Andrei A. Bulayungan, Police Lieutenant Melchor J Pascua, Hepe ng Ifugao Provincial Community Affairs and Development Unit, at si Captain Inocencio Quiming ng 54th Infantry Battalion, 5th Infantry Division ng Philippine Army.
