पक्ष विपक्षमा तर्क राख्ने स्वाँठहरुको जानकारीका लागि

कानुनी राज्यको सिद्धान्त अनुसार कुनै पनि राष्ट्रमा कानुन सबै नागरिकलाई समान व्यवहार गर्ने एउटा नजीर वा ब्यबस्था हो । जसअनुसार बिश्वको सबै राष्ट्रहरूमा कुनै पनि ब्यक्तीलाई अपराधको आरोपमा आरोपित माथि मुद्दा चलाउनको लागि थानाबाट निकाल्नको लागि आरोपित ब्यक्ती नभागोस र न्यायालयले बोलाइएको समयमा अदालतमा उपस्थित भई कानुनलाई सहयोग गरोस भनेर न्यायालयमा जुन सम्पत्ति बुझाइन्छ भने त्यसलाई जमानत वा धरौटी रकम भनिन्छ।

जमानत वा धरौटी बुझाउने भनेको मुद्दा चलाउनको लागि स्विकार गर्छु भन्ने हो । जमानत वा धरौटी रकम बुझाएर थुना मुक्त हूनु भनेको स्थाई मुक्त हुनु होइन। न्यायालयले छानबिन गरि मुद्दाको बिषयमा बहस हुदा र निर्णय सुनाउदा हाजीर हुनुपर्ने सर्तमा धरौटी रकम बुझाएर थुना मुक्त हूने प्रावधान बिश्व भरि नै रहेको छ।

कुनै पनि ब्यक्तीको बिरूद् अपराधको आरोप छ र त्यो आरोपलाई प्रमाणित गर्न छानबिनको लागि समय चाहिन्छ तसर्थ छानबिनको समयमा ब्यक्तीले अपराध गरेको प्रमाणित नहुने समयसम्म थुनेर राख्न नमिल्ने र उसलाई दोषी मान्न नसकिने हुदां सो अबधि सम्म उसलाई बिभिन्न सर्त राखेर थुनाबाट मुक्त गराउनलाई उसलाई प्रदान गरिएको अधिकार नै धरौटीमा रिहा हुनु हो।
investigation मा प्रभावित नपारर्ने सर्तमा संसार भरिकै आरोपीहरु जमानत वा धरौटीमा रिहा हुन्छन्। धरौटी रकममा जेलबाट मुक्त हूनु भनेको पनि कानुनी राज्यको सिद्धान्त अनुसार संबिघानले दिएको नागरिकको स्वतन्त्रता सम्बन्धित मौलिक अधिकार हो। यो स्वतन्त्रता पुनः अदालतले आदेश जारी गर्दा सुनुवाइको लागि अदालतमा उपस्थित हुनुपर्ने सर्तमा दिएको हुन्छ।

यदि आरोपी त्यो दिन उपस्थित भएन भने पुनः पुलिसले समातेर अदालतमा उपस्थित गराउने ब्यबस्था यो धरौटी प्रकृयामा रहेको छ। अदालतले बिभिन्न प्रमाणहरूको आधारमा र पुलिसले यो अबधिमा गरेको investigation सत्य प्रमाणित हुन्छ भने आरोपी अपराधीमा परिणत हुन्छ र उसलाई जेल चलान गरिन्छ तर यदि प्रमाणहरूले र investigation ले आरोपी अपराधी ठहर भएन भने उ रिहा हुने ब्यबस्था नेपालको कानुनमा रहेको छ जसलाई सबैले बुझ्नुपर्ने हुन्छ ।
