CopiedCOMMUNIQUE ISSUED AT THE END OF A 2-DAY RETREAT ON STRATEGIES AND MODALITIES FOR THE IMPLEMENTATION OF FINANCIAL AUTONOMY OF STATE LEGISLATURE AND STATE JUDICIARY ORGANIZED BY PRESIDENTIAL IMPLEMENTATION COMMITTEE ON AUTONOMY OF STATE LEGISLATURE AND STATE JUDICIARY HELD ON THURSDAY 16TH AND FRIDAY 17TH MAY 2019, AT THE CONGRESS HALL TRANSCORP HILTON HOTEL, ABUJA.

Preamble

Following the Assent by President Muhammadu Buhari, GCFR, to the Constitution of the Federal Republic of Nigeria, 1999 (Fourth Alteration) in June 2018, granting financial autonomy to States’ Legislature and Judiciary, it was observed that it was honuored by the various State Governments, more in breach, than in compliance.

As a result, President Muhammadu Buhari, GCFR inaugurated a Presidential Implementation Committee on the Autonomy of State Legislature and Judiciary (“The Committee’’) on 22nd March, 2019 to fashion out a workable national strategy for the implementation of financial autonomy of State Legislature and Judiciary in accordance with the provisions of Section 121(3) of the Constitution of the Federal Republic of Nigeria, 1999 (Fourth Alteration) whereby funds appropriated to these two tiers of Governments at the State level, are released to them directly.

Upon inauguration, the Committee adopted its work plan and held a number of technical meetings, sub-committee meetings, strategic consultations, etc., which culminated into the 2-Day Retreat to provide a broad based platform for stakeholders to brainstorm and articulate an effective national strategy for the implementation of autonomy of States’ Legislature and Judiciary. The Retreat was declared open by His Lordship, Hon. Justice (Dr.) Ibrahim Tanko Mohammed, the Ag. Chief Justice of Nigeria, who was represented by the Administrator of the National Judicial Institute, Hon. Justice Rosaline Bozimo, OFR ( Retd). The Honourable Attorney General of the Federation and Minister of Justice, Mr Abubakar Malami, SAN was represented by Mr. Tayo Akpata, Solicitor –General and Permanent Secretary, Federal Ministry of Justice. Goodwill messages were delivered by Rt. Hon. Yakubu Dogara, Speaker House of Representatives, Senator Ike Ekweremadu, Deputy Senate President, H.E Abdul – Aziz Yari, Chairman, Nigerian Governors’ Forum represented by H.E. M. A. Abubakar, Bauchi State Governor, and Dr. Clement Nkwankwo, Director, Policy and Legal Advocacy Centre (PLAC). The Secretary of the Committee, Senator (Dr.) Ita Enang, delivered the welcome address, on behalf of the Chairman.

The Retreat was attended by a cross section of stakeholders from the Legislature, Judiciary, Representatives of Judicial Staff Union of Nigeria, Representatives of Parliamentary Staff Union of Nigeria (PASAN), Civil Society Organizations, among others (List of Attendees is attached).

Papers were presented by Resource Persons on topics germane to the terms of reference of the Committee which elicited useful and robust contributions from critical stakeholders.

At the end of the Retreat, Participants and Stakeholders adopted the following Resolutions –

1. Commend His Excellency, President Muhammadu Buhari, GCFR for the bold step in signing into law the Constitution of the Federal Republic of Nigeria, 1999 (Fourth Alteration) and for inaugurating the Presidential Implementation Committee on Autonomy of State Legislature and Judiciary as a clear demonstration of his commitment to give effect to the financial autonomy of the Legislature and the Judiciary at the State Level;

2. There are various levels of minimal compliance in various States but all fall short of the expected compliance, as Budget performance across 36 States of the Federation show that whilst the least allocations to the State Judiciary in the past three years was 0.6 percent of the Budget of the entire State, the highest allocation was 4.89 percent and therefore urge the Governors as the Heads of the Executive Arm of Government to begin full implementation of the financial autonomy granted the Legislature and the Judiciary;

3. Adopt the Budgeting model operating at the Federal level where the sum due to the Judiciary and the Legislature are captured as first line Charge in the Budget laid before and passed by the Legislature;

4. That the Budget proposal of the Legislature and Judiciary should be defended before the relevant Committees of the Legislature;

5. That the total sum, both Capital and Recurrent, approved in the Annual Budget of the State, be released monthly on a pro–rata basis by the Accountant General of the State, directly to the Heads of the Legislature and the Judiciary, and Heads of Judicial Service Committee or Commission;

6. That the budgeted sum, Capital and Recurrent howsoever described, be released to the Judiciary to be spent by the Judiciary on the projects, programmes and capital development of the Judiciary, including recruitment and training of personnel. And so for the Legislature;

7. That the current practice in some States where appropriated Recurrent Expenditure due the Judiciary and Legislature in the budget, are released to the Judiciary and Legislature and the Capital components are warehoused in the Executive is hereby abolished;

8. That the Model Budget Template of the Judiciary and Legislature, the strata of line consultations and inter Arms, as well as Inter-Agency pre-budget consultations and front loading as already done in some states, be adopted;

9. That the Nigeria Governors’ Forum is appreciated for its commitment to the implementation of the financial autonomy of State Legislature and State Judiciary in Accordance with the 4th Alteration to the 1999 Constitution (as amended);

10. There shall be created a State Allocation Committee comprising the Commissioner of Finance, the Accountant General of the State, the Clerk of the State House of Assembly, the Chief Registrars of High Courts, Sharia Court of Appeal and Customary Courts, the Secretary of the Judicial Service Commission/Committee and the Secretary of the State Assembly Service Commission if any, for the purpose of determining the amount due to each Arm of Government based on the budgetary provision but subject to the funds available to the State;

10. The retirement benefit and pensions of judicial officers of Superior Courts of records in the State should be paid by the National Judicial Council as they receive their salaries and allowances from the NJC while in office;

11. Encourage all State Houses of Assembly to pass Funds Management Law or Budget Process Law by whatever name called, as a legal framework that will ensure judicious budgeting and use of funds accrued to the State.

NLC sets July deadline
for new minimum wage

The Nigeria Labour Congress (NLC) has
insisted that the new minimum wage must
come into effect in July this year.
President of Congress, Ayuba Wabba, who
told The Guardian in an exclusive interview in
Abuja, yesterday, added that Congress would
reject any date that is beyond July.
Wabba highlighted that arrangements have
been finalised to sign the agreement in Kigali,
Rwanda on March 21, this year.
He said: “Going by all the data submitted so
far to the negotiation committee, we believe
that a new wage is possible in July. Labour
will reject any date that is beyond July and we
have made that known to the government.”

The NLC chief also accused the Minister of
Trade and Investment, Okechukwu Enelamah,
of seeking to sign the Africa Continental Free
Trade Agreement, without consulting labour,
manufacturers and the National Assembly.
He stated: “Admittedly a free trade
agreement is not a customs union in the
sense that Member States abolish only tariffs
between them, while maintaining their own
tariffs on third world countries, but this
would already be impossible.
“Far from promoting regional integration of
the continent, it will disintegrate it strongly
in opening wide the doors to multinationals
already well implemented in most African
countries and which would concentrate their
activities in the most competitive countries
from which they would export to the
others.”
Wabba explained that the trade agreement,
which is being pushed by the European Union
and World Trade Organisation (WTO), would
damage Africa’s economy and promote
massive unemployment.
On his part, the Executive Secretary of the
Organisation Trade Union of West Africa
(OTUWA), John Odah, while faulting the
agreement, said only Nigeria and The Gambia
and other few countries in the continent are
yet to sign the document.
He added: “Indeed, the new acronym is a
new one. The old one was the Economic
Partnership Agreement (EPA) they have been
pushing, which has failed. The agreement is a
bad move for the labour and manufacturers
in the continent and will further subject
Africa to the negative effects of the neo-
liberal policies on the West.”
Meanwhile, the Presidency has launched a
discreet investigation into employment of 350
new staffers into the Nigeria Social Insurance
Trust Fund (NSITF) by the Minister of Labour
and Employment, Dr. Chris Ngige.
The Guardian gathered in Abuja that the Chief
of Staff to the President, Abba Kyari, is
leading the investigation.
The investigation team was also given the
task of unraveling the alleged N200 million
spent on staff induction and training
approved by the minister.
A source said: “The presidency has directed
that a team investigate the employment scam
going on in NSITF. It was learnt that some
senior members of the ministry got about 300
employment letters of senior new employees
ready for distribution.
“The investigation team is also expected to
examine the appropriation of N200million
approved for the training and induction of
staff.”
The time frame for the submission of the
report was not made known yet as at the
time of filing this report.hi]

New minimum wage certain, Ngige promises workers

The Minister for Labour and Productivity, Dr, Chris Ngige, on Monday assured Nigerian workers that implementation of a new minimum wage in the country would be done.

He said the committee set up for that purpose by the Federal Government had already started work.

Ngige gave the assurance while speaking with journalists shortly after witnessing the swearing-in of newly-elected chairmen of the 18 local government councils in Edo State at the Government House, Benin.

Council elections were conducted in the state on Saturday, and the ruling All Progressives Congress won all the positions.

The minister said the Minimum Wage Review Committee, with him as deputy chairman, would submit final report in the third quarter of the year to the National Assembly for due consideration.

“This is a constitutional issue and the Constitution makes provision for the minimum wage to be reviewed every five years and we are on course.

“The committee will decide what the minimum wage will be and it is a tripartite arrangement comprising the government, employers and employees.


“So, the Nigerian workers should hope that we have their issues at heart,’’ he said.

He commended Edo governor, Mr. Godwin Obaseki, for saving up funds for the new councils’ chairmen to commence activities.

Ngige described the act as “benevolent” and urged the chairmen to utilise the funds for the benefit of the masses.

“The governor has done the ultimate for them; the ball is now in their court to do the needful,’’ he said. (NAN)

Federal High Court Reshuffles Judges To Clear Corruption Cases

The acting Chief Judge of the Federal High Court, Justice Abdul Kafarati, has redeployed 10 judges of the Federal High Court to different divisions of the court across the country.
The affected judges, according to a circular by the court, are to leave the divisions where they currently sit and resume at their new stations on October 27, 2017.
The redeployment is said to be in accordance with the directive of the Chief Justice of Nigeria, Justice Walter Onnoghen, that heads of various courts should constitute special courts for the speedy trial of corruption cases pursuant to the Federal Government’s anti-graft war.
By the circular, Justice Saliu Saidu, who currently sits at the Bayelsa division, will move to Lagos; Justice B.B. Aliyu will move from Yola to Port Harcourt; Justice I.M. Sani will move from Lokoja to Uyo; Justice I.L. Ojukwu will move from Uyo to Abuja; while Justice D.U. Okoronkwo, who currently sits in Ekiti will move to Lokoja.
Others moved are Justice F.O. Giwa-Ogunganjo; Justice Adamu Turaki Mohammed; Justice Abdulaziz Anka; and Justice Ibrahim Watila.....
