Supreme Court Voids National Lottery Act, Affirms States' Exclusive Powers Over Games of Chance

Nigeria's Supreme Court has declared the National Lottery Act 2005 unconstitutional, affirming that the National Assembly lacks the power to regulate lottery and games of chance nationwide.

In a unanimous decision, the seven-member panel led by Uwani Abba-Aji held that the National Assembly can only legislate on lottery matters for the Federal Capital Territory.

The court's judgement resolved a 15-year-old legal dispute between the federal government and the 36 state governments.

The Supreme Court granted all the plaintiffs' prayers, placing the matter of lottery and gaming under the residual list of the constitution.

"The National Assembly can only make laws to regulate and control the operation of lottery in the Federal Capital Territory," the court ruled.

The judgement also declared sections 17, 18, 19, 20, and 21 of the National Lottery Act inconsistent with the Nigerian constitution.

The Supreme Court's decision may have implications for the regulation of the gaming and lottery sectors in Nigeria.

It is uncertain whether the National Assembly will need to pass a new law to regulate the sector in Abuja.
