FINIDI GEORGE FIRES BACK AT ENYIMBA FC MANAGEMENT AFTER AFL ELIMINATION

“Out of 19 new players that were brought in, I had knowledge of only 4 of them. When I saw the quality of the players that were brought, I called Ekwueme the Sporting Director and asked what the target for the season is, he said it is just to stabilize in the league as the focus is to settle down first”

“Ideally, before registering players for any competition, the coaches must be consulted to submit the list. But that wasn’t the case here. For whatever flimsy reason, we were not consulted and they did the registration themselves. As a result, some of the players we would have needed were not registered. It was much later that the sporting director just sent us the list of players that they had already registered.

“After the first leg, they dropped some players from travelling for the second leg in Casablanca, claiming that they couldn’t get them visas. We had to protest it strongly before it was rectified. We later found out that there was more to it.

“Can you imagine that we went for such a game without the goalkeeping and fitness coaches? Myself and Yema were the only coaches that travelled for that game. That is very strange to me.

“Everyone has to put the interest of the club first because until this is done, we would only be joking.”

“We arrived Uyo on October 17 with the idea to have as many training sessions as possible on the grass pitch in Uyo since we are more used to our synthetic pitch. But we couldn’t really achieve that because the management failed to make the right arrangements with the stadium authorities. As a result, we improvised and had one of our training sessions at a primary school, while another training session was cut short because of the same poor arrangements.

“In fact, we played a team that was more used to the playing surface than us, the home team. It was obvious that we were at a disadvantage as a team used to artificial pitches and this really affected us.

“Also, we had only three trainings with the AFL match ball, meanwhile, our opponents had enough time to get used to it. That was why you could see my players struggling with their control, passing and shooting.”

“It is sad to see such statements being released when all hands should be on deck and things should be more organized to enable a positive environment for all. Yes, there have been issues, but I remained patient because I believed that we could harmonise efforts and work things out; but here we are.

“The issue with the team is obvious, and it has nothing to do with the coaches. The same coaches won the league with less goals conceded and highest goal scored. We won the best Super 6 ever organized, scored the highest and conceded the least number of goals,”

ALEX OTTI FILES TEN GROUNDS OF APPEAL, BEGS APPEAL COURT TO REVERSE HIS SACKING.

After several denials and deceit, the embattled Abia State Governor elect Dr Alex Otti has filed an Appeal at the Kano State Division of the Court of Appeal begging the court to reverse his sacking by the Federal High Court Kano, Division.

TAKE NOTICE that the Appellant being dissatisfied with the decision/part of the decision, more particularly stated in paragraph 2 of the Notice of Appeal, contained in the judgment of the Federal High Court, Kano, delivered on 18th May, 2023, Coram M. N. Yunusa J., in Suit No: FHC/KN/CS/107/2023, do hereby appeal to the Court of Appeal upon the grounds set out in paragraph 3 and will at the hearing seek the reliefs set out in paragraph 4.

AND THE APPELLANT FURTHER state that the names and addresses of persons directly affected by the appeal are those set out in paragraph 5.

2) PART OF THE DECISION OF THE LOWER COURT COMPLAINED OF:
The whole judgment/decision, except where the findings are in favour of the Appellant.

3) GROUNDS OF APPEAL

GROUND ONE
The learned trial judge erred in law and acted without jurisdiction in granting the claim of the Plaintiff regarding the selection of candidate of the 1st Respondent, Labour Party when the issue relating to selection of candidate being a pre-election matter had become statute barred.

PARTICULARS
Selection of candidate of political party is a process undertaken through the primaries of political parties.

A complaint relating to legality or otherwise of selection of candidate of a party for election is a pre-election matter;

A pre-election matter can only be cognisable if filed within 14 days of occurrence of the fact/event which gave rise to the complaint.

Plaintiffs action filed on 11th May, 2023 was not filed within the 14 days statutory period of filing a pre-election matter, thereby rendering the action statute barred and incompetent.

GROUND 2
The learned trial judge erred in law and acted without jurisdiction in proceeding to declare as null and void, the participation of the 1st Respondent and its candidate in Kano State and Abia State at the 25th February, 2023 and 18th March, 2023 general election respectively when there was no claim/relief to that effect, thereby changing the coloutation/character of the Plaintiff’s case.

PARTICULARS
The court is always bound by the relief/claim formulated by the Plaintiff;

No court has the jurisdiction to grant what is not claim or change the character of the Plaintiff’s claim;

Plaintiff by his claim never sought for any specific claim affecting the selection of Plaintiff’s candidate in Abia State;

In all the claim before the court, Plaintiff never mentioned Abia State as a state affected by the complaint made by him; and

Trial judge wrongly stated Abia State as a state affected by the alleged breach of section 77(3) of the Electoral Act, 2022;

GROUND 3
The learned trial court erred in law and acted without jurisdiction in holding thus:

“That the 1st Defendant has carried on with its activities in the selection of its candidates for the General election in a manner that is at variance with mandatory provisions of the Electoral Act, 2022 which renders its participation in the General Elections, 2023 in Kano State and Abia State as null and void.

Without appreciating that, Plaintiff lacked the locus standi to institute and seek such a relief.

PARTICULARS
By section 84(14) of the Electoral Act, 2022 and section 285(14) of the 1999 Constitution, only a person who participated in the primary election of a political party can question the emergence of the candidate of the party;

Plaintiff did not participate in the primaries elections conducted in Abia State and other states of the federation; and

Having not participated in the primaries elections, conducted by the 1st Respondent in Abia State and all other states of the federation, Plaintiff lacked the locus standi to seek the reliefs he made to the court below.

GROUND 4
The learned trial judge erred in law and wrongly assumed jurisdiction over the claim of the Plaintiff which touches on an internal affairs of a political party.

PARTICULARS
The question of computation of names of members of a political party and the maintenance of membership register is an internal affairs of a political party; and

Plaintiff’s case in so far as it is predicated on register of members of Labour Party (1st Respondent) is an intra-party affairs for which court lacks jurisdiction to look into

GROUND FIVE
The learned trial judge erred in law in granting declaratory and injunctive reliefs against non-parties, who have acquired vested right, without joining them and thereby acted in excess of its jurisdiction and rendered the proceeding/judgment a nullity.

PARTICULARS
By Plaintiff’s showing, candidates of the 1st Respondent (Labour Party) contested and won elections and were issued with certificate of returns;

The success of candidates of the 1st Respondent who had been issued with certificates of return created a vested right in favour of each of the candidates of the 1st Respondent;

None of the candidates of the 1st Respondent who won election and issued with certificate of return was made a party to the proceeding;

Plaintiff’s claim seeking to void the success of candidates of the 1st Respondent’s candidate is incompetent for failure to make the said candidates parties to the proceeding;

Trial judge acted without jurisdiction in granting the claim of the Plaintiff which affected the interest of the successful candidates of the 1st Respondent who were not made parties to the proceeding; and

The order of the trial judge voiding the votes of the candidates of the 1st Respondent as wasted votes, without joining the said candidates as parties to the proceeding is a nullity.

GROUND SIX
The learned trial judge erred in law in assuming jurisdiction over the claim of the Plaintiff as constituted, without appreciating the fact that all necessary parties against whom reliefs were sought, are not before the court, which error has impugned on the circumscribed jurisdiction of the court, thereby rendering the decision of the trial court a nullity.

PARTICULARS
Necessary parties must be present before the court to enable the court exercise jurisdiction on the matter before it;

Failure to joinder the Appellant, against whom positive orders were granted and/or made; rendered the entire proceedings incompetent;

In the absence of necessary parties the court lacks jurisdiction to adjudicate on the case; and

The decision has occasioned a grave miscarriage of justice

GROUND SEVEN
The learned trial judge erred in law when his lordship granted the Plaintiff’s claim and held that 1st Defendant has carried on with the activities in the selection of its candidate for the general election in a manner that is at variance with the mandatory provision of the Electoral Act, 2022 which renders its participation in the general elections of 2023 in Kano and Abia States as null and void without considering and appreciating the overriding effect of sections 65, 66, 106, 107, 131, 137, 177 and 182 of the 1999 Constitution of the Federal Republic of Nigeria which had covered the field regarding the qualifying and disqualifying factors for participation in a general election and thereby came to a wrong conclusion which has occasioned a grave miscarriage of justice.

PARTICULARS
It is the 1999 Constitution of the Federal Republic of Nigeria that provides for qualifying and disqualifying factors to elective posts created by the 1999 constitution;

Any other qualifying and disqualifying factor outside the 1999 Constitution is null and void;

Section 77(3) of the Electoral Act, 2022 cannot operate to impose additional qualifying or disqualifying factors to elective offices created by the 1999 constitution of the Federal Republic of Nigeria; and

Section 77(3) of the Electoral Act, 2022 in so far as it purports to introduce additional qualifying factors for election into elective position is at variance with the 1999 Constitution of the Federal republic of Nigeria and therefore null and void by virtue of section 1(3) of the 1999 Constitution of the Federal Republic of Nigeria.

GROUND EIGHT
The learned trial judge erred in law when it assumed jurisdiction over the claim of the Plaintiff, as constituted, when on the face of the originating summons and the Defendants endorsed thereon, the Federal High Court Kano lacks the territorial jurisdiction to entertain and determine the claim and thereby came to a wrong decision which has occasioned a grave miscarriage of justice.

PARTICULARS
Federal High Court is divided into judicial division for administrative purposes;

Federal High Court Kano judicial division cannot entertain a complaint affecting activities of the 1st Respondent in each of the other states of the federation; and

Plaintiff rushing to file his action at the Kano judicial division on a claim affecting other states of the Federation is forum shopping and an abuse of court process.

GROUND NINE
The learned trial judge erred in law in interpreting section 77(2)(3) of the Electoral Act, as a basis of disqualifying the 1st Respondent’s candidate for participating in the general election without due regard for the Appellate court’s decision in APM vs. INEC (UNREPORTED) APPEAL NO: CA/ABJ/CV/1414/2022 delivered on 8/2/2023 – which had earlier held that section 77 of the Electoral Act is not a ground for qualification or disqualification for an election and thereby came to a wrong conclusion/decision which has occasioned a grave miscarriage of justice.

PARTICULARS
The case of ALLIED PEOPLES MOVEMENT vs. INDEPENDENT NATIONAL ELECTORAL COMMISSION (SUPRA) is relevant and applicable to the instant action;

The Court of Appeal in ALLIED PEOPLES MOVEMENT vs. INDEPENDENT NATIONAL ELECTORAL COMMISSION (SUPRA) held at page 70 of the judgment as follows:

“The words employed in section 29(1) and 77(2) and (3) of the Electoral Act, 2022, which I have reproduced above are clear, plain and unambiguous. Effect is therefore to be given to the literal, ordinary and plain meaning of the words used, moreso, when doing so would not lead to absurdity. It is instructive that the said provisions do not deal with the qualification or disqualification for a candidate for election”

The Court of Appeal in the above stated case further held that:

“The Appellant seeks to import and read into the said constitutional requirement what is not provided therein by harvesting from section 77(3) of the Electoral Act, 2022, a qualification requirement that is not in the constitution.”

By the doctrine of stare decisis, the lower court was bound to follow the decision of the Appellate court in construing and interpreting a provision of statute;

Trial court failed to follow the decision of the Court of Appeal in breach of the doctrine of stare decisis

GROUND TEN
The learned trial judge erred in law and acted without jurisdiction to void the victory and return of the candidates of the 1st Respondent at the general election of 25th February and 18th March, 2023 when it is not vested with jurisdiction to entertain Plaintiff’s claim which is a nullity.

PARTICULARS
A court cannot exercise judicial powers on matters outside its jurisdiction;

By section 285 of the 1999 Constitution of the Federal Republic of Nigeria, only an election tribunal can question victory and certificate of return issued to a candidate who won an election;

Trial judge by its decision exercised jurisdiction over a complaint meant for an election tribunal; and

Decision of the trial court is a nullity

4. RELIEFS SOUGHT FROM THE COURT OF APPEAL:
An Order allowing the Appeal;

An order striking out and/or dismissing the Plaintiff’s originating summons;

An Order setting aside the decision of the Federal High Court, Kano; and

Such further or other orders as this Honourable Court may deem fit in the circumstances in favour of the Appellant herein.

ABIA GUBER 2023: PROF IBE DECLARES INTEREST!!

The Chancellor of Gregory University Uturu Prof Gregory Ibe has formally announced his intention to contest the governorship election of Abia state in 2023. Prof Ibe made the declaration during a consultation meeting with officials of Isuikwuato Local Government Council chapter of the Peoples Democratic Party (PDP).
• Addressing PDP members from the 10 wards of the LGA, Prof Ibe recalled his earlier declaration and subsequent procurement of the statutory expression of interest form in 2014, stating that he was then advised to step down in respect of the party zoning arrangement which favored emergence of a governor from Abia South Senatorial District.
In his words, “You will recall that I was prepared to contest the 2015 governorship election and had already produced a detailed manifesto blueprint for the exercise, set up political structures round the state, procured branded vehicles and even purchased the expression of interest form from Wadata House before I was advised to step down based on the decision of Abia Elders Council to implement the Charter of Equity by zoning governorship to Abia South Senatorial District. I was subsequently counselled to wait till 2023 when it will be the turn of Abia North”.
Subsequently, he stated that he has since 2015 committed himself to supporting governments at all levels and the PDP by creating social welfare packages for the people while fine tuning his manifesto blueprint for 2023, asserting without equivocation that he is now more prepared for the crucial race than before. According to Prof Ibe,” As a loyal stakeholder of the party, I have since the developments of 2014 sustained partnership with the structures of PDP, proactively supported every initiative of the state government as a corporate citizen while building and enlarging capacity to do the party and the people of Abia proud in the office of governor come 2023. Leveraging my extensive knowledge of political power dynamics, vast background in the world of corporate business, diplomatic skills acquired while consulting with international bodies and relevant experience garnered from being the largest private investor in our state, I consider myself sufficiently prepared by God to run for the seat of Governor of Abia. Umunnem, if the politics of 2023 must reflect the lessons learnt from the economic recession, COVID-19 and EndSARS protests, then we need someone who not only comes from the right political zone but a governor that can can think outside the box, innovate and reinvent the state. I believe that I tick all the boxes right. And having thus declared this intention at my ward today, I will subsequently embark on state wide consultation visits to enlist the support and partnership of other stakeholders towards actualizing the project”.
Responding the chairman of Achara Mbaugwu Ward 7 Hon. Chief Cyprain Obite congratulated Prof Ibe for his decision to offer himself to serve the state at the highest level of governance. He recalled that “Prof Ibe as a foundation member of the party has continued to offer different levels of assistance to the ward especially at critical times”. He therefore promised the partnership of the ward executive in realizing the vision.
Also speaking the chairman of Isuikwuato chapter of PDP Hon Charles Emenike appreciated Prof Ibe for keeping faith with the party through thick and thin, assuring that his gesture will be reciprocated at the right time. He promised to transmit news about Prof Ibe’s declaration to the party hierarchy. Correspondents report that the event which was witnessed by officials from the 10 electoral wards of Isuikwuato LGA also featured solidarity songs and a session of intercessory prayers.

EXIT OF A COLOSSUS.

The remains of Late Hon. High Chief Prince Ndu Nwanke ( former Chief of staff to the Asepa Chairman Aba Zone) was laid to rest today at his country home, Umunkiri in Obingwa LGA, Abia State.

The funeral service held by the Anglican Church was led by the Bishop of Aba Diocese, Rt Rev. Christain Chiozoadighi Ugwuzor.

In attendance were high profiled dignitaries like ; Sen. Enyi Abaribe, Rt Hon Rowland Nwakanma, Rt Hon Eziuche Ubani, Hon Chief Hanson Amaechi Sunday ( Abacha), Hon Kingsley Nnaji, Elder Obioma Nna, Hon Seth Agomuo, Chief Rowland Nwosu, Hon Iyke Aaron and other respected people too numerous to mention.

May his gentle soul rest in peace. Amen.

Abia to Establish Business School as Ikpeazu Advocates Sustenance of Igbo Apprenticeship System

Governor of Abia State, Dr Okezie Ikpeazu has announced that Aba Business School will soon be established to groom younger Igbo entrepreneurs.

The Governor stated this while speaking at the Aba Business and Leadership Summit and Awards 2021 which held at the Aba Sports Club with the theme: "Transferring Tested and Proven Business Models to the Next Generation".

The Governor also announced that the lingua franca at the school will be the Igbo Language while the instructors would be successful Igbo businessmen and women who have excelled in their various endeavours.

Governor Ikpeazu who noted that no country has developed in science and technology without their Mother Tongue, made a case for the sustenance of the Igbo apprenticeship system which he said is better than what is being taught at the Harvard Business School, and maintained that the Igbo apprenticeship system offers great insight into successful business concepts including teaching alternatives, packaging and repackaging, storage and warehousing, ethics of business as well as corporate social responsibility among others.

He said that the essence of the Summit was to see how best to reignite interest of young people in job and wealth creation, advising that any attempt to break the chain of teaching and mentoring them including their understudying business ventures will be jeopardizing the future of Ndigbo.

In a keynote speech, a former Governor of Anambra State, Mr Peter Obi identified lack of mentorship in the family, lack of proper corporate governance and structure and improper fiscal policy to support businesses as some of the factors militating against sustenance of businesses in Nigeria.

He also attributed the collapse of businesses in the country to a lack of patronage of indigenous goods and stressed the need for "the right things to be done".

On his part, the President, Coscharis Group, Dr Cosmas Maduka advocated for the Igbo apprenticeship system of mentorship for the younger generation, adding that willingness and desire to brave the odds are some of the attributes needed for one to be successful in business.

Earlier in his welcome address, the Director General, Abia State Marketing and Quality Control Agency, Mr Sam Hart said that efficient structure for continuity is key for the growth and sustenance of a business enterprise, adding that the summit was put together to chart a way forward for the sustainability of businesses in Aba, the economic hub of the South East.

He also identified some of the factors affecting the growth and sustenance of businesses to include refusal of business owners to submit to equity, nepotism and a lack of well planned business structure.

In their separate speeches, the President, Aba Chamber of Commerce, Industry, Mines and Agriculture, Sir Lawrence Obetta, and the Chairman, Aba Sports Club, Chief Jerry Kalu noted that succession plan is equally key to achieving a sustainable business establishment, ensure economic growth and improve the GDP of the state. They appreciated Governor Okezie Ikpeazu for his robust policies that have improved ease of doing business in the state.

The summit featured panel discussion session on the theme, "Pathway to Trans-Generational Wealth Transfer (Aba as a Case Study), by eminent Nigerians including Ide John Udeagbala of NACCIMA, Darl Uzu, CEO, Crown Realtors/Enyimba Economic City, Professor Barth Nnaji, President, Geometric Power, Professor Pat Utomi of Lagos Business School, Sir Lawrence Obetta, Chief Mrs Stella Igbokwe and moderated by Mrs Nana Nwachukwu, a development expert, where they advised that the younger generation be taught how to stand firm in the face of adversity.

Professor Barth Nnaji while speaking extensively on the Geometric Power Project in Aba, assured that with the support and untiring efforts of Governor Okezie Ikpeazu the project will be fully functional before the end of this year.

MOUAU ARE OUR PARTNERS IN PROGRESS

Governor Okezie Ikpeazu says that the Abia State Government will sustain its partnership with the Micheal Okpara University of Agriculture, Umudike in working towards creating a more robust economy for the grassroots with women and youth inclusion in focus.

Governor Okezie Ikpeazu stated this while receiving a delegation of the
Vice-Chancellor of Michael Okpara University of Agriculture, Umudike, Professor Maduebibisi Iwe and his management team who called on him in Government House, Umuahia. He said, it is as a result that the administration is bent on setting up agro-based cottage industries in the 17 LGAs, especially in the areas of palm kernel oil processing, cassava processing and rice milling. According to him, 6 LGAs have been selected for the pilot scheme which would soon take off, while equipment for the industries have since arrived the State from India.

Governor Ikpeazu said that the State government will be open to partnership with the University to see how to do reverse engineering on the possibility of fabricating and producing agro-equipment,such as the ones imported from India. He noted that the greatest challenge of the Nigerian Universities is how to bridge the gap between research findings and actual inventions to put them to every day use.

The Governor said his government will be willing to support the patronage of the inventions of MOUA as the State yearns for economic development. He also assured that government will give Visitation Panel the enabling environment to do their job. He congratulated the new management team of the university and directed the SSG to take up the issue of the Certificate of Occupancy of the school which they said has been outstanding while commiserating with them on the loss of the former Vice- Chancellor, Late Professor Otunta.

Earlier, the Vice-Chancellor of Michael Okpara University of Agriculture, Umudike, Professor Maduebibisi Iwe said the visit was to present himself as the 6th Vice-Chancellor of the University, his management as well as presenting the Presidential Visitation Panel of the school to the Governor. He requested the Governor to continue to extend his goodwill to the school as it is the only specialized university of its kind in the South East and South South area.

He thanked the Governor for his encouragement and support that led to his emergence as the new Vice-Chancellor and expressed their readiness to partner with the State in the area of agriculture. He reminded him that the land alloted to the University since 1994 has not been properly documented by the State.

Contributing, the Chairman of the Visitation Panel, Professor Suleman Adeyemi said, the purpose of constituting the Visitation Panel by Mr. President, is to review performance of the university in governance, academic standard, management of finances, staff and students relationships among others. He said, one issue of concern for the institution is land and appealed to the Governor to look into non issue of C of O to the University as well as encroachment of the university land by unauthorized people.

Bende Youths Set to Honor Hon. Nnenna Elendu Ukeje (ADA BENDE).

To Hold Grand Civic Reception in her Honor come Wednesday May 12th 2021.

Bende Youths under the aegies of Bende Youth Forum in Conjunction with Abia Democratic Initiative is set to host the homecoming and Grand Civic Reception in Honor of Hon. Nnenna Elendu Ukeje (ADA BENDE).

The event which will hold on the 12th of May 2021 at Bende Local Government Headquarters Stadium in Bende is inline with the tradition of Bende people to Honour and Celebrate her illustrious Sons and Daughters who has distinguished themselves in all Spheres of Life.

Bende Youths under the aegies of BENDE YOUTH FORUM found Hon. Nnenna Elendu Ukeje worthy and deserving of this Honour.

Special Guest of Honour to the event is the Executive Governor of Abia State Dr. Okezie Victor Ikpeazu.

The Deputy Governor of Abia State Rt.Hon. Sir Ude Oko Chukwu, the Speaker, Abia State House of Assembly Rt.Hon. Chinedum Enyinnaya Orji, the Senator Representing Abia Central Senatorial District at the National Assembly Senator Theodore Ahamefula Orji.
