Parti Warisan legal advisor Chin Tek Ming today queried National Registration Department on whether there is a proposal to do away the learned First Class Magistrate’s power to hold a proceeding in order to decide the genuinity of the ‘Late Registration’ for person born in Sabah who did not register within 42 days after birth.

‘It is clearly stated in our Registration of Births and Death Ordinance (Sabah Cap.123), in particular, section 22 (2) that every entry of birth made after the expiration of 42 days after birth and every entry of death made after the expiration of 10 days after such death shall be marked clearly as a “LATE REGISTRATION”…’ Chin quoted.

Chin added that in section 22 (3), it is mandatory that every late registration’s entry shall have a conspicuous printing of the words “LATE REGISTRATION” on the entry of the birth certificate. It is also encumberred upon the First Class Magistrate to hold a proceeding to hear and to receive evidences in order to verify the genuinity and authenticity of the application by the interested party. Only when the First Class Magistrate is satisfied with the truth of the facts then the finding can be certified and entered in the register.

‘There is no other similar provisions in any other part of Malaysia regarding this mode and manner of late registration that empowered our Magistrate Courts to be directly involve in eliminating the bogus late registration application by non-deserving individual. This is the law that presently enforceable in such matter that cannot be compromised. ’

‘If the National Registration Department is to take away this power from the Magistrate Court, then it will be a disaster to Sabah state. We must remember that bogus identity cards have always been a gigantic problem in Sabah since the project IC era. To the extend that the then Yang Di-Pertuan Agong had to appoint the Royal Commission of Inquiry on illegal immigrants in Sabah on 6 September 2012 and the public hearing commenced on 14 January 2013 and ended in mid September 2013.’ Chin said.

‘There is no necessity to adopt any law even if its from our neighbouring state of Sarawak, because unlike Sabah, Sarawak does not have much issue on illegal immigrants. I believe that in Kota Kinabalu alone, the late registration would easily be around 10,000 applications. Just maintain the existing section 22 (3) of our own Ordinance to let us preserve our own sovereignty’

‘Irrespective of one’s political affiliation, one must never compromised and give away this power. I urge the Chief Minister to look into this matter seriously.’ Chin concluded.

（亚庇11日讯）民兴党法律顾问陈德明律师今日质问国民登记局是否有意废除一级推事在本州行使的“延迟登记”核实权，特别是针对在本州出生但未在出生后42天内登记的个案。

陈德明援引出生和死亡登记条例（沙巴第123章）第22(2)条文,明确规定所有在出生42天后才登记的出生，以及在死亡10天后才登记的死亡，都应清楚标注为‘延迟登记’。

他解释，第22(3)条文规定，所有延迟登记的出生证明上必须显著标明“延迟登记”。

“一级推事有义务举行听证会，并收集相关证据，以核实申请的真实性。只有在推事对事实满意的情况下，相关调查结果才能被认证并登记在案。”

“在马来西亚的其他地方，没有类似沙巴的法律程序，允许推事法庭直接参与防止虚假延迟登记申请，这也是现行法律中的不可妥协之处。”

陈德明表示，如果国民登记局剥夺推事法庭的上述权力，将对本州造成严重影响。

他强调，自身份证计划以来，假身份证问题在沙巴一直是个大难题。

“正因如此，2012年9月6日，当时的最高元首委任皇家调查委员会调查本州的非法移民问题，并于2013年1月14日启动公开听证会，直到2013年9月中旬结束。”

“我们不需要其他法律的介入，即使是邻州砂拉越的法律,砂拉越没有像沙巴一样严重的非法移民问题,而在亚庇，仅逾期登记申请就可能多达一万份。”

因此,他敦促保留本州法令中的第22(3)条文，这样才能维护本州的主权。

“无论政治立场如何，这项权力都不容妥协或放弃,我呼吁首席部长对这個问题进行严肃调查。”

PENAMPANG - Mangsa, Monica Ting Siew Kwong, 37, ditemui di celah pokok berhampiran rumah penduduk pada kira-kira jam 8 pagi tadi di Kampung Hungab, di sini, kira-kira 500 meter dari lokasi dia dihanyutkan arus deras.

Terdahulu, seorang wanita dikhuatiri lemas dihanyutkan arus deras ketika mengharungi banjir selepas menghantar makanan kepada mangsa terperangkap dalam banjir, dekat pekan Donggongon, di sini, awal pagi tadi.

Dalam kejadian 1.40 pagi itu, mangsa bersama suaminya dikatakan menghantar makanan kepada mangsa lain yang terperangkap akibat banjir, sebelum pulang.

Bagaimanapun, difahamkan, ketika cuba melalui kawasan banjir berhampiran Bulatan Sigah, Jalan Penampang Bypass, di sini, mangsa dikatakan dihanyutkan arus deras.

Suaminya cuba membantu dengan menarik tangan mangsa, namun arus banjir yang sangat kuat menyebabkan mangsa hanyut.
