----Filed Judge Complaint Before Supreme Court

The Government of Liberia through its state prosecutors has filed with the Supreme Court Justice in chambers Yamie Quiqui Gbeisay a legal complaint against Judge A. Blamo Dixon of Criminal Court "C" accusing the judge of being biased in handling a landmark corruption case involving five high profile government officials of former President George Weah.

State prosecutors in a petition for the issuance of the Writ of Certiorari against Judge Dixon said the Judge manifested bias in handling the case when he granted bail to the former government officials on personal recognizance, although the ex-officials did not make an application, it was evident that the criminal appearance bonds as filed were defective and did not meet the requirements of law.

The defendants in the case include Samuel Tweah, Former Minister of Finance
and Development Planning, Cllr. Nyenati Tuan, Former Acting Minister of Justice, Stanley S. Ford, Former Director of the Financial Intelligence Agency, D. Moses P. Cooper, former comptroller of the Financial Intelligence Agency, and Jefferson Karmon, former national security advisor

The former officials are accused of the commission of the crimes of Economic Sabotage, Misuse of Public Money and/or Record, Illegal Disbursement of Public Money, Theft of Property, Criminal Facilitation, and Criminal Conspiracy by the Republic of Liberia through the Ministry of Justice.

The officials individually filed various bonds using properties that did not meet
the statutory requirements. The state said, in keeping with the law, it filed an exception to the validity of each of the various property bonds that were filed by the defendants. The defendants in response to Petitioner's Exception to their bonds, filed a motion to justify their bonds.

On the scheduled day for the hearing of the justification of the bonds filed for and on behalf of the defendants, after representation of the parties was announced, the respondent surety was sworn and put on the witness stand, where he testified on direct examination that the properties he proffered into bonds for the Movants/Defendants were given to him by the owners of said properties to apply them for the purpose of bond as he may deem fit, as has been applied for the surety for the defendants.

He testified further that the monetary value as inscribed in the various title deeds of the proffered bonds were genuine and authentic in fact and law; emphasizing that the government of Liberia was aware of their existence by means of the probation, registration and tax payments done for the properties to LRA.

The jury of Criminal Court 'A' on Tuesday came down with a not guilty verdict infavor of Q-Net Independent Representative Yaccuba Sawadogo for allege human trafficking.
The jury arrived at the decision in a 11-1 vote, after hours of closed door deliberation.

Amin Modad, the Minister of Commerce, who was implicated to controversy surrounding the purchase of a luxury vehicle with a market value of over US$96,000 has officially resigned from the ruling Unity Party (UP) headed by President Joseph Boakai.

In his resignation letter Modad, who is the former Chairman of the ruling Unity Party (UP) said, his decision was intended to ensure the integrity of the party remains paramount.

But, in accepting Modad’s resignation, President Boakai said, while Mr. Modad has contributed to the development of the Ministry during his tenure, the decision to make such a purchase at this time reflected poor judgment and a lack of sensitivity to the current economic environment in the country.

The President directed that the vehicle in question be transferred to the General Services Agency (GSA) for appropriate use in accommodating VIP guests of the government.

State's lawyers are making the first formal push to have Judge Blamo Dixon of Criminal Court 'C' overseeing former Finance Minister Samuel Tweah's US$8million property valuation bond case be recused and disqualified from the matter.

Their decision may have been raised after Judge Dixon recently rejected an effort by state lawyers to push for thorough review of the US$8million property valuation bond.

During the rejection, Dixon said, Tweah was out of the bailiwick of the Republic of Liberia and has just arrived in the country with his bond in the hands of his lawyers.

Dixon also said Tweah is entitled to remain silent and that any word spoken out of his mouth would be used against him in the Court of law.

The recusal decision, the prosecutors argue shows the judge "suggested that Tweah should not be imprisoned and the bond granted."

"Such statements, made before this case began and without due process, are inherently disqualifying," state prosecutors' said.

In one hearing on October 9, declined to hear prosecutors request for jurisdiction of the Tweah's bond.

State's lawyers raised concerns about the bond’s coverage, as Tweah’s criminal appearance bond is already being used as surety in another case involving a co-defendant.

Dixon, however explained that the rationale is that the Case involving Defendant Samuel D. Tweah, Jr. and the other co-defendants is not docketed for the August Term of Court, A. D. 2024.

“In other words, the Case is not on the Docket for the August Term of Court, A. D. 2024," Dixon clarified his action.

The question now arises that, if Judge Dixon’s explanation is anything to go by, then why did he first grant the bond with specific conditions, if the case was not docketed as he was claiming.

But Dixon said, it is worthy to note that the said Case was transferred from the First Judicial Circuit, Criminal Court ‘A’, Montserrado County, Republic of Liberia, to the Criminal Court ‘C’ on September 6, 2024, same being the 22nd Day Jury Sitting, about one month ago; but the Prosecution and the Defense Team failed to file a Motion to Advance the Case on the Docket for the August Term of Court, A. D. 2024.

“Therefore, the Case is not docketed for the August Term of Court, A. D. 2024,” Dixon emphasized.

“To sum up, the August Term of Court, A. D. 2024 closed for transaction of Business on September 30, 2024; same being the 42nd Day’s Jury sitting.

“”That is to say, the Judge is out of Term, Time, or his Assignment to preside over the Criminal Court ‘C’ has expired, pending new Assignment from the Chief Justice of the Honorable Supreme Court of Liberia,” Dixon said.

“The Closing Chambers Session of the Court, which is only for Ten (10) Days, commenced on Tuesday, October 1, 2024. The Court has already exhausted eight Days, with two days remaining to the Closing Chambers Session of the Court and the entire August Term of Court,” emphasized Dixon.

Dixon said, the stage that the Case is on now does not fall in the category of Cases that require appealing to the Chief Justice of the Honorable Supreme Court of Liberia for Extension of time. According to the judge, the Case is a new Case.

He explained that the Indictment was drawn up on September 5, 2024 by the Grand Jury of Montserrado County, Republic of Liberia, sitting in its August Term, A. D. 2024.

“The Court is poised to have the Case docketed for the November Term of Court, A.D.2024; in the absence of the Motion to Advance the said Case on the Docket for the August Term of Court, A. D. 2024,” he emphasized, adding: “The filing of such motion is late and moot. The November Term of Court, A. D. 2024 shall commence on November 11, 2024. In conclusion, the Clerk of Court is hereby ordered to have the said Case docketed for the November Term of Court, A. D. 2024.

Besides Cllr. Barbu, who is the former Chairman of the Law Reform Commission, Cllr Boakai Kanneh, the Verdier brothers, Counsellors James and Jerome and Ms. Massa Washington are all in the running for the influential post, according to a source closed to the committee.

The vetting process began on Thursday, October 9, by the President Joseph Boakai’s committee constituted to recruit and select three qualify candidates for appointment of the Executive Director.
