to Receive their After Recapturing Rights. The U.S. Copyright Office has updated the rules for "termination rights" under the Music Modernization Act (MMA). This affects how mechanical licensing payouts are handled. The new rule, published after nearly two years of discussion, aims to clarify how royalties are distributed when a songwriter regains rights to their work after 35 years.
Under the new rule, royalties from streaming services like Spotify will go to the current copyright owner, even if the rights were recaptured. The Mechanical Licensing Collective (MLC) must assume the listed royalty recipient is correct and pay them accordingly, but this does not determine the final legal right to the royalties.
