The University of Bologna Law Review welcomes applications for its for associate editors from students enrolled at the University of Bologna.🎓

👩🏻‍💻The admission process is composed of an interview with two Editors from the Human Resources and Welfare team, to get to know the candidate better both from a motivational and a linguistic point of view.
The purpose of this interview is to evaluate the candidate's compatibility with the University of Bologna Law Review.

Effective Recognition and Protection of Non-Binary Gender Identities in the Council of Europe Framework: a Critical Analysis of Third Gender Marker Options From a Human Rights Law Standpoint by Elias Tissandier-Nasom, PhD candidate at Leiden University (Netherlands).

🏳️‍⚧️Non-Binary gender identity is slowly growing in visibility across the globe. In at least seven Member States of the Council of Europe, some judicial, administrative or legislative bodies have already started organising a form of legal recognition for gender identities outside of the binary through the creation of “third” gender categories and “X” gender markers.

🆕[New contribution] The Problem with the Global Notion of “Environmental Sustainability” by MARTIN KWAN, an Honorary Fellow at the University of Hong Kong’s Asian Institute of International Financial Law (China), an Associate at the Monash Business School’s Centre for Development Economics and Sustainability (Australia), and an Affiliate at the Center for Information, Technology, and Public Life, University of North Carolina at Chapel Hill (U.S.A.). He was selected as a United Nations RAF Fellow in 2021, and as an Associate in Research at the Fairbank Center for Chinese Studies at Harvard University (U.S.A.) in 2022.

♻️ This article reflects on the international notion of environmental “sustainability” from the normative perspective. As a norm, it has been commonly analogised to “justice” — meaning the failure to uphold such would constitute a “wrong”. At its face value, this positive understanding should be welcomed as it signals and promotes the importance of sustainability. However, this article takes the role of the Devil’s advocate and argues that this analogy does more harm than good. It has over-glorified the notion of environmental sustainability because injustice is — at least in theory — an absolute wrong in all circumstances, but unsustainability is not.

❓Is the public being increasingly instilled with the normative idea that unsustainability is wrong? Or are unsustainable acts not necessarily outlawed, and may even be endorsed?

📌After the 2008 crisis, banks are increasingly investing in bank ratings by applying algorithmic techniques to improve the creditworthiness of customers: algorithmic credit scoring is now a reality.

Against this background, the European regulator and supervisory authorities are asking banks to adopt profiling methods that are both efficient and legitimate in terms of data processing, but they have not yet identified clear and definite legislation.

What are the advantages resulting from the use of Artificial Intelligence automation tools in creditworthiness assessment for the various stakeholders involved?
What could be the critical aspects regarding the involvement of algorithmic systems in credit scoring that should be addressed? And finally, what could be a possible preventive solution to mitigate such risks?

Since the dawn of the era inaugurated by the 2006 Global Europe communication, the European Union (E.U.) has emerged as a key international actor in the negotiation and conclusion of
ambitious New Generation Free Trade Agreements (N.G.F.T.A.s), striking to counterbalance commercial liberalization also with the enhancement of environmental safeguard.

🧐Interestingly, the latter represents for the Union not merely a policy goal, but a core normative target embedded in the founding treaties. A rationale which has thus been transposed to N.G.F.T.A.s by means of ad hoc Trade and Sustainable Development (T.S.D.) Chapters - including given green clauses dedicated to a vast array of eco-related domains. Nonetheless, ambiguities continue to subsist with regard to the enforcement phase of the present Chapters, having been at the center of an intense debate.

♻️Against the illustrated backdrop, this article is to focus on the major deficiencies characterizing green clauses’ enforceability both from an upstream and a downstream perspective.

🇪🇺First, the identified pillar environmental provisions will be assessed in their semantic formulation. Secondly, attention will be paid to the specialis, non-confrontational, approach to dispute settlement provided for by T.S.D. Chapters, disregarding reliance on countermeasures in the case of non-compliance. In order to introduce innovative inputs to the research, relevance is to be conferred to the E.U. political guidelines for T.S.D. Chapters announced by the June 2022 Power of Trade Partnerships communication.

📝Whereas it will be ultimately demonstrated that the latter document has managed to open the door to a novel season for N.G.F.T.A.s’ environmental enforcement. It is believed that further room for normative clarification seems to be appropriate.

🏦The European Central Bank anticipates including a holding limit of about € 3,000 per user within the design of its potential retail central bank for the Eurozone, the digital euro. This is principally motivated by concerns regarding compliance with regulations related to anti-money laundering and countering the financing of terrorism and the disintermediation of as credit intermediaries.
