SSHFC Hosts Grand Annual General Meeting

On Thursday, April 24th, 2024, the Social Security and Housing Finance Corporation (SSHFC) convened a spectacular Annual General Meeting at the Paradise Suite Hotel in Senegambia.

The event brought together representatives from both public and private institutions, notably members of the Federated Pension Scheme and the National Provident Fund.

During this gathering, elections were successfully conducted for representatives of the Federated Pension Scheme, National Provident Fund, and Pensioners on the SSHFC Board. Additionally, twenty distinguished institutions were honoured with awards for exemplary compliance in employee contribution payments throughout 2023, in adherence to the SSHFC 2015 Act.

Mr. Oreme Joiner, the seasoned Chairman of the SSHFC Board, warmly welcomed delegates, with support from fellow Board Members. In his address, Chairman Joiner emphasized the corporation's commitment to governance initiatives aimed at efficiently addressing stakeholders' expectations, needs, and requirements.

He informed the members that the Corporation has witnessed a noteworthy uptick, with membersโ€™ funds growing from D7.8 billion in 2022 to D8.3 billion in 2023, representing a commendable percentage growth of 6.4%. He also indicated that in line with its oversight function, the Corporation has significantly reduced staff costs.

"We are pleased to report significant progress in our endeavour to reduce staff costs, achieving a notable 26% reduction to date. This achievement underscores our dedication to maximizing value for our members while ensuring the sustainability of our operations."

He stated that SSHFC has achieved key milestones with the launch of its Strategic Plan 2022-2026, outlining impactful strategies for sustainable growth. Additionally, the recent validation of the Amended SSHFC Act 2015 reflects their commitment to compliance and governance. The Corporation also implement numerous policy documents and others are in an advanced state for implementation.

Additionally, the completion of the 2023 Financial Audits demonstrates the Corporationโ€™s commitment to financial probity and transparency making SSHFC among the few parastatals that have accomplished their 2023 Financial Audit.

The Chairman stated that the Board fully supports Management in the implementation of the Social Security Management Information System (SSMIS), a cutting-edge computerized system that enhances operational efficiency and member services. This system integrates all related subsystems and features a dedicated user portal for 24/7 member access, aligning with the commitment to meet evolving needs in the digital era.

"The SSMIS will revolutionize member interactions by enabling instant access to contribution and mortgage statements and related services, offering unmatched convenience and flexibility," he added.

The Chairman further that with the support of the Board. The Corporation is preparing the grounds to offer social security services to the informal sector which forms the bulk of the Gambia workforce.

The Managing Director of the Social Security and Housing Finance Corporation commenced the presentation by providing members with a comprehensive overview of the Corporation's background, highlighting key amendments to the SSHFC Act that define its mandate and operations. This informative session shed light on the regulatory framework shaping the corporation's activities, underscoring the importance of legislative compliance in fulfilling its mission and responsibilities.

The Managing Director's address resonated as a testament to the corporation's commitment to transparency and governance, setting a tone of informed engagement and strategic vision for stakeholders.

"In 2023, contributions from members of the Federated Pension Scheme reached D321,321,000, representing a notable 4.63% increase from the previous year. This growth underscores the continued commitment of scheme members towards securing their retirement futures,".

Additionally, the National Provident Fund recorded contributions totalling D424,882,000 during the same period, highlighting the significant financial support provided by participants in this essential fund.

These contributions not only reflect the dedication of individuals towards their long-term financial well-being but also contribute to the overall strength and sustainability of social security initiatives within the nation. The steady growth in contributions speaks volumes about the confidence and engagement of citizens in securing their future welfare.

In 2023, the Social Security and Housing Finance Corporation (SSHFC) disbursed significant benefits to members of its Federated Pension Scheme and National Provident Fund. According to the Managing Director, a total of D242,819,000 was paid out to members of the Federated Pension Scheme during the year. Additionally, D140,461,000 in benefits was distributed to members of the National Provident Fund for the same period.

The Managing Director of the Social Security and Housing Finance Corporation (SSHFC) emphasized the organization's commitment to leveraging technology for enhanced member services. Under the new IT system, member registration will transition to a remote process through the member interface, streamlining accessibility and convenience.

Furthermore, the IT overhaul will facilitate online account maintenance, allowing for seamless payments and remittance scheduling. Claim processing and benefit payments are set to undergo significant improvement, to reduce processing time from 30 days to under 10 working days, ensuring timelier disbursement of benefits to members.

In a move towards digital transformation, members will have access to their statements online via the member portal, marking a shift towards efficient and paperless statement production. These advancements underscore SSHFC's dedication to modernizing operations and providing members with efficient, user-friendly services in line with evolving technological trends.

The Managing Director of SSHFC discussed plans to extend social protection to the informal sector cautiously. Effective strategies and implementation frameworks were deliberated to ensure successful entry into this sector, aiming to provide vital social security to a broader population segment. This initiative underscores SSHFC's commitment to inclusive social protection and addressing evolving societal needs.

Board Members Election. The Independent Electoral Commission (IEC) oversaw the elections for representatives of the National Provident Fund (NPF), Federated Pension Scheme (FPS), and Pensioners' Representative on the SSHFC Board during the event. Mr Abubacarr Darbo, Memunatu J. Camara, and Mr Alhagi Alieu Faal were all re-elected to the position of Federated Pension Scheme, National Provident Fund, and Pensioners Representative respectively unopposed as no opposing candidates contested these positions against them.

The Corporation recognized and awarded the top twenty most compliant institutions of 2023 for their exemplary adherence to employee contribution payments, as stipulated by the Social Security and Housing Finance Act of 2023.

These awards highlight SSHFC's commitment to promoting and rewarding best practices in compliance with social security regulations among institutions. By honouring these compliant organizations, SSHFC encourages industry-wide accountability and responsible practices in fulfilling employee contribution obligations.

Comium Officially Launches Affordable 4G+ Network in the County.

Comium officially launched its highly anticipated 4G+ service for commercial use in a press conference with journalists. The service had been under testing, with customers using it for the past three months for free, and the feedback has been overwhelmingly positive, describing it as an affordable internet provider.

Abdoulie Drammeh, the ISP Director, informed the public that Comium is thrilled to announce the official launch of its 4G+ service, which is aimed at transforming the digital landscape for people in the county. He added that Comium is proud to enter the market with the primary objective of providing Gambians and residents with the most affordable 4G+ Network and a range of diverse offerings to meet the evolving needs of its customers.

Mr. Drammeh highlighted Comium's history, mentioning that the institution has faced challenges in the past, but this chapter was closed with the arrival of Monty Mobile, who took the management of Comium as an investor to upgrade its network and restore it to its former glory.

He further stated that Monty Mobile, a multi-million company headquartered in the United Kingdom and a telecom service provider operating in the Middle East, Europe, and Asia, is not a traditional mobile operator but has a culture of innovation and creativity.

Drammeh emphasized that Monty Mobile's culture of innovation brought them to the Gambia to transform Comium back to its former leading position in the county, adding that the transformation has been felt throughout the county with positive feedback.

Drammeh highlighted that throughout 2023, Monty Mobile has made significant investments in Comium's infrastructure and human resources, employing dozens of young Gambians in full-time positions. He further stated that under the management of Monty Mobile, Comium's network and data have been overhauled and replaced by state-of-the-art 4G+ and 5G networks.

He revealed that the 4G+ is the latest generation, and Comium has deployed 4G+ cell sites in the greater Banjul area and other parts of the country, with more sites on the way to ensure full coverage, delivering the best network at the most affordable rates.

Drammeh highlighted that with their slogan "We Are Better Together," Comium invited all Gambians and residents of the Gambia to participate in the testing phase of their new 4G+ Network, which began in May 2023, and the response was positive, allowing its customers to enjoy the service for free while providing constructive feedback for improvement.

Drammeh emphasized Comium's commitment to enhancing the digital experience for Gambians and residents and introducing many value-added services (VAS) in the coming months, ensuring a holistic and enriching telecommunications experience for its customers.

Finally, he thanked all the users for their support and welcomed them to the commercial phase after the testing phase, assuring them of the best and most affordable network. He extended gratitude to the Ministry of Digital Economy and PURA for providing an enabling environment.

Sarjo Khan, the Commercial Director, expressed gratitude to the population for embracing the new transformation of Comium and the milestone achievement in the world of telecommunications in the county. He highlighted significant developments in terms of access and coverage.

He indicated that Comium has shown that it is for the people, as per their slogan "We Are Better Together." He said in the past eight months, Gambians have experienced significant coverage of Comium's network, especially within the greater Banjul area, and the company will continue to roll out to increase accessibility and provide the most affordable services in the county.

He also stated that the management of Monty Mobile has indicated the direction Comium has taken, by coming up with affordable and accessible services, which he promised will continue.

Isatou G. Ceesay, the Commercial Manager, expressed that the milestone achievement had been long-awaited, and they are excited to announce the launch of 4G+ alongside the services and packages that accompany the new direction of Comium for the customers.

Setback in Kumba Sinyan Murder Trial Due to Defense Counsel's Absence

The murder trial involving Kumba Sinyan faced a setback due to the absence of the defense counsel. Sinyan has been charged with the murder of her boyfriend, Lamarana Jallow, by using a razor blade to cut his stomach, resulting in his death.

Today's proceeding was scheduled for the testimony of the medical doctor who conducted the postmortem examination on Lamarana's body, and he was present in court. When the case was called, Counsel Lamin Jarju and M. Sanyang appeared for the State, while the defense counsel for the accused was absent.

The presiding Judge, Justice Sidi K. Jobarteh, informed the state counsel about the receipt of a letter from the defense counsel informing the court that she is sick and unable to attend. Justice Jobarteh asked, "Have you received a letter from defense counsel stating that she is sick and unable to attend?."

In response, state counsel M. Sanyang confirmed, "Yes, I have received the letter, just now in court. I would like to inform the court that the witness is a very busy person, and difficult to get a hold of him. I wanted to bring this to the court's attention."

The presiding Judge then informed the state counsel, M. Sanyang, that the case is a murder trial, and it couldn't proceed in the absence of the defense counsel. She adjourned the case to the 18th of December 2023 at 14:00.

The letter from the defense counsel reads as follows:

"THE STATE VS. KUMBA SINYAN
I am writing to inform you that due to ill health, I am unable to appear in the above-mentioned case scheduled for hearing today, Wednesday, 13th of December, 2023 at 1:00 pm.

Therefore, I kindly request for the indulgence of this Honorable Court for an adjournment to a more convenient date. I apologize to the Court and the Prosecution for any inconvenience caused."

GTBoard Calls For Regularization Of Operational Licenses

The Gambia Tourism Board (GT Board) wishes to remind all proprietors and businesses operating within and outside the Tourism Development Area, including hotels, nightclubs, casinos, bars, restaurants, and other tourism-related establishments, to regularize their operational licenses with the GT Board. Failure to do so violates Part VII, Section 32 and 33 (1) & (2) of the GT Board Act, 2011.

Section 32 of the GT Board Act states that any hotel, nightclub, casino, or restaurant must obtain a license from the Board to operate legally, except for cases where the Board has issued a notice exempting certain premises or classes of premises from this requirement. Failure to comply with this licensing requirement may result in the Board invoking Section 48 of the GT Board Act.

Section 48 of the GT Board Act stipulates that any person who violates the provisions of this Act is guilty of an offence and upon conviction may be subject to a fine not exceeding fifty thousand dalasis.

To clarify the definitions outlined in the GT Board Act, 2011 and Regulations:

A "hotel" refers to any establishment used for accommodating guests or travellers, such as a guest house, rest house, tourist village, flat hotel, inn, or lodging house. However, certain premises listed in the First Schedule of the Act are excluded from this definition.

A "restaurant" refers to premises engaged in the business of selling food or beverages to the public.

A "casino" refers to any premises, including gaming houses, that are accessible to the public for the purpose of playing prescribed games of chance.

A "nightclub" refers to premises that are open for business at night, offering a combination of a bar and disco or other forms of entertainment.

"Tourist enterprises" are the enterprises listed in the Second Schedule of the Act.

A "tourist guide" is an individual employed to provide tourists with information about the geography, history, cultures, and life of different communities in The Gambia.

On that note guests and tourists are strongly advised not to stay in any apartment, guesthouse, lodge, or motel that is not registered with the Gambia Tourism Board. It is the responsibility of the guests themselves to ensure that they choose accommodations that are compliant with GT Board regulations.

Court Remanded 23 Youths In Mile 2.

The police arraigned 23 Youths before Principal Magistrate Jabang on two counts. The accused persons are charged with idle and disorderly conduct, as well as common nuisance, under sections 166 (c) and 160 (1) of the Criminal Code, respectively.

According to the particulars of the offence
Alpha Dampha, Janka Sanyang, Babucarr Secka, Arfang Badjie, Ebrima Camara, Wa Saidyba, Alieu Khan, MalickNyang, Muhammed Jobe, Pierre Jatta, Papa Khan, Ebrima Jallow, Musa Sallah, Ebrima Camara, Lamin Manka, Macho Ceesay, Babucarr Jallow, Yerro Saidy, Abdoulie Dibba, Musa Saidykhan, Alfa Omar Jallow, Sheikh Tijan Faye and Muhammed Touray in August 2023 at SerreKunda and diverse places in the Kanifing Municipality of the Republic of The Gambia, while in a public place conducted yourself in a manner that causes a breach of the peace, thereby committing an offence.

Upon being read the charges, all the accused persons have pleaded not guilty. The police prosecutor, ASP Bobb, seeks the court not to grant the accused persons. She said the accused individuals have prior records of offence.

She submits that while bail is indeed a constitutional right, it is not an absolute right, especially considering the circumstances of the case. According to her, it is within the discretion of the Magistrate to grant or refuse bail.

She further stresses the prevalent crime rates in the country and the efforts of the Gambia police to maintain public order through "Operation Clean the Street". According to the prosecutor, the accused persons were apprehended during that operation, and granting them bail would compromise the safety of both the country and the lord himself.

She urged the court to deny bail, emphasizing the necessity of ensuring the safety and freedom of movement for the country and the presiding Magistrate.

On the other hand, the accused persons have presented compelling reasons for the court to consider granting them bail. Each accused person has provided their circumstances, highlighting the vital role they play in supporting their families and their overall contribution to society. These reasons range from being primary caretakers for their parents, responsible for the education and well-being of younger siblings, and being the sole breadwinners for their families.

Alpha Demba has emphasized the need to take care of his family, stating that their well-being would be jeopardized if he is not granted bail. He attests to the restless state of his family since his arrest.

Jonko Sanneh argues that he is responsible for supporting his mother and siblings, including paying his younger brother's school fees. He reveals that his parents are divorced, and he alone bears the financial responsibility for their rented accommodation in Busumbala.

Babucarr Secka, a businessman, appeals to the court to grant him bail, asserting that he was arrested at his workplace. He highlights the importance of his work and his contributions to the country.

Afrang Badjie, an electrician, pleads for bail, stating that he supports both his mother and father. He explains that he was arrested on his way home after finishing work at 5 pm.

Ebrima Camara claims to have been arrested while leaving work. He appeals to the court for assistance in his situation.

Bowa Saidy argues that he deserves bail as he was arrested while on his way to work, maintaining his innocence and asserting that he has not committed any crime.

Alieu Khan, also seeking bail, explains that he was apprehended on his way home after finishing work. He states that his income is crucial for supporting his family.

Malick Nyang pleads for forgiveness, stating that he was found at the Serek***a garage without having committed any wrongdoing.

Muhammad Jobe, a carpenter, implores the court to grant him bail as he is the sole provider for himself and his mother, who relies on him financially.

Pieera Jatta, Khan, Ebrima Jallow, Sallah, Lamin Manga, Sowe, Bubacarr Jallow, and Musa, each individually appeal for bail, asserting their innocence and expressing their roles as responsible individuals supporting their families through their respective professions.

After listening to arguments made by both the police prosecutor and the accused persons, the principal Magistrate adorned the case to the 17th of August 2023 for a ruling.

The Foundation Stone of Batokunku Football Field Laid.

The GACH Mining Company on Sunday laid the foundation stone for the Batokunku village football field, an investment worth 2.3 million dalasi.

According to the GACH representative, the project is part of the company's social cooperation initiatives to support the Kombo South coastal line community.

The Councilor, Boto Bojang, praised GACH's CEO, Abubakary Jawara, for his commitment to the country and highlighted that GACH is the only mining company that has paid royalties to the affected communities over the years.

"The company has already undertaken various development projects, including the construction of a police station in Sanyang village, providing royalties to Tujereng, organizing a football tournament for the coastal line communities, and installing a borehole in different communities,"

He added the GACH Mining Company also plans to contribute to community health facilities in Tujereng, and it has fulfilled its promise to construct a standard football field in Batokunku village.

The village leaders and residents expressed their gratitude for the company's contributions and urged unity and continued collaboration for further development.

Lawyer Lamin Ceesay for Abdoulaye Thiam Tendered Documents Before The Court

Lawyer Lamin Ceesay for Abdoulaye Thiam, a senegalase businessman has tendered more documents before Justice Ebrima Jaiteh of the Banjul High Court. While Lamin L.S. Camara for Aisha Fatty strongly objected that they were photocopies and inadmissible, Justice Jaiteh admitted the documents into the records of the court. Section 97 of the Evidence Act provides "The contents of documents may be proved either by primary secondary evidence."

Section 101 of the same Act provided a basis and conditions to be satisfied before using secondary documents including documents photocopied. Justice Jaiteh allowed photocopies to be admitted into the records

Lawyer Lamin Ceesay for Abdoulaye Thiam made an application to tender the documents and for all of them to be admitted into the records. Lawyer Lamin S. Camara for Aisha Fatty demanded for the original of the documents because to him, what was tendered were photocopies. Lawyer Camara indicates that he will object to the admissibility of the documents in the absence of the originals.

Lawyer Cessey said ExhibitPI is the agreement letter of Fajara waterfront, Exhibit P2 is the Statement made by Thaim to the Interpol, Exhibit P3 is the Statement from Solie Chambers to the Inspector General of Police, Exhibit P4 is the originating summons by Aisha Fatty in another matter in the High Court and Exhibit P5 is the Legal fees.

Ceesay applied to tenders the bill and receipt for the purchase of the two Mercedes Benz and the other documents. Lawyer Camara for Aisha Fatty said the documents were inadmissible based on law. He added that the documents are photocopies and based on the expressed provisions of the Evidence Act, they are inadmissible.

Senior Counsel Camara further pointed out that the document "Commonwealth of Pennsylvania certificate of title for a vehicle also a photocopy, adding that it is also not part of the list of documents. He further indicated that the document titled Motorways Corp invoice is a coloured photocopy document.

"No foundation has to be laid as to the whereabouts of the original documents and as such, the said documents are inadmissible under the circumstances. I urged the Court to reject the document for what they are and mark them accordingly," Camara submitted

In his response, Lawyer Lamin Ceesay for Thiam described Lawyer Camara's objection as a misconception. He stated that Aisha Fatty admitted in paragraph 14 of her affidavit that Thiam bought the vehicles for her, adding that the documents sought to be tendered are evidence of the purchase of the said vehicles.

Ceesay said the documents are original copies and were pleaded in Paragraph 11 of Thiam's affidavit statement. Ceesay added that the documents are relevant to the case. Ceesay cited section 118 of the EvidenceAct which is titled Books of Science, Maps and Charts" which provides "On matters of public history, literature, science or art, reference may be made, for the purpose of evidence, to such published books, maps or charts, as a court shall consider being an authority on the subject to which they relate"

Ceesay also relied on Section 3 of the Evidence Act which is titled "Relation of Relevant Facts which provides "As a general
rule and except as otherwise prescribed by an Act of the National Assembly all evidence which is sufficiently relevant to an issue before the court is admissible, while evidence which is irrelevant or sufficiently irrelevant is not admissible"

In reply on points of law, Counsel Camara submitted that section 118 of the Evidence Act cited by Lawyer Ceesay is irrelevant to the issues before the court. He said Section 3 of the Evidence Act also cited by Ceesay is irrelevant to the issue and cannot override specific provisions of the Evidence Act.

He reiterated that the documents are photocopies as he urged the court to reject the said documents.

The turn of the presiding Judge Justice Ebrima Jaiteh to rule on whether to allow the documents to pass or reject them. Justice Jaiteh cited sections 97 and 101 of the Evidence Act of 1994. Justice Jaiteh stated.

"I must state that this court does not have the expertise to differentiate the original copies from photocopies and would consider the said documents for what they are,".

He placed reliance on the submission of Counsel Ceesay, who said the documents are the originals and not secondary copies.

"I must emphasise that the law has progressed as to the admissibility of documents. The line of authorities is to the effect that relevancy is what governs the admissibility of documents" Jaiteh said.

He added: "Once a document is pleaded and it is relevant, and it is a document which can ordinarily be admitted under the Evidence Act, the fact that it is a photocopy should not obstruct its admissibility. The probative value to be attached to the document however is another kettle of fish (meaning-bad state of affairs)". Jaiteh said the Law is that facts admitted in a pleading may be taken as established without the need for proof.

"When parties have agreed about a particular matter in their pleadings, such matter need not be proved and such an agreed fact is taken as established," Jaiteh said, adding that "What is admitted need not be proved and parties are bound by their pleadings"

He pointed out that Abdoulaye Thiam in his affidavit of statement pleaded the invoices and receipts of payments for the vehicles, which is also captured in paragraph 14 of Aisha Fatty's statement of Defence that the Plaintiff (Thiam) bought the said vehicles.

"It is a settled law that what is admitted need not be proved. There is no doubt that the Plaintiff purchased the said vehicles and this is established in their respective pleadings" he said.

On the issue of whether the documents are original or not, Jaiteh said it should not obstruct the admissibility of the said documents as it is already established fact in their respective pleadings. He added that the court is bound by such pleadings.

On whether they are admissible or not he cited section 3 of the Evidence Act saying in the test for admissibility or inadmissibility of the evidence, the court will have to weigh the probative value of the evidence against the prejudicial effect and decide which substantially outweighs the other. He resolved the issue of admissibility in favour of Thiam and admitted the documents into evidence.

"Accordingly, and pursuant to section 3 of the Evidence Act, 1994, the bill of sale, invoice number 41910262, invoice number 41923988, the Commonwealth of Pennsylvania certificate of purchase and Motorways Corps invoice are hereby admitted into evidence as a bundle and marked Exhibit P6(a) to (f) Jaiteh ruled.

Lawyer Lamin Ceesay continued to tender documents into evidence, he tendered the documents of the contract of the purchase of Benz GLP 63 (black)Bjl 4222 W.

Counsel Camara objected to the document by pointing out that only the first 6 pages are served to the defendant and the rest are not served.

"There are 14 pages but only 8 pages were served to us. So I am objecting to it" he said. Lawyer Ceesay conceded to the observation of Lawyer Camara.

Lawyer Camara further stated that what he observed in the document is that 4 were about a contract, one-page page was an invoice, one page contained bank information and another two pages of invoices. Camara pointed out that the documents were photocopies and the Court was not informed about the whereabouts of the original.

"My Lord, in this case, no evidence is advanced why the original of the document is not before the court. My Lord, this document being a photocopy is not admissible and if you observe at the e bottom you will see a signature that tells you this is a photocopy" Lawyer Camara stated.

He said while documents 4 and 5 had a stamp, it can be seen that both are photocopy documents. He added that document number 6 is not pleaded and is not listed in the list of documents. He stated that documents numbers 7 and 8 were invoices, but both were photocopies.

He finally submitted that the documents intended to be tendered were not admissible under section 115 of the evidence, regardless of how relevant they may be. Section 115 deals with the certification of public documents.

Lawyer Ceesay, in reacting to Camara's argument, said document number 6 is an original copy and was related to the purchase of the vehicles. Ceesay simply relied on the court's earlier ruling asking the court to admit the documents into the records. He submitted that all the documents were pleaded in their pleadings and have been listed in the list of documents. He submitted that the courts have moved away from relying on technicalities to make decisions.

In his reply on point of law, Camara said what is expected from LawyerCeesayis to look at the pleading and show the court where they are listed. The case was adjourned to 13th July 2023 at 11:00 am for ruling and continuation of the hearing.
