EC declares DOME-KWABENYA in favour of NDC’s FaustIna Akurugu.

This is what just happened in court over 4 seats in Parliament.

The Supreme Court directed the High Court to hear the Mandamus application by NPP but with NDC joined as a party and being heard as well.

When court opened this morning , lawyers for the NDC rather raised a preliminary objection challenging the procedure by with the NPP came to court.

The NDC argues that since there has been an earlier declaration by the EC which named winners including Ebi Bright and Baba Sadiq, the NPP can only come to court by a petition which challenges their election and not a mandamus to compel the EC to re-collate.

The High Court, constituted by Justice Baah Forson Agyapong adjourned the matter to tomorrow to rule on the preliminary objection.

The other point of argument is this that as the EC claims there was undue threats upon their officials to make such declarations and thus such declarations have never been made as far as the law is concerned .

So we await the court’s decision , stay with us for more and all the gossip .

HERE IS ALL YOU NEED TO KNOW ABOUT THE SUPREME COURT AND THE RE-COLLATION MATTER

On Dec 7th, elections were held.
9 of the 276 parliamentary results were not released by the EC on account of suspected mal-conduct.

Results were declared in some of the 9 constituencies and the EC later alleged that such results were declared under duress.

Some of the NPP members and affected PC’s proceeded to the High Court, seeking an order of MANDAMUS (which is an order to compel a public institution to perform its function) to compel the EC to re-collate the results.

The application was sought ex-parte (which means without notice to the other side) but the NDC were in court and demanded to be heard as they were an interested party.

The court refused to hear the NDC and proceeded to grant the MANDAMUS application ex-parte.

The NDC then proceeded to the Supreme Court seeking an order of CERTIORARI (which is an order given by a higher court that nullifies the decision of a lower court), to quash the decision of the high court over the grant of MANDAMUS on account of failure to hear the NDC and bias.

The Supreme Court unanimously accepted the NDC’s position and upheld the application for certiorari…

Consequently, the court ordered a re-hearing of the mandamus with all parties including the NDC being heard.

That event is set to occur on or before 31st December 2024.
