Der Deutsche Anwaltsverein kritisiert den Vorschlag von CDU-Kanzlerkandidat Friedrich Merz, Menschen mit Doppelpass die deutsche Staatsbürgerschaft nach schweren Straftaten abzuerkennen.

Zwar sei es „juristisch denkbar, weitere Gründe für den Verlust der Staatsbürgerschaft festzulegen“, sagte Thomas Oberhäuser, Vorsitzender der Arbeitsgemeinschaft Migrationsrecht des Vereins dem FOCUS. Doch stoße der Vorschlag schnell an rechtliche Grenzen.

„Einem Deutschen, der die doppelte Staatsangehörigkeit besitzt, weil ein Elternteil deutsch und der andere Ausländer ist, die deutsche Staatsangehörigkeit wegen Straffälligkeit zu entziehen, ist wohl ausgeschlossen“, betont Oberhäuser. „Wenn man das allerdings bei Zugewanderten, die sich haben einbürgern lassen, anders sieht, wäre das mit dem Gleichheitsgrundsatz nur schwer vereinbar.“

Denn in dem Fall würden Menschen mit doppelter Staatsbürgerschaft unterschiedlich behandelt werden, je nachdem, wie sie die deutsche Staatsbürgerschaft erworben haben. „Ein Deutscher, der die Staatsbürgerschaft mit der Geburt erworben hat, hätte dann mehr Rechte als jemand, der sie durch die Einbürgerung erworben hat“, sagte Oberhäuser.

Bislang kann die deutsche Staatsbürgerschaft nur in wenigen Fällen entzogen werden, beispielsweise bei der Mitgliedschaft in einer ausländischen Terrororganisation.
