To ALL Monte Pego homeowners:

You may already be aware that Pro Monte Pego, the Association representing Homeowners’ interests on the Urbanisation, has launched a legal action against Pego Town Hall. You may have already joined our legal action thus appreciating the reasons behind this action. If so, you have no need to read any further.
However, if this is all news to you and you want to understand the true reasons, maybe even join the action, then please read on.

The Town Halls of Pego and Denia have for 15 year neglected their duty of care to us all, effectively abandoning the urbanisation by illegally failing to provide any basic services - safe roads, pavements, sewerage, etc. - and no maintenance or repairs. During all this time we have dutifully paid our suma (taxes) but received nothing in return.

The law throughout Spain is extremely clear stating that in such instances of an urbanisation being abandoned, as we clearly are, it is the Town Hall’s responsibility and they must step in and provide repairs, maintenance and basic services. Failure to provide basic services could leave Town Halls liable to prosecution in a court of law, and potential compensation to residents.

The Town Halls might try to claim back the costs from the developer, but that is between the Town Halls and the developer and of no interest to us and our legal action.

The time for negotiating with the Town Halls of Denia and Pego has long since passed hence this unprecedented legal action taken by the home owners of Monte Pego against the Town Halls.

FIRE PREVENTION SIGN

The fire prevention sign to be placed in different locations and "approved by the Pego mayor" does not address the main issue: the conditions for a fire have not been removed. Please see below the sign as an example. This is just another distraction to avoid the municipal obligations.

What is required is the obligation by law for each town hall to prepare, manage, implement and update a comprehensive fire prevention and extinction plan. This is a multi-task operation comprising constant w**d cutting and removals, plants pruning, fire -breaks, water points, escapes routes, proper road access, coordination with other government department such as fire brigade, training of property owners and how to react in fire situation, etc.

This fire prevention and extingtion plan is long overdue, and is clear that by not fulfilling their obligation by law, the town hall will be directly liable for any further fire disasters and damages.

Leí el escrito de opinión del "Sr. Paul Carter" en montepego.info sobre los derechos de los propietarios de Monte Pego en recibir de los Ayuntamientos los Servicios públicos mínimos municipales obligatorios por ley.
Soy español, represento a varios Propietarios en Monte Pego y estoy completamente de acuerdo con el escrito del "Sr. Carter". Lean este extracto de la "Ley de la Comunidad Valenciana" que confirma lo dicho por el Sr. Carter:
"LEY 8/2010, de 23 de junio, de la Generalitat, de Régimen Local de la Comunitat Valenciana"
Artículo 25 Derechos y deberes de los vecinos y vecinas
1. La condición de vecino o vecina confiere los siguientes derechos y deberes:
g) Solicitar la prestación y, en su caso, el establecimiento del correspondiente servicio público, así como exigirlo en el supuesto de constituir un servicio de carácter obligatorio

Artículo 34 Servicios mínimos obligatorios
Los municipios, por sí mismos o asociados, deberán prestar, como mínimo, los servicios siguientes:

a) En todos los municipios: alumbrado público, cementerio, recogida de residuos, limpieza viaria, abastecimiento domiciliario de agua de consumo humano, alcantarillado, acceso a los núcleos de población, pavimentación de las vías públicas y control de alimentos y bebidas y agencia de lectura.

Quiero además ampliar y aportar información importante para todos:
En el mismo artículo 25 en su apartado 3 dice que la ley contempla que los propietarios puedan formular sus quejas al “Síndic de Greuges” de conformidad con la ley 11/1988 de 26 de Diciembre. Quejas que el “Síndic de Greuges” ha comenzado a recibir para que denuncie la falta de cumplimiento de los Ayuntamientos en especial del Ayuntamiento de Pego para con la Urbanización Monte Pego.
La misma ley en su artículo 36 establece la posibilidad de “dispensa de prestación de servicios mínimos obligatorios a los Ayuntamientos” por no considerar prioritario su realización, previendo transferir esa responsabilidad al Consell de La Generalitat Valenciana.
Creo que a nadie le importaría pagar los impuestos al "Consell de La Generalitat Valenciana" en vez de al Ayuntamiento de Pego para recibir los Servicios Mínimos. Si en vez de que en la Urbanización Monte Pego el 98% de propietarios son extranjeros fueran la mayoría españoles, el Ayuntamiento de Pego no se hubiera atrevido a NO cumplir con sus obligaciones de Servicios Mínimos Obligatorios por los que cobra una enorme cantidad de dinero.
¡Ya está bien. Basta Ya! ¡La ley no contempla excusas! ¡Cumplan la Ley o devuelvan Impuestos o pidan “ Dipensa al consell de la Generalitat Valenciana.

Some neighbors are wondering what is happening in Montepego, do not understand that they do not follow the urban ordinances.
The bewilderment has caused several residents have organized to face common to what many consider an injustice, which strikes against the majority to favor a few who do not hesitate to destroy the beautiful aesthetics of our urbanization to their own benefit.

Einige Nachbarn fragen, was in Montepego geschieht nicht, dass die Bauvorschriften verstehen nicht befolgt werden.
Die Verwirrung erzeugt hat mehrere Bewohner gemacht haben organisiert, um gemeinsam gegen das, was als Unrecht viele sehen, dass die meisten bedroht einige bevorzugen, die nicht zögern die schönen Ästhetik unserer Entwicklung zu zerstören zu profitieren.

Algunos vecinos se preguntan que esta pasando en Montepego, no entienden el que no se sigan las ordenanzas urbanísticas.
El desconcierto generado ha hecho que varios residentes se hayan organizado para hacer frente común a lo que muchos consideran una injusticia, que atenta contra la mayoría para favorecer a unos pocos que no dudan en destrozar la bellísima estética de nuestra urbanización para beneficiarse .
