PF HIJACKERS COURT STRATEGY BACKFIRES WHEN CASE GOT ADJOURNED TO 20th MARCH
AS HON MILES SAMPA SCORED ANOTHER GOAL TO EXTENDS THE LEAD ON THEM

The matter came up this morning Friday 3rd March 2023 for the hearing of the Contempt application by Hon Miles Sampa against Hon Given Lubinda, Hon Nickson Chilangwa, Mr Davies Chama and Mr Raphael Nakachinda. Misled by Makebi Zulu and Hon George Chisanga the 4 were told not to show up at court but have lawyer Jonas Zimba arrive alone and raise a preliminary issue to dismiss contempt proceedings on the basis that there was no personal service on the Alleged Contemnors.

Lawyers for Miles last week served the contempt document to their lawyers Makebi & Co but their submission was same should have been served directly to each of the four contemptors.

Hon Sampa’s lawyers from IvenLevi, Lifunana & Co and Madaika & Co successfully argued that failure to serve was not fatal as it is curable. Matters of contempt are meant to protect the integrity of the courts and should be decided in merit and not only procedure of service.

Judge Timothy Katenekwa then made a preliminary judgement and agreed with Hon Sampa’s lawyers and ordered that personal service be first effected on the Alleged Contemnors before matter can be head. He also rejected an application made by the 4 Contemnors to also cite Hon Miles Sampa for contempt of court for talking about the case in apparent reference to his Diamond Tv programme with Costa. The judge did not sign their order to commence the contempt as it is an afterthought and they needed to first defend themselves on the contempt charges raised by Miles.

The matter has since been adjourned to the 20th of March, 2023 at 09:30hrs with costs in favor of the Alleged Contemnors. After the contempt matter is disposed off after March 20th then the substantive matter of them suspending Miles and him arguing back that they masqueraders and illegal PF top leaders as no one elected them to those positions as enshrined in the PF constitution.

This means until after 20th March, 2023, the 4 and any other purporting to be the top leaders of PF can not speak or carry the PF top functions otherwise they risk additional contempt charges which if found guilty is punishable by jail sentence of upto 2 years as was in the case McDonald Chipenzi in 2019.
