PRAY FOR PRESIDENT CYRIL RAMAPHOSA CONSIDERING BELA EDUCATION BILL

Please pray for President Cyril Ramaphosa as he considers whether to sign the BELA education bill, or send it back to Parliament for corrections.

WHY SHOULD WE PRAY?
The bill would take power away from parents to decide how our children will be educated. It would impact on multiple Constitutional rights, that Ramaphosa himself negotiated as lead negotiator for his party at CODESA. This bill is the biggest change in education since the very good 1996 schools act and will impact the next generation of children. The Bible instructs is to pray for kings and those in authority (1 Timothy 2). If we neglect to obey that command, then we can't blame the government for our problems, because we are part of the problem.

Encouraging is that since we started protesting against this draconian bill in 2017, the government has agreed to two thirds of the corrections we asked for. We just need to remaining one third. Also about two thirds of the bill we don't have a problem with. We just need them to correct the clauses taking power from parents. Millions of rands have been donated by parents to fight this at the Constitutional Court. But it would be much better for everyone if the President gave the bill his red pen of corrections instead of his black pen of signature.

Cyril Ramaphosa was the leader of his High school, Student Christian Movement, and his leadership potential was recognized by the national leadership of SCM. Pray for Cyril Ramaphosa that he will remember what he learned about education in the Bible in his youth.

Definitions (and in depth descriptions of these definitions) are important as they reveal what meanings the DBE attributes to certain words and phrases. I'm baffled by the fact that "in the best interest of the child" has come to mean whatever the DBE decides it must mean. Recently, "in the best interest of the child" was used to justify the banning of Baby Savers. These devices are said to encourage child abandonment, so having them installed is not "in the best interest of children".

Parents want to preserve their children's innocence. In order to do this they believe SLPs should be blocked from being introduced to their children, however when one does a search on the what "the protection of the child's right to innocence" means to the DBE, one realises that the DBE and parents are not on the same page regarding this issue. In a DBE document, published when Kader Asmal was still the Minister of Basic Education, the protection of innocence was not only linked to learners having access to Sexuality Education but it was dependent on SE.

The DBE and parents can not agree to disagree, not on matters pertaining to our children, and not on the very basic (and obvious) meanings to certain words and phrases.

The BELA Bill Process

A Bill is referred to the President after it has passed through the National Assembly and NCOP. The Constitution requires that the President must assent to and sign a Bill. However, if the President has reservations about the constitutionality of a Bill, he or she may refer it back to the National Assembly for reconsideration. If the Bill affects the provinces, the NCOP must participate in the reconsideration of the relevant Bill. If a reconsidered Bill accommodates the President’s reservations, the President must assent to and sign the Bill. However, if a reconsidered Bill does not fully accommodate the President’s reservations, the President must either assent to and sign the Bill or refer it to the Constitutional Court for a decision on its constitutionality. If the Constitutional Court decides the Bill is constitutional, the President must sign it.

According to PMG records "The President does not automatically sign a bill into law. He has the opportunity to assess the constitutionality of a bill and can refer it back to Parliament for reconsideration if he has any reservations. When exercising this right, the President seeks counsel and considers submissions and PETITIONS made to him."

To-day (23 April), the Pestalozzi Trust sent a legal letter to the National Council of the Provinces, highlighting the procedural flaws in both the public hearings and last week's Clause-by-Clause discussion.

This letter contains a detailed setting out of some key aspects that dismayed and angered home schoolers.

Consider the impact Clause 2 will have on how much push back you will be able to give when your parental authority is undermined in a BELA Bill world.

Note: The BELA Bill is not law yet. It is currently at NCOP level and we can NOT afford to be audience members in our democracy. Not when we have been invited by the NCOP to be participants.

BELA Bill Awareness 🚨🚨

The BELA Bill needs to be sent back to the drawing board. The sensible recommendations made by citizens and residents of SA during BELA-Bill related hearings need to be taken into consideration. As South Africans we say: Nothing about us, without us!

The BELA Bill seeks to amend the South African Schools Act (SASA) of 1996 as well as the Employment of Educators Act (EEA) of 1998. Some of the changes and additions to the current Acts include:

📢Making Gr R compulsory.

📢Criminalising parents who do not comply with certain regulations.

📢Introducing additional laws which will have a negative impact on the home education sector.

📢Closing primary schools with less than 135 learners, and secondary schools with less than 200 learners in.

📢In addition to this the Bill will also grant powers to the Minister to make regulations regarding a range of serious matters (one of which relates to the management of learner pregnancy).

If this Bill is pushed through there will be an enormous power shift. The HoD, MEC and the DBE will have the final say! This all translates into the centralisation of our public school sector.
