HAWKS ARREST FORMER LOCAL MUNICIPALITY CFO FOR ALLEGED FRAUD AND CONTRAVENTION OF MFMA

NORTH WEST: Members of the Hawks' Serious Corruption Investigation arrested a 45-year-old suspect on Monday, 04 November 2024, for alleged fraud and contravention of the Municipal Finance Management Act.

The suspect, who is the former Chief Financial Officer (CFO) at Lekwa Teemane Local Municipality in Christiana, was arrested in Heidelberg following allegations of fraud and contravention of the Municipal Finance Management Act in the procurement of motor vehicle rental service for the mayor.

Reports indicate that from April to May 2022, the suspect procured motor vehicle rental service for the mayor without following proper supply chain processes. Investigation revealed that the suspect procured these services without the approval of the municipal manager. As a result, the municipality suffered a loss of over R167 000,00.

The suspect is due to appear in the Christiana Magistrates' Court on Tuesday, 05 November 2024, to face three counts of fraud and contravention of the Municipal Finance Management Act.

Two suspects, a 45-year-old member of the Directorate for Priority Crime Investigation attached to Serious Organised Crime Investigation and a 53-year-old Polokwane Magistrates court stenographer are to appear this morning in the Polokwane Magistrates court facing charges of corruption and defeating the ends of justice.

The duo was arrested yesterday, 07 October 2024 following an intensive investigation which began on 27 February 2020. The allegations against the pair relate to a case of corruption and an attempt to defeat the course of justice that took place in Polokwane.

Dear SMME'S,

So To achieve compliance with Section 217 of the Constitution, procurement of goods and services for public entity must, among other things, be conducted in an open and competitive environment.

The Constitution states in Section 217(1) that: ‘When an organ of state in the national, provincial or local sphere of government, or any other institution identified in national legislation, contracts for goods or services, it must do so in accordance with a system which is fair, equitable, transparent, competitive and cost-effective.’

As a result, the Public Finance Management Act 1 of 1999 (PFMA) was adopted to give effect to certain constitutional provisions, including Section 217 of the Constitution. The PFMA enables National Treasury to issue regulations and instruction notes.

To underscore the relevance of s 217 of the Constitution, the court remarked in Valor IT v Premier, North West Province and Others 2021 (1) SA 42 (SCA) that the section is meant to ‘prevent patronage and corruption, on the one hand, and to promote fairness and impartiality in the award of public procurement contracts, on the other.’

So if you are of a firm view that an organ of state has breached this provision of The Constitution Of The Republic Of South Africa 1996, take it upon yourself to alert the relevant authorities.
