Durban: A Durban teacher has pleaded guilty to voting 24 times during the local government elections in November last year.

Nomusa Precious Gabuza was sentenced to three years of correctional supervision and four years’ imprisonment, wholly suspended for three years in the Umlazi Regional Court this week.
NPA spokesperson Natasha Kara said Gabuza pleaded guilty to Contravention of the Local Government Municipal Electoral Act 2000.

In her plea, Gabuza told the court that she was at teacher at a school in Durban, which was also used as a voting station during the Local Government Elections.

“She was the presiding officer at this voting station and acknowledged that her job was to ensure that the voting process was conducted fairly and justly without any problems,” said Kara.
“On the morning of the elections and before the voting station could open, she decided to cast extra votes in favour of her party of choice.

“She said that she cast 24 votes (12 for the municipal elections and 12 for the ward elections) in favour of her party and put them in the relevant boxes.”

Gabuza, in her plea, said she did this knowing that her actions were wrong and that she was only entitled to vote once.
“Gabuza was arrested after a party representative inspected the boxes before the start of the voting process. was then arrested and eventually confessed,” concluded Kara.

Telkom and communications regulator Icasa have reached an out-of-court settlement, bringing to an end the drawn-out legal wrangling over the licensing of high-demand spectrum.

Icasa and Telkom were due to face off in the high court next week, starting on Monday.

In terms of the settlement agreement, Icasa will kick off the licensing of spectrum that remains unassigned in the auction by no later than 30 June 2022, with the licensing process to be concluded within the regulator's current financial year, by the end of March 2023. It has also undertaken to take into account the outcomes of the recently completed auction in its licensing of the unassigned 800 MHz.

Icasa said it would conduct an inquiry that would look into a secondary market for spectrum. It would consider the findings of the Mobile Broadband Services Inquiry as well as the recent auction's outcome, and would assess whether there is a need for regulatory intervention.

Telkom itself was one of the winners in the recently completed auction round, having secured over R2 billion spectrum. It nonetheless wanted the auction declared invalid, arguing that the auction process would entrench an uneven playing field in the telecommunications sector.

In a notice, Telkom said the settlement agreement would give challenger operators like itself "further opportunity to acquire sub 1 spectrum to compete with established players".

Group CEO Serame Taukobong added: "Telkom has, in good faith, entered into a forward-looking settlement, providing Icasa the opportunity to resolve current market challenges identified by competition authorities while allowing operators to focus on the business of providing superior service to their customers."

At the end of March, Icasa issued what it called a "humble plea" to Telkom to call off its court challenge, asking it to "[embrace] the winds of digital evolution in our country", according to Icasa chair Keabetswe Modimoeng.

In a statement on Friday, the regulator confirmed the settlement, saying it was "indeed happy" to have reached agreement with Telkom. "This is indeed an epitome of the power of cordial dialogue where everyone has the same vision of building an inclusive digital society. We look forward to a new chapter of our public interest regulatory work with this litigation finally behind us," said Modimoeng.

The legal battle had drawn the ire of communications minister Khumbudzo Ntsavheni, who argued that the spectrum auction was part of key reforms that would boost economic growth.

Joe Biden has said that Russia's false accusations that Kyiv had biological and chemical weapons illustrated that President Vladimir Putin was considering using them himself.
Washington and its allies have previously accused Russia of spreading an unproven claim that Ukraine had a biological weapons programme as a possible prelude to using such weapons itself, but Biden's remarks on Monday were some of his strongest yet on the subject.
Biden also told businesses to be alert for possible cyber attacks by Russia. "It’s part of Russia’s playbook," he said in a statement.
Ukraine's military said on Tuesday residents should brace for more indiscriminate Russian shelling of critical infrastructure, as US President Joe Biden issued one of his strongest warnings yet that Moscow is considering using chemical weapons.

Russian troops have failed to capture any major Ukrainian city more than four weeks into their invasion, and increasingly are resorting to causing massive destruction to residential areas using air strikes, long-range missiles and artillery.

The southern port of Mariupol has become a focal point of Russia's assault and lies largely in ruins with bodies lying on the streets, but attacks were also reported to have intensified on the second city Kharkiv on Monday.

Ukraine's armed forces said in a statement issued on Tuesday that Russian forces were expected to continue to attack critical infrastructure using "high-precision weapons and indiscriminate munitions”.

Without citing evidence, Biden said Russia's false accusations that Kyiv had biological and chemical weapons illustrated that President Vladimir Putin was considering using them himself.

Putin's "back is against the wall and now he's talking about new false flags he's setting up including, asserting that we in America have biological as well as chemical weapons in Europe, simply not true," Biden said at a Business Roundtable event.

"They are also suggesting that Ukraine has biological and chemical weapons in Ukraine. That's a clear sign he's considering using both of those.

US President Joe Biden on Tuesday announced a US ban on Russian oil and other energy imports, ramping up a pressure campaign on Moscow in retaliation for the invasion of Ukraine.

Ahead of the announcement, oil prices rose with Brent surging past $132 a barrel in anticipation of reduced supply.

Biden acknowledged that fuel prices will go up further with this move, adding that Russian President Vladimir "Putin's war is hurting American families at gas pump”.

Britain will also phase out Russian imports of oil and oil products by the end of 2022, business minister Kwasi Kwarteng said on Tuesday, calling on businesses to use the transition period to ensure a smooth transition.

A former police constable shot his wife, killed her three siblings then turned the gun on himself in Standerton, Mpumalanga on Sunday night.

According to police spokesperson Brigadier Selvy Mohlala, the incident occurred after they had an argument in the driveway of the couple's home.

According to Mohlala, the 36-year-old wife is fighting for her life in hospital. Her siblings - two sisters, aged 40 and 44, and a 37-year-old brother - died and her husband was found dead next to his firearm.

"Preliminary investigation indicates that there was an argument between the man and his wife, together with the woman's family in the driveway of the man's residence," Mohlala said.

Mpumalanga police have opened a murder and attempted murder case as well as an inquest docket.

Provincial police commissioner Lieutenant General Semakaleng Daphney Manamela described the incident as "regrettable".

A heavily pregnant Tshegofatso P**e received repeated threats to leave her lover Ntuthuko Shoba, who is in the dock for allegedly masterminding her brutal killing.

As the trial finally got under way in the high court in Johannesburg on Monday, P**e’s close friend Tshepiso Tsita took the stand as the first witness and detailed how Shoba’s wife, Rosetta Moatshe, allegedly threatened P**e in the weeks before her death and warned her to “leave her man”.

She also allegedly threatened to “deal with her” and “visit her workplace”.

P**e was killed on June 12 2020.

Tsita told the court that Shoba had used her bank account several times to send money to P**e, who she said was dependent on Shoba for her financial upkeep.

With her evidence led by state prosecutor Faghre Mohammed, Tsita told the court that P**e had also been unhappy about Shoba's relationship with Moatshe as “she was not getting enough time” with Shoba, who pleaded not guilty to the charges on Monday.

Tsita said a series of SMSes raised red flags for P**e and increased her fears for her safety. “She did not feel safe. She said she felt like she was being watched,” Tsita told the court.

“One of the messages was from a lady called Zandile or Zanele asking if Tshegofatso was looking for a job and it was a makeup job... She would teach people how to apply makeup. She said yes, she was interested and then the lady said she would call her but she called with a private number.”

Shoba is facing charges of murder, conspiracy to commit murder and defeating the ends of justice.

He is serving 20 years behind bars for his role in P**e’s killing.

The court also heard on Monday how Shoba had allegedly told P**e that his father wanted a DNA test to be conducted on their unborn child before she was sent to their home for the payment of damages.

Shoba’s lawyer Norman Makhubela told the court that his client's version of events was that he had not been in a romantic relationship with P**e at the time of her death but that he had been taking care of her financially since she was carrying his child.

“My instruction is that P**e had accepted that the only thing that was keeping them together at the time was the fact that he was supporting their child that was due in July. Otherwise there was no relationship,” Makhubela said.

Makhubela said Shoba had decided against visiting P**e’s home after her death and her funeral as her aunt and brother accused him of being responsible for her murder.

Cyril Ramaphosa says the Lekgotla warned of ANC divisions, which are threatening democratic gains.
The ANC's deepening divisions and factionalism remain the biggest threat to the party and the country's democratic gains.

This was a warning shot by the party's leaders, who cautioned about counter-revolutionary threats within the governing party.

The ANC held a two-day Lekgotla at the weekend.

In giving an outline of the Lekgotla's recommendations, the president of the ANC, Cyril Ramaphosa, said the decay and deprivation of the party remained a concern.

The threats to the party's future lay within and outside, Ramaphosa said.

"The Lekgotla recognised our movement is going through a period of decay and degeneration; the ANC has been able to extricate itself from similar situations in the past. It is important not to lower our guard against counter-revolution.

In his closing remarks at the Lekgotla, Ramaphosa said:

The threat to our democratic gains is also a result of an era of loss of moral and ethical principles within the congress movement. We need to show determination in addressing the toxic legacy of state capture, resulting in weakened security institutions, misdirected and hallowed [sic] out. Divisions and factions in the ANC are becoming a threat to our democracy.

The Department of Employment and Labour has strongly condemned the unsanctioned inspection of company employment policies conducted by EFF leader Julius Malema and his party this week.

This was Western Cape Judge President John Hlophe’s parting shot after delivering a ruling reversing a decision by a lower court to send Zandile Mafe who is accused of setting the national assembly on fire.

The late afternoon ruling dealt the state a huge blow as Hlophe ordered that Mafe must be released from the Valkenberg psychiatric hospital first thing on Wednesday and be taken to a correctional services facility.

“In the event of the bail application not being successful, I can guarantee you, the doors of this court are open, as soon as the record has been made available, I will convene a full bench to hear that. In this province, justice is guaranteed.”

Adv Mpofu had approached the court on behalf of Mafe to set aside the decision taken by the Cape Town magistrate’s court on January 11 to refer Mafe to Valkenberg psychiatric hospital based on a preliminary report.

Mpofu said the preliminary psychiatric report conducted by Dr Zelda van Tonder was available to the prosecution seven days before the day of the court proceedings but was never given to the defense.

“As of the 4th of January, Mr [Luvuyo] Godla appeared as a legal representative officially for Mr Mafe but was still not furnished with this document.

The EFF has called on basic education minister Angie Motshekga to ensure that pupils who dropped out of school due to Covid-19 are readmitted.

This comes after the basic education department on Tuesday revealed that up to 700,000 pupils had dropped out over the past two years.

The department estimates that between 150,000 and 700,000 pupils dropped out of school due to Covid-19 disruptions.

In a statement, the EFF said the huge dropouts were due to “the directionless leadership within the department”, worsened by rotational timetabling and lack of adequate support for educators and pupils.

The party said it was concerned that the department had not outlined plans to ensure that pupils who left the education system were readmitted.

The late King Goodwill Zwelithini’s first wife, Queen Sibongile, and her two daughters -- Princess Ntandoyenkosi and Princess Ntombizosuthu Zulu-Duma -- are challenging the validity of his will.

She, in turn, appointed King Misuzulu kaZwelithini as her successor in her will.

The court case has divided the AmaZulu royal house and forced the KwaZulu-Natal government to put the king's coronation on hold.

With just a day left until the reopening of schools, three provinces are racing against time to allocate thousands of pupils space.

Schools will reopen on Wednesday in inland provinces – Gauteng, North West, Free State, Limpopo and Mpumalanga.

Lights fail during Cyril Ramaphosa's thank-you speech to business

The ANC president finished his speech in the dark before leaving the venue

The lights went out at the party's gala dinner while President Cyril Ramaphosa was thanking the business community for its financial support.

Before the lights failed, Ramaphosa was expressing his gratitude to those who had stood with the ANC.

“Apart from signifying your financial support by being here, this is proof that you still have trust in the ANC. We thank you for helping the ANC achieve sustainability and stability — for having the courage to come tonight to be associated with the ANC”, he said.

Ramaphosa had just assured business that economic recovery plans were in place and that the ANC renewal project was not just a pipe dream. The president had also admitted that the ANC NEC was concerned about security breaches that led to attacks on institutions such as parliament.

President Cyril Ramaphosa delivered a speech to investors and various ANC dignitaries at an ANC gala dinner in Polokwane, Limpopo on January 7 2022. Ramaphosa made a hasty exit as the power cut towards the end of his speech.

Ramaphosa had to finish his speech in the dark and project his natural voice as the power went off.

After the speech, he was whisked out by his security detail and deputy president David Mabuza and national chairperson Gwede Mantashe also left.

Electricity was restored 15 minutes later.

The Gala dinner is a fundraiser for the party with patrons dishing out huge amounts of money to secure tables at the event.

ANC treasurer-general Paul Mashatile is the party's fundraiser and would have been responsible for organising the event.
