The delayed trial of Rev. Tim Omotoso continues after a month break. It’s been 4 years since his unlawful arrest, incarceration and denied bails without reasonable grounds.
Last month, March 2021, the Defence attorney Peter Daubermann had made an application to the court for the state to hand him the email correspondences between the former state prosecutor, Cerfontein and the current state prosecutor, Ntelwa - due to suspicions that Ntelwa had been misleading the court through the state witnesses.
Initially, the state refused to submit the requested documents but Judge Irma Schoeman made ruled in favour of the defence and instructed the state to bring the documents to court.
Yesterday, 26th of April 2021, the emails correspondences were presented to the court, however, Daubermann noticed that the emails had been tampered with and there were missing paragraphs.
In one of the emails that were presented in court by the state was read out, and it appeared that former Judge Makaula knew about the witnesses staying in his house which he denied in 2019.
In another email, it appeared that Advocate Cerfontein removed herself from the trial because witnesses kept on changing their statements, which was going to put her in jeopardy. So she then decided to withdraw on "ethical reasons" because she didn't want to draw attention.
Daubermann put it to the court again, that the emails do not have enough information and also the names of some witnesses have been blotted, and the state should tell the court who the witnesses are that were removed because of "irrelevancy"
The state objected Daubermann's request and put it to the court that there's no need to include everything, some things are irrelevant and the email is not meant for "OTHER EYES"
