BUHARI’S LETTER ADDRESSING OSINBAJO AS NATIONAL COORDINATOR CAUSES UPROAR IN SENATE HOUSE.

President Muhammadu Buhari’s letter to the National Assembly informing the
Parliament of his medical vacation in London on Tuesday caused a brief
drama.

This is coming about forty eight hours after the President traveled to the
United Kingdom (UK) ‎to see his doctors.

Trouble started when Senator Mao Ohuabunwa (PDP, Abia), raised a point of
order to draw the attention of the Senate to what he described as
deficiencies in the letter addressed by President Buhari.

He said President Buhari was ambiguous in his letter, by claiming that
Vice President Yemi Osinbajo will coordinate the activities of the country
in his absence, without stating a time frame.

The senator argued that the letter should be returned to the presidency,
in order to reflect what he said were appropriate requirements captured in
Section 145 of the 1999 constitution (as amended).

Quoting Section 145 of the 1999 Constitution (as amended) Senator
Ohuabunwa said: “Whenever the president transmits to the President of the
Senate and the Speaker of the house of representatives, a written
declaration that he is proceeding on vacation or is otherwise that he is
unable to discharge the functions of his office until he transmits to them
the written declaration to the contrary, such function shall be discharged
by the Vice President as Acting President.

“Mr President, I do not think in our constitution we have anything like
coordinating President or coordinating Vice President. It is either you
are the Vice President or you are the Acting President and any letter
should be unambiguous and very clear.

“So, I am saying that this letter really does not convey anything because
coordinating has no space or any place in our constitution. We have been
having letters like this. But we need to know who to deal with as a
Senate.

“This is the highest legislative body of any country and if you are
sending us a letter, it should be direct and unambiguous. So, I am saying
that this letter, for me, is not right and should be sent back.”

He was immediately countered by the Senate Leader, Senator Ahmad Lawan
(APC, Yobe), who said there was nothing wrong with the letter.

Lawan called on the Senate President, Bukola Saraki to rule Ohuabunwa out
of order, a request quickly obliged.

He said:‎ “Mr President, let me say that the point of order raised by my
colleague and the explanation that subsequently followed should not have
been and my responses are simple.

“I still rely on the first paragraph of that letter which Mr President
wrote to this Senate and read by the President of the Senate. I will read
section 145 of the 1999 Constitution as amended.

“Any other word in this letter or indeed anywhere else is irrelevant. I
therefore feel that Mr President has done what the constitution requires
him to do and I urge this Senate not to go ahead to discuss this because
its not an issue. We have the budget and so many other serious issues for
us to discuss and Nigerians are waiting.”

Saraki, in his ruling, said President Buhari acted within the confines of
the law.

Saraki said:‎ “I think it is a very clear issue and what should be guided
by is the constitution and I think that it is clear. The letter has
referred to the constitution and there is no ambiguity in the
constitution. So, I do not think there’s any issue there. Let me first
rule you out of order Senator Mao.‎”

Saraki, had at about 11.5am formally read the letter of President
Muhammadu Buhari, wherein the former informed the parliament of his long
medical vacation to the United Kingdom (UK).

Saraki, while reading the letter, told his colleagues that the Vice
President , Professor Osinbajo will perform the functions of the President
while he is away.

The letter reads: “In compliance with section 145 (1) of the 1999
constitution as amended, I wish to inform the Distinguished Senate that I
will be away for a scheduled medical followup with my doctors in London.
The length of my stay will be determined by the doctor’s advice.

“While I am away, the Vice President will coordinate the activities of the
government. Please accept the Distinguished Senate President the
assurances of my highest consideration.”

This is the third time President Buhari has transferred power to Professor
Osinbajo since his inauguration in May 2015.

The first time was on February 5, 2016, when the President embarked on a
five-day vacation.

The second was in June 2016 when Buhari traveled to the UK for treatment
of what the Presidency described as an ear infection.

WARRI- PROTESTING elders, leaders, women and youths of Ugborodo, an Itsekiri community in Warri South-West Local Government Area, Delta State, have laid siege to the Escravos Tank Farm, belonging to Chevron Nigeria Limited, CNL, alleging neglect and discrimination by the multinational oil conglomerate.

Vanguard learned that the angry villagers, who set bonfires occupied the company’s premises since Tuesday and remained their till this morning.

Reports from the area said that the villagers cordoned the gate preventing access in and out of the company through the gate.

While the villagers were protesting outsiders, some of affected workers complained inside.

However, the company airlifted some workers out with helicopters, while tension has enveloped the area.

Security agencies were making efforts to calm the irate villagers, who refused to leave the company until their demands were looked into, accusing the firm of playing hide and seek with them.

Contacted, General Manager, Policy, Government and Public Affairs, CNL, Mr. Deji Haastrup, simply stated: “We are engaging them.”

Youth President of the community, Mr. Ofe Nene, confirmed the siege to Vanguard, Wednesday morning, that the company was breaching the Local Content Policy, LCP, put in place by government to regulate its operations with host communities.

He said: “The first thing is that there is supposed to a New Town project in Ugborodo because of the enormous Chevron project in the area and impact on the people, but the company has decided to abandon the project because it believes the people do not know their rights and cannot speak.”

“Also, it is about doing turnaround maintenance, TAM, but for about two months that we complained in a letter to them that they are not carrying us along, they have been deceiving us. We are in Ugborodo, but they will invite us to a meeting in Warri, when we get to Warri, they will either tell us that the date is not feasible or that so and so management official was not available,” he said.

Nene said: “They take us as fools, as people who do not know their left from their right, which is why they treat us this way. We know about the LCP, but they are engaging our people like without condition of service as we are slaves.”

“For instance, we have over 400 community people with them, they make them to work for six months or so, after that, they would sack them, make them to stay at home for a month or two, then they say that they have reengaged them again. Some of them have been working for over 14 years and there is not condition of service,” he bemoaned.

Another villager, who spoke on phone, added: “They do not consider us in employment; they just want to make casual workers for eternity. Ugborodo is host to over 200 oil wells, why should they treat us as if we are inconsequential.”

“Even the Federal Government is also neglecting us; we have not representation in the federal government as I speak to you. The appointment we have in the NDDC, they have taken it away from us,” he asserted.

Senate rejects bill that seeks to make women equal to men

ABUJA- A bill seeking to guarantee women equal rights with their male counterparts, was, Tuesrday, thrown out of the Senate plenary, when it was presented for consideration.

The bill, which was presented for consideration by Senator Biodun Olujimi, PDP, Ekiti South, incur the wrath of senators, mainly from the Northern part of the country, who did not only slam those behind it but also described it as anti-Islam.

But the bill's sponsor,Senator Olujimi, in her lead debate,explained that its purpose was to permit women to have equal rights with men in marriages,education and employment.

She said this had become compelling in view of increasing discrimination against women in education and employment.

The bill also sought to eliminate discrimination against any person irrespective of his gender on any ground including sexual violence against women.

According to Olujinmi, gender discrimination often makes women insecure, denies them meaningful employment and exposes them to discrimination and exploitation.

She said: "The fact that disparity of gendered pricing still exists within today's society shows that women still continue to be disempowered in many aspects of economic life.

Falae, SDP deny receiving N100m from CBN

THE Social Democratic Party, SDP, yesterday denied that N100million was transferred to the company account of its Chairman, Chief Olu Falae, from the Central Bank/ Joint Trust Dimension Nigeria Limited.

This was contained in a statement issued in Akure by the state Publicity Secretary of the Party Remi Olayiwola.

According to the statement; “The party and it’s national Chairman never had any business dealing or transaction whatsoever with either the CBN or the Joint trust Dimension Limited.

“ We wish to inform the general public that it is the same amount sent by the Peoples Democratic Party, PDP, to the SDP as a result of their inter-party agreement that is now being re-presented to the public through another dubious channel in order to portray Chief Falae and the SDP in bad light.

“It is falsehood. It has failed in the past and it will fail again no matter how many times our detractors attempt to smear our name obviously for political reasons.

The party noted that “ On many occasions in the recent past , chief Falae had reiterated that the sum of N100m was transferred by the PDP through its former Chairman, Board of Trustee, chief Tony Anenih to the SDP through him as the National Chairman of his own party.

“ Chief Tony Anenih in his own statement has confirmed this transaction which was based on a written inter party agreement which existed between the two parties before the last Presidential election.

“It is also a statement of fact that the national secretariat of the SDP has confirmed through a widely publicized Press Conference that the N100m was received in full by the party haaving remitted to the party account by Chief Olu Falae.''

“ We strongly believe that this new story is yet another attempt aimed at further embarrassing Chief Falae and especially the SDP which the initiators now perceived to be towering in the Politics of Nigeria .

“ The EFCC at one point said that the N100million was from Dasuki, a lie which has now been effectively debunked.

“ Now they are claiming that the money was from a company known as Joint Trust Dimension Nigeria Limited, an entity totally unknown to Chief Falae and the SDP.
The EFCC had alleged in the reports that an alleged N100 million was traced to the account of Chief Falae while N840million was traced to the account of Chief Fani Kayode and some members of the PDP ahead of the last presidential polls.

Chief Falae, according to the anti graft agency received the money through his company- Marreco Limited, where he is the Chairman and paid it into the company’s United Bank of Africa Plc account.

Electricity, corruption crippling Nigerian firms

ABUJA—The World Bank has identified power, corruption and access to finance as the bane of the private sector in Nigeria.

According to the bank, this has resulted in as high as 17-20 per cent losses in sales recorded by Nigerian firms.

To make matters worse, rather than improving, power generation dropped again, yesterday, to 2,884.30 megawatts, MW, a development the Ministry of Power struggled to explain.

This came on a day the Federal Government said it was determined to cut down on Nigerians’ spending on foreign products by introducing and enforcing a local patronage policy that will drive patronage of made-in-Nigeria goods, especially by government.

The present precarious situation of companies in Nigeria is contained in the report of the bank’s study, entitled: “The Nigerian private sector and its challenges,” presented by the bank’s Specialist, Finance and Private Sector, Mr. Michael Wong, in Abuja, yesterday.

According to Wong, the study was conducted within the period of April 2014 to April 2015.

He noted that 48 per cent of the 28,000 firms sampled identified inadequate power supply as their greatest challenge, adding that the study covered 19 states of the federation.

Generation capacity

Generation capacity fell from 3,192.00MW last recorded on Monday, after reaching a peak of 4,326.80MW.

Spokesman for the Power Minister, Mr. Hakeem Bello, had promised to find out what was responsible for the drop, but could not at press time, especially as reports had quoted the minister, Mr. Babatunde Fashola, as saying that generation had increased appreciably to above 4,000MW.

The drop in output meant a corresponding reduction in the quantity of power allocated to the 11 distribution companies, DISCOs, for onward distribution to homes and businesses.

The Federal Government after apologising for the very poor power situation, promised Nigerians of improvement in the comings days.

Data from the Nigerian Systems Operations, NSO, Department of the Transmission Company of Nigeria, TCN, website,www.nsong.org, indicated that power generation peaked at 2,884.30MW as at 12:57PM:00 on Tuesday.

The 2,884.30MW was distributed to the 11 electricity Distribution Companies, DISCOs, as follows:

Ikeja - 432.65MW;

Abuja - 331.69MW;

Eko - 317.27MW;

Benin - 259.59MW; Enugu - 259.59MW; Ibadan - 374.96MW;

Jos - 158.64MW;

Kano - 230.74MW; Kaduna - 230.74MW;

Port Harcourt - 187.48MW; and

Yola – 100.95MW.

Other business challenges

The two other worst problems of Nigerian businesses, according to the World bank report, are corruption and access to finance.

The report said: “When asked to take the severity of investment climate constraints, Nigerian managers of formal firms were most likely to report electricity, corruption and access to finance as serious obstacles to business performance.

“Firms in Nigeria are significantly more affected by power outages than firms in comparative countries. Nigerian firm managers reported that losses due to power outages were approximately 17 per cent of sales.

“Firms in Lagos and other Southern states reported the highest losses, equivalent to more than 20 per cent of sales.

“There are slight differences across states. Electricity and corruption are among the top three constraints throughout Nigeria. Firms in Northern states rank political instability among the biggest constraint."

However, the drive to shore up Internally Generated Revenue, IGR, of the last Lagos State government under Mr. Babatunde Fashola was considered an impediment to operational growth by companies that responded in the study.

“In Lagos, tax rates rank among the top constraints, and in other Southern states, the top constraint is access to finance,” Wong said.

The report called for greater attention to the power sector in order to make Nigerian companies competitive, both at the regional and global levels.

In her presentation on “More, and More Productive, Jobs for Nigeria", another official of the bank, Ms. Kathleen Beegle, noted that the nation was facing a major challenge of a population that was growing more than the economic growth rate.

She noted that the wide gap in the socio-economic well-being between the North and the South had continued to increase and had been exacerbated by the high fertility rate in the North where girls get married at early age and give birth to many children.

Ms. Beegle said the study indicated that those in that category were categorised as “inactive” going by the International Labour Organisation’s definition because they were illiterate and hardly ever get into meaningful employment.

She noted that Human Development Index results had shown that Northern Nigeria had largely lagged behind in virtually all areas of development, owing to antagonism to formal education, as well as cultural and religious beliefs that have continued to increase the rate of poverty in most areas of that region.

According to her, the refusal to moderate birth rate in most parts of the North and the almajiri culture have contributed not only to an increasing poverty rate but also now directly responsible for the level of insecurity in much of the North.

Made-in-Nigeria goods

Meanwhile, the Federal Government said, yesterday, it was determined to cut down on Nigerians’ spending on foreign products by introducing and enforcing a local patronage policy that will drive patronage of made-in-Nigeria goods especially by the government.

The Minister of Industry, Trade and Investment, Dr. Okechukwu Enelamah, stated this during the opening session of the 3rd annual Manufacturing Partnerships for African Development and Nigerian Manufacturing Expo 2016, organised by Clarion Events, Spintelligent Pty Limited in collaboration with Manufacturers Association of Nigeria, MAN in Lagos.

Represented by Mrs. Omotara Awobokun, Director of Trade at the Ministry, the Minister said: “We are working on a Memo for local patronage at the ministry and we are about to present it to the Federal Executive Council for approval.

"When the policy takes effect, it will compel government agencies, ministries and departments to be in the vanguard of purchasing made-in-Nigeria products.

“The administration has identified the manufacturing sector as one of the key drivers of the nation’s economic diversification process. The strategic plan is to support increased production of goods and services, encourage more patronage of locally produced goods and services and export processed goods to earn much needed foreign exchange.

"More than ever before, we shall pursue these objectives with vigour and a determination to succeed. My presence here is to identify with you as a starting point in this process of economic diversification and to appeal to all Nigerians to buy Made in Nigeria products as a matter of service to our nation.

“The event is timely as it is coming at a time when the nation is faced with the urgent need to diversify the economy in the light of dwindling price of crude oil in the global market which has had significant negative impact in the Nigeria economy with depletion of our foreign reserve and decline in GDP growth from 6 per cent in 2014 to 3 per cent in 2015.”

According to the Minister, the Federal Ministry of Industry, Trade and Investment was strategically positioned to play a pivotal role in the economic diversification agenda of the government.

Also speaking, President, Manufacturers Association of Nigeria, Dr. Frank Jacobs, commended the anticipated policy and described government as the biggest spender in the economy.

Tompolo appeals court order for his arrest

Chief Government Ekpemupolo (alias Tompolo) has filed his appeal before the Court of Appeal sitting in Lagos, challenging the order of the Federal High Court, Lagos, for his arrest.
Justice Ibrahim Buba of the lower court had, on January 14, 2016, issued a warrant for Tompolo's arrest. On January 27, 2016, Tompolo filed an application before the court, to set aside the said warrant of arrest.

On February 8, 2016, the said application was argued and dismissed by the court. Tompolo, thereafter, appealed against the ruling of the lower court, on February 18, 2016.

Determined to pursue the appeal, Tompolo has since compiled the record of appeal in the appeal and has forwarded same to the Registry of the Court of Appeal, Lagos.

It was gathered from his counsel that the 170-page record of appeal was received by the Registrar of the Court of Appeal, Nassara Williams, on March 3, 2016, with Appeal No. CA/L/240/2016. The prosecutor, the Economic and Financial Crimes Commission, EFCC, has also been duly served with the said record of appeal.

Tompolo also filed his appellant’s brief of argument, through the law firms of Tayo Oyetibo, SAN and Ebun-Olu Adegboruwa, on March 11, 2016, thus invoking the judicial process for the prompt and effective determination of the said appeal.

Tompolo, in the appeal, is complaining that the trial court erred in law, in refusing to set aside the warrant of arrest issued against him, when there was no evidence to show that he had been notified of the summons and the charge pending against him, before the court.

Tompolo also complained that the trial court ought to have ascertained that the respondent, that is the EFCC, duly complied with the order of the court for substituted service, by posting the charge at the correct address as contained in the order of the court.

Tompolo stated further that the application leading to the issuance of the warrant of arrest was not competently placed before the court, as the counsel that signed and filed it on behalf of the EFCC failed to affix his seal thereto, as required by law.

Tompolo is thus asking the Court of Appeal to set aside the warrant for his arrest and vacate all subsequent proceedings emanating from the flawed process of the criminal charge.

He is further seeking that the charge against him should be transferred from the current judge, to another judge of the Federal High Court.

N3.3trn scam: Senate vows to probe Auditor-General’s report

ABUJA —THE Senate,yesterday, said it would carry out thorough investigation into the audit report presented to the Clerk of the National Assembly, Monday, by the Auditor-General of the Federation,Mr Samuel Ukura.

The report had said that N3.2 trillion was allegedly not remitted to the Federation Account by the Nigerian National Petroleum Corporation, NNPC.

Senate spokesman, Abdullahi Sabi, said the red chamber would stop at nothing to probe the audit report.

Senator Sabi, who spoke to newsmen in Abuja, yesterday, said the intending probe of the report was in line with the resolve of the 8th Senate to stand itself out from the past ones.

He said: “The 8th Senate has chosen to be different as we have stated severally since we came on board and for which we came up with our legislative agenda to make us different from the past. This is because we are in the season and period of change and we want to seriously key in to that.

“Along that line, you could see the courage that we have to make some differences from what was obtained in the past and on this note, we have passed reports of some committees such as the Treasury Single Account, TSA, which is a classical example.

“Through that exercise, we were able to save the country N7 billion. There are similar works that have been done. We want to say that since we have chosen to be different, we urge Nigerians to wait and see what we will make out of the investigation.

“Without holding forth for the past assemblies, I want to say that it is not as if they have not been doing anything about the past audit reports, perhaps they have not taken their action up to the scale that would have made a huge impact that people want to see.

“If that is what the Auditor-General meant, I agree with him. The Auditor-General is raising a query, it is not an indictment. So, when he raises his queries, the essence of the Public Accounts Committee is to invite those parties involved in the query and through the instruments of their own work , investigate all the issues by seeking for clarification.

"At the end of the day, where they have infractions or infringement on certain procedures, they met out appropriate sanctions as stipulated by extant rules and regulations.”

JAMB accuses tutorial proprietors of sponsoring protests

SCORES of Joint Admissions Matriculation Board, JAMB, candidates and members of Association of Tutorial School Owners of Nigeria, yesterday, protested against what they described as the poor conduct and outcome of the recent examination conducted by the board.

The protests which took place in Lagos and Ilorin were largely peaceful even as the protesters demanded for the resignation of the Registrar of the examination board, Prof Dibu Ojerinde.

The placard carrying admission seekers in Lagos, marched to the Lagos State House of Assembly demanding for the resignation or dismissal of Prof Ojerinde.

At the scene of the protest, Vanguard gathered that most of the aggrieved protesters blamed the leadership of JAMB for their failures, adding that the electronic devices used for the examination malfunctioned.

Speaking, a protester, Mr. Kalejaiye Joshua said; ‘’When the result came out my English was 37, Mathematics, which I am not good at, I got 47. My total score was 220, but when I went to print it out yesterday, I saw 164. It is unfair. I spent eight hours to Igbajo Polytechnic, in Osun State from Ketu, Lagos.’’

Reacting to the development, the board’s Head of Media, Dr. Fabian Benjamin accused proprietors of private schools, whose facilities were not used for the examination of being behind the protests.

Benjamin in a statement said: ‘’The protests were being sponsored by some proprietors whose examination centres were lacking in all the indices needed for a successful Computer Based Test (CBT) examination.’’

“The attention of the Board has been drawn to a planned protest tomorrow over the Board’s activities by individuals who called themselves education consultants. JAMB has called for calm and advised candidates to always avail themselves of the opportunity provided by the board through its public complaints unit to vent their grievances and not to allow blackmailers use them for any selfish interest."
