According to PMG records "The President does not automatically sign a bill into law. He has the opportunity to assess the constitutionality of a bill and can refer it back to Parliament for reconsideration if he has any reservations. When exercising this right, the President seeks counsel and considers submissions and PETITIONS made to him."
BELA Bill Awareness 🚨🚨
The BELA Bill needs to be sent back to the drawing board. The sensible recommendations made by citizens and residents of SA during BELA-Bill related hearings need to be taken into consideration. As South Africans we say: Nothing about us, without us!
The BELA Bill seeks to amend the South African Schools Act (SASA) of 1996 as well as the Employment of Educators Act (EEA) of 1998. Some of the changes and additions to the current Acts include:
📢Making Gr R compulsory.
📢Criminalising parents who do not comply with certain regulations.
📢Introducing additional laws which will have a negative impact on the home education sector.
📢Closing primary schools with less than 135 learners, and secondary schools with less than 200 learners in.
📢In addition to this the Bill will also grant powers to the Minister to make regulations regarding a range of serious matters (one of which relates to the management of learner pregnancy).
If this Bill is pushed through there will be an enormous power shift. The HoD, MEC and the DBE will have the final say! This all translates into the centralisation of our public school sector.

Hmm...🤔 On the 2nd of August 2023 Committee Chairperson Ms Bongiwe said (very nonchalantly) that parents are accepting the clause that is proposing that parents be criminalised? Interesting!
Homeschooling and Registrations in a BELA Bill World...
While it is true that a parent who has registered their child for home education, and has not received a response after a 60 day period, is by default considered to be registered. It is also true that, while a registered home educated learner is of compulsory school attending age, the HoD may nullify a registration.Yes, this will involve an entire process, and the parent may challenge the DBE's decisions, but all of this sounds very inconvenient.
We need to ask ourselves:
1.What have previous encounters with the DBE resulted in? 2. Have they heard us out in the past? 3. If the best predictor of the future is the past, then what will future deliberation processes yield?

As you know, the ideas contained in the Bela Bill are not law yet. A lot can happen between now, and when this bill is sent to the President to sign off on. So, don't lose heart or hope, instead...Get ready to make written submissions, and to make them count!
IT IS crucial that we help shape the BELA Bill into something all citizens could possibly live with for the next 10 to 15 years, and if we can't do that then it needs to be squashed in its totality. Let the South African Schools Act 84 of 1996 then remain as is. Unaltered!

Ons het via 'n Concerned Citizen opname/"survey" bewus geraak van die feit dat 1300+ oumas en oupas, ouers, onderwyssers en lede van skole se beheerliggame eers besef het watter impak die BELA-wetgewing op hul kinders se toekoms sal hê toe die proses (wat die publiek se deelname behels het) reeds voltooi was. Dis jammer, maar weet asseblief dat daar nog 'n ongelooflike belangrike fase voorlê! Ons (die tuisskoolgemeenskap) wil u uitnooi om gedurende die volgende rondte saam met ons te werk.
Agtergrond: Die BELA-wetgewing kan jul skool se voortbestaan in gevaar stel... Alhoewel Gr.R dalk deur die staat gefinansier mag word sal dié voordeel teen 'n enorme prys kom! In 'n BELA-wetgewing-wêreld sal jul skool se beheerliggaam nie mag besluit in watter taal jul skool lesse gaan aanbied nie. Julle sal ook nie mag besluit wie by jul skool inskryf en wie nie. En dit is net die punt van die BELA-wetgewing-ysberg!
