The direct examination of Herson would have only supported the answer filed by. Tod Deck before he ditched for non payment which used verbagesuch as Denny's efforts to "frustrate Jim's efforts to fix up his property.
Julie Ann Gengler was up all night filing exhibits that proved where the money came from that went into these houses, there was abundant proof of what had really happened between Dennis and his brother James but by the time Judge Neary got around to his deliberations and rendering a verdict 6 months later the sands of timehad washed away all the fact and Judge Neary could not even identify the "plus two" part of the saga incorectly referring to 4105 Country Club and 1727 S Hennepin as the plus 2.
The real plus two were 3311 6th St and 1304 Villa. They were the 2016 tax deeds that Tod Deck forgot to include in his answer and never sued over which provided $150,000 net profit to Dennis by themselves.
It is my opinion that failing to do hs job in a timely manner and just mostly doing a copy and paste job from petition to ruling was an act of malfeasance by itself and that a careful examination of petition/answer and transcripts/exhibits and ruling would support my opinion.
All of it easily done because Dennis made it so that his brother would be unreperesented by counsel making it possible to shift his financial statement by almost 2,000,000 from black to the red.

Undue influence, criminal conspiracy, I have not talked much about extortion.
Here is an example of extortion. On Wed my brother Steven D Gengler who resides in Dakta Dunes SD stopped by my daughter's house to inform that, "the lawyer is studying all of this stuff I am putting on Facebook. He thinks that I can be put away for 20 years for sharing protected health information about my mother" .
"What protected health information could that be?" I inquired.
"You put on Facebook that mom has vascular dementia" he responded nervously.
My personal opinion is that my mother had that or some intelectual disorder since before my father died but my father took care of things and hid her disability from view. In July of 1994 he expressed anxiety about my mother's ability to, "stand up to them" after he dies. I think that his fears were warranted. The dirt on his grave was still fresh when Dennis J Gengler had her sign her first document. A power of Atty that no one knew about. Like the deeds signed October 21 2012 he did not record the document. He just held it.
According to Steve I have 6 hours to delete all of these posts or I will be arrested and I will be going to prison. He has his phone out and is recording everything. Extortion is different from undue influence because it comes with threats of a terrible consequence.
In 2018 Dennis J Gengler told Herson Hernandez that if he showed up at the trial of EQCV174441 per his subpoena to testify that Dennis would call the INS and have him deported. Herson was a key witness in the defense of a petition that alleged that I had victimized my brothe Dennis by selling him 6 properties for $60,000. His lawsuit alleged that as part of this oral agreement I had also agreed to fix up the properties that I sold but had breached my agreement. Therefore Dennis had to spend approximately $464,000 fixing the properties and was Therefore entitled to liquidated damages for that amount. He furthermore alleged that I acted fraudulently
