Judge Reed O'Connor has denied ATF's request to stay his decision in the FRT case. He did extend the time frame of 30 days to six months for ATF to return FRT and WOTs they confiscated from dealers and consumers. ATF is in process of appealing the decision, but the same court ruled against the ATF’s brace rule so they are unlikely to get any sympathy.

The 8th Circuit ruled today that the ATF’s brace rule likely violates federal law. They cited the 5th Circuit decision that vacated the rule and reversed the district court decision which denied preliminary injunction. This sends it back to the district court to be heard with the injunction in place.

ATF announced new reporting requirements for FFLs in the southwest. Similar to multiple handgun reporting, buying 2 or more semi-auto rifles that have detachable mags in a 5 day period will trigger a mandatory report to the ATF including purchaser info, make, model, and serial number. This info will go into the same digitized database of fi****ms records that ATF falsely claims is not a registry in defiance of federal law.

While it's disappointing that SCOTUS isn't taking action on these cases, the translation is they does not want to take cases all the time. Lower courts have a clear directive with Bruen and should do their job according to the law, not politics. Only when they get all the way through the courts will SCOTUS take on the cases.

Disappointing to say the least, but the case is not over. SCOTUS basically took their usual hands off approach until the entire lengthy appeal process is exhausted. Justice Clarence Thomas called the 7th Circuit’s ruling “nonsensical” and said “It is difficult to see how the Seventh Circuit could have concluded that the most widely owned semiautomatic rifles are not “Arms” protected by the Second Amendment.” He went on to say that when it comes back as final judgment, SCOTUS should review the case.

Roll out a supposed surgeon to spew absolute lies and call it "science". Where have we seen that before? The surgeon General is a dispicable liar. When you throw out the 0-1 age group you drop the biggest amount of real childhood deaths from sudden infant death, suffocation and other illnesses. Then you add in the gang members up to 19. Politicians are laying the groundwork with lies to push their next big gun control push through "public health emergencies". The real numbers are far different.

More good news from the 5th Circuit. Judge Reed O'Connor has vacated the unconstitutional brace rule in the FPC case Mock v Garland. We'll be hearing more in August as the district court is set to hear the combined brace case then and the ATF is sure to cry to SCOTUS, but this is a big win.

ATF’s unconstitutional "engaged in the business" rule has been enjoined while the case is heard. By issuing a preliminary injunction, the judge indicates that plantifs are likely to succeed in proving the rule unconstitutional. ATF will of course appeal the preliminary injunction, but in the 5th circuit the track record on these cases do not favor ATF.

Guilty on all three counts. There is a lot going on in this case. There is certainly the 2A argument that non-violent felons should not lose their gun rights, but it is currently the law and many normal people are behind bars for it. Another, the case is clearly a distraction from many far more serious crimes. Biden is on the record saying he would not pardon his son, but he probably doesn't remember it. What are your thoughts on this case?
