Part 1 - General Provisions
§ 16-11-4. Advocating Overthrow of Government

a. As used in this Code section, the term:
1. “Organization” means any corporation, company, partnership, association, trust, foundation, fund, club, society, committee, political party, or any group of persons, whether or not incorporated, permanently or temporarily associated together for joint action or advancement of views on any subject.
2. “Subversive organization” means any organization which engages in or advocates, abets, advises, or teaches, or which has a purpose of engaging in or advocating, abetting, advising, or teaching activities intended to overthrow, to destroy, or to assist in the overthrow or destruction of the government of the state or of any political subdivision thereof by force or violence.

b. A person commits the offense of advocating the overthrow of the government if he knowingly and willfully commits any of the following acts:
1. Advocates, abets, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the state or any political subdivision thereof by force or violence;
2. Prints, publishes, edits, issues, circulates, sells, distributes, exhibits, or displays any written or printed matter advocating, advising, or teaching the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the state or of any political subdivision thereof by force or violence;
3. Assists in the formation, participates in the management, or contributes to the support of any subversive organization, knowing the purpose thereof;
4. Becomes a member or continues to be a member of a subversive organization, knowing the purpose thereof;
5. Destroys any books, records, or files or secretes any funds in this state of a subversive organization, knowing the organization to be such; or
6. Conspires with one or more persons to commit any of the acts prohibited by this Code section.

c. A person convicted of violating any provision of this Code section shall be punished by a fine of not more than $20,000.00 or by imprisonment for not less than one nor more than 20 years, or both.

§ 16-11-3. Inciting to Insurrection

a. A person commits the offense of inciting to insurrection when he incites others to overthrow or attempt to overthrow the representative and constitutional form of government of the state or any political subdivision thereof and he or they commit any violent act in furtherance thereof.

b. A person convicted of the offense of inciting to insurrection shall be punished by imprisonment for not less than one nor more than ten years. Inciting to insurrection shall be bailable only in the discretion of a judge of the superior court.

Protecting Privacy with the Founders' Strategy

Last week, an Utah law putting limits on warrantless biometric surveillance went into effect. This is another advance in Utah’s step-by-step approach to protect privacy and limit the surveillance state, that should absolutely be replicated in the other 49.
The new law prohibits government entities, including law enforcement agencies, from obtaining biometric surveillance information without a warrant. This includes iris scans, voice recognition, heart rate scanners, software that analyzes a person’s gait or distinctive movements, etc.

This new law is the 8th passed in Utah in the last decade - closely tracking the founders' advice and strategy for moving things forward in support of the Constitution and liberty.
As Thomas Jefferson wrote in 1790, “The ground of liberty is to be gained by inches …We must be contented to secure the liberty we can get from time to time, And eternally press forward for what is yet to get.”

The American Revolutionaries certainly understood this first-hand. In response to the hated Townshend Acts, John Dickinson penned the most widely-read documents on American liberty until publication of Thomas Paine’s Common Sense in January, 1776.
The “Penman of the Revolution” signed off the first of his twelve Letters from a Farmer in Pennsylvania with an important maxim – Small things grow great by concord.

Dickinson wrote, and the colonists understood, that each step forward for liberty was essential, because, as Jefferson emphasized years later, “It takes time to persuade men to do even what is for their own good.”

Success against the largest government in history requires more than tough rhetoric or big talking in social media posts. It requires an incredibly good strategy – a step-by-step approach, as advised by the founders.

The national surveillance state has been growing in size and scope for decades. We won’t cut it back down to size in a day by passing a single bill.
There is no silver bullet.
Anyone promising you one is either lying to you, or more likely – has never made an effort beyond posting something online about how anything less than their idea is a “waste of time.”

Think about it.

If you were starving, you wouldn’t turn down a slice of bread just because it wasn’t the whole loaf. You’d eat the slice and then continue looking for more.

This is exactly the approach Utah has taken to push back against the surveillance state. For more than a decade, starting in 2013, the Utah legislature has incrementally built some of the most robust privacy protections in the country with a step-by-step approach. Over that time, Utah chipped away at the surveillance state, passing at least eight separate laws limiting surveillance.

Part 1 - General Provisions § 16-11-1. Treason

a. A person owing allegiance to the state commits the offense of treason when he knowingly levies war against the state, adheres to her enemies, or gives them aid and comfort. No person shall be convicted of the offense of treason except on the testimony of two witnesses to the same overt act or on confession in open court.
When the overt act of treason is committed outside this state, the person charged therewith may be tried in any county in this state.

b. A person convicted of the offense of treason shall be punished by death or by imprisonment for life or for not less than 15 years.

• An illuminating fight over FISA renewal:
If you don't understand the conservative case against renewing the federal government's Foreign Intelligence Surveillance Act, then you might need a refresher course on how our nation's grotesquely politicized intelligence services used it to create the Trump-Russia collusion hoax. Or perhaps you could simply review the Durham Report or the case of deep-stater Kevin Clinesmith. In any case, as Fox News reports, "More than a dozen House GOP privacy hawks have blocked the House of Representatives from advancing a Speaker Mike Johnson-backed bill to renew a controversial federal government surveillance tool known as Section 702 of the Foreign Intelligence Surveillance Act (FISA)." It comes hours after former President Trump posted on Truth Social, "KILL FISA, IT WAS ILLEGALLY USED AGAINST ME AND MANY OTHERS." He's right. It was illegally used against him. The final vote was 193 to 228, with 19 Republicans joining the Democrats to tank the procedural vote. But, as Kentucky Congressman Thomas Massie observed: "Many people have been misled today. There was not a vote on the FISA bill. There was a vote on a resolution that would have allowed FISA, as well as 6 amendments to it, including a warrant requirement amendment, and three other pieces of legislation, to come to the floor." FISA's Section 702 is at issue. As The Wall Street Journal reports: "The concern is that Federal Bureau of Investigation officials have on occasion abused their access to search for American names that aren't plausibly linked to terrorism. The Reforming Intelligence and Securing America Act, championed by Intelligence Chairman Mike Turner, imposes new guardrails as well as criminal penalties for abuse. But it also preserves the ability to surveil and act with dispatch without introducing onerous bureaucratic barriers." Reform to FISA is clearly needed. We'll wait to see what's next.
