No one told the Indiana Department of Education that a teacher at Indianapolis Public Schools filmed and encouraged the alleged abuse of a second grader with disabilities. The state officials who govern teacher licenses found out from the media.

BREAKING: For the 2nd time this week accusations of a fight at Guion Elementary earlier this year that a guardian says landed their young student in the hospital.

According to a tort claim just disclosed a special education elementary student was the victim of a severe physical assault that resulted in a closed head injury and concussion during recess on March 6th.

Attorney Catherine Michael told us her client was struck repeatedly with a closed fist to his face, head, and dragged on the ground and kicked. She says it was caught on video. But as of right now they have not been able to get a copy.

Michael says no staff member stepped in to stop the abuse and the boy was not given immediate medical attention. It wasn't until after school his guardian says she saw his swollen eyes and face and took him to the hospital. Later, according to the tort claim the school called the guardian and grandma and told them staff "is not allowed to intervene and stop students who are fighting."

The family say they filed a police report, but they don't believe the school did nor do they believe they contacted DCS.

A tort notice was hand delivered today to Pike Township Schools. It states the family seeks damages due to negligence causing personal injury among other accusations.

We have reached out to the district for comment.
